10 AN ACT
concerning the behavioral sciences regulatory board; relating
11 to the powers thereof;
amending K.S.A. 74-7508 and repealing the
12 existing section.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. K.S.A. 74-7508 is hereby amended to read as follows:
74-
16 7508. In all matters pending before the
behavioral sciences regulatory
17 board, the board shall have the power:
18 (a) To administer
oaths and take testimony.
19 (b) To issue
subpoenas, compel the attendance of witnesses and the
20 production of any papers, books, accounts,
documents, and testimony,
21 and to cause the deposition of witnesses,
either residing within or without
22 the state, to be taken in the manner
prescribed by law for taking depo-
23 sitions in civil actions in the district
courts. In case of the failure of any
24 person to comply with any subpoena issued
in behalf of the board, or on
25 the refusal of any witness to testify to
any matters regarding which the
26 witness may be lawfully interrogated, the
district court of any county, on
27 application of a member of the board, may
require compliance by pro-
28 ceedings for contempt, as in the case of
failure to comply with a subpoena
29 issued from such court or a refusal to
testify in such court. Each witness
30 who appears before the board by its order
or subpoena, other than a state
31 officer or employee, shall receive for such
attendance the fees and mile-
32 age provided for witnesses in civil cases
in courts of record which shall
33 be audited and paid upon the presentation
of proper vouchers sworn to
34 by such witnesses and approved by the
chairperson of the board or by a
35 person or persons designated by the
chairperson.
36 (c) To revoke
the license or registration of any licensee or registrant
37 who voluntarily surrenders such
licensee's or registrant's license or reg-
38 istration or whose license or
registration expires pending investigation of
39 misconduct or while charges of
misconduct against the licensee or regis-
40 trant are pending or
anticipated.
41 Sec. 2. K.S.A. 74-7508 is hereby
repealed.
42 Sec. 3. This act shall
take effect and be in force from and after its
43 publication in the statute book.
