9 AN ACT
concerning cosmetologists; relating to provision of services;
10 amending K.S.A. 1999
Supp. 65-1904a and repealing the existing
11 section.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. K.S.A. 1999 Supp. 65-1904a is hereby amended to read
15 as follows: 65-1904a. Any licensed
cosmetologist, esthetician, electrolo-
16 gist, manicurist, or person desiring to
establish a salon or clinic shall make
17 application, on a form provided, to the
Kansas state board of cosmetology,
18 accompanied by the new salon or clinic
license fee established under
19 K.S.A. 65-1904 and amendments thereto. Upon
filing of the application,
20 the board shall inspect the equipment as to
safety and sanitary condition
21 of the premises and if the equipment and
premises are found to comply
22 with the rules and regulations of the
secretary of health and environment
23 and the rules and regulations of the Kansas
state board of cosmetology,
24 the board shall issue a new salon or clinic
license. Nothing herein con-
25 tained shall be construed as preventing any
licensed person from practic-
26 ing cosmetology or electrology in a
licensed cosmetologist's private home
27 or residence if the home or residence
complies with rules and regulations
28 of the secretary and the state board. A
licensed cosmetologist may make
29 application as provided in this section
to provide cosmetology services in
30 a place other than the licensed salon or
clinic or a private home or resi-
31 dence of the licensed cosmetologist.
Excluding services provided by a li-
32 censed cosmetologist in a health care
facility, hospital or nursing home or
33 in the residence of a person requiring
home care arising from physical or
34 mental disabilities, in order to provide
such services, such licensed cos-
35 metologist shall be employed in a salon
or clinic or in the licensed cos-
36 metologist's private home or residence
for at least 51% of the total hours
37 per week employed; and shall attest by
affidavit that such cosmetology
38 services shall be provided only in the
residence or office of the person
39 receiving services. Licensed salons
and clinics may be reinspected in ac-
40 cordance with a schedule determined by the
board by rules and regula-
41 tions or upon a complaint made to the board
that such salon or clinic is
42 not being maintained in compliance with
rules and regulations of the
43 board. The license shall expire on June 30
following its issuance. Any such

1 license may be renewed upon
application accompanied by the salon or
2 clinic license renewal fee made to
the board before July 1 of the year in
3 which the license expires. Any
license may be renewed by the applicant
4 within 60 days after the date of
expiration of the last license upon payment
5 of a delinquent renewal
fee.
6 Sec. 2. K.S.A. 1999 Supp.
65-1904a is hereby repealed.
7 Sec. 3. This act
shall take effect and be in force from and after its
8 publication in the statute book.
