9 AN ACT
concerning wildlife; amending K.S.A. 32-1013 and repealing
10 the existing
section.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section
1. K.S.A. 32-1013 is hereby amended to read as follows:
32-
14 1013. (a) Any landowner or person in lawful
possession of any land may
15 post such land with signs stating that
hunting, trapping or fishing on such
16 land shall be by written permission only.
It is unlawful for any person to
17 take wildlife on land which is so posted,
without having in the person's
18 possession the written permission of the
owner or person in lawful pos-
19 session thereof.
20 (b) A person
licensed to hunt or furharvest and following or pursuing
21 a wounded animal on land so posted without
written permission of the
22 landowner or person in lawful possession
thereof shall not be deemed to
23 be in violation of this provision while in
such pursuit, except that:
24 (1) The
provisions of this subsection (b) shall not authorize a
person
25 to be on such land unless the person
first makes every reasonable effort
26 to locate the landowner or person in
lawful possession of the land to seek
27 permission to be on the land;
and
28 (2) the
provisions of this subsection (b) shall not authorize a
person
29 to remain on such land if instructed to
leave by the owner or person in
30 lawful possession of the land and any
person failing to leave such land
31 when so instructed is subject to the
provisions of K.S.A. 21-3721 and 21-
32 3728, and amendments thereto.
33 Sec. 2. K.S.A. 32-1013 is hereby
repealed.
34 Sec. 3. This act shall
take effect and be in force from and after its
35 publication in the statute book.
