10 AN ACT relating
to vehicles; concerning the electronic filing of appli-
11 cations for renewal of
registration; amending K.S.A. 8-129 and K.S.A.
12 1999 Supp. 8-173 and
repealing the existing sections.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. K.S.A. 8-129 is hereby amended to read as follows:
8-129.
16 (a) Applications for the registration of a
vehicle required to be registered
17 shall be made by the owner, by mail or
otherwise, in the office of the
18 county treasurer of:
19 (1) The county in
which such owner resides; or
20 (2) the county in
which the owner has a bona fide place of business,
21 if such vehicle is garaged in such county
for a period exceeding 90 days.
22 Such place of business shall not be an
office or facility established or
23 maintained solely for the purpose of
obtaining registration.
24 Such applications for
registration shall be made upon appropriate forms
25 furnished by the department and every
application shall contain the name
26 of the owner, such owner's residence
address or bona fide place of busi-
27 ness, a brief description of the vehicle to
be registered and such other
28 information as may be required by the
department. If the owner is not a
29 resident of or does not have a bona fide
place of business in this state,
30 the owner may make application for
registration in any county which the
31 department shall designate, except that in
the case of members of the
32 armed forces of the United States, the
application may be signed by the
33 owner's spouse, parent, eldest brother or
sister, in the order named. If
34 the application is made by mail it shall be
accompanied by a fee of $.50
35 for postage and other expenses incidental
to mailing the license plates,
36 which fee shall be in addition to the
registration fee, and the county
37 treasurer shall deposit the sum in the
special fund provided by K.S.A. 8-
38 145, and amendments thereto, to be used for
the purpose of paying the
39 postage, necessary help and expenses. With
reference to every foreign
40 vehicle which has been registered outside
of this state, the owner shall
41 exhibit to the department the certificate
of title and registration card, or
42 other evidence of such former registration
as may be in the applicant's
43 possession or control, or such other
evidence as will satisfy the depart-

1 ment that the applicant is the lawful
owner or possessor of the vehicle.
2 (b) The
applicant for the registration of a vehicle required to be reg-
3 istered, upon the filing of the
application, shall submit a statement cer-
4 tifying that such person has a
certificate of title for the motor vehicle,
5 showing the date and identification
thereof, or file an application therefor,
6 as provided in this act.
7 (c) On
and after July 1, 2001, application for renewal of
registration
8 of a vehicle may be filed
electronically, in accordance with rules and
9 regulations adopted by the
secretary of revenue.
10 Sec.
2. K.S.A. 1999 Supp. 8-173 is hereby amended to read as
fol-
11 lows: 8-173. (a) An application for
registration of a vehicle as provided in
12 article 1 of chapter 8 of the Kansas
Statutes Annotated and amendments
13 thereto, shall not be accepted unless the
person making such application
14 shall exhibit:
15 (1) A receipt
showing that such person has paid all personal property
16 taxes levied against such person for the
preceding year, including taxes
17 upon such vehicle, except that if such
application is made before June 21
18 such receipt need show payment of only
one-half 1/2 the preceding year's
19 tax; or
20 (2) evidence that
such vehicle was assessed for taxation purposes by
21 a state agency, or was assessed as stock in
trade of a merchant or manu-
22 facturer or was exempt from taxation under
the laws of this state.
23 (b) An
application for registration of a vehicle as provided in
article
24 1 of chapter 8 of the Kansas Statutes
Annotated shall not be accepted if
25 the records of the county treasurer show
that the applicant is delinquent
26 and owes personal property taxes levied
against the applicant for any
27 preceding year.
28 (c) An
application for registration or renewal of registration of a
mo-
29 tor vehicle shall not be accepted until the
applicant signs a certification,
30 provided by the director of motor vehicles,
certifying that the applicant
31 has and will maintain, during the period of
registration, the required in-
32 surance, self insurance or other financial
security required pursuant to
33 K.S.A. 40-3104 and amendments thereto.
34 (d) An
application for registration or renewal of registration of a
ve-
35 hicle shall not be accepted if the
applicant is unable to provide proof of
36 the insurance, self insurance or other
financial security required by article
37 31 of chapter 40 of the Kansas Statutes
Annotated. Proof of insurance
38 shall be verified by examination of the
insurance card issued by an insur-
39 ance company, a certificate of self
insurance issued by the commissioner,
40 a binder of insurance, a certificate of
insurance, a motor carrier identifi-
41 cation number issued by the state
corporation commission, proof of in-
42 surance for vehicles covered under a fleet
policy, a commercial policy
43 covering more than one vehicle or a policy
of insurance required by K.S.A.

1 40-3104, and amendments thereto and
for vehicles used as part of a driv-
2 ers education program, a dealership
contract and a copy of a motor vehicle
3 liability insurance policy issued to
a school district or accredited nonpublic
4 school. Examination of a photocopy of
any of these documents shall suf-
5 fice for verification of mail
registration or renewals. On and after July 1,
6 2001, any person filing an
application for renewal of registration of a
7 vehicle electronically, shall be
required to mail a photocopy of any of the
8 documents required by this
subsection.
9 Sec. 3. K.S.A. 8-129 and
K.S.A. 1999 Supp. 8-173 are hereby
10 repealed.
11 Sec. 4. This act shall
take effect and be in force from and after its
12 publication in the statute book.
