9 AN ACT
relating to credit card solicitation; prohibiting certain
practices
10 regarding solicitation
thereof at institutions of higher learning.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section
1. As used in this act:
14 (a) "Credit card"
shall have the meaning ascribed to it in paragraph
15 (19) of K.S.A. 16a-1-301 and amendments
thereto.
16 (b) "Creditor"
shall have the meaning ascribed to it in paragraph (20)
17 of K.S.A. 16a-1-301 and amendments
thereto.
18 (c) "Credit card
issuer" means any person or entity who issues a credit
19 card, the term "credit card issuer" also
includes any agent or employee
20 of such credit card issuer.
21 (d) "Institution
of postsecondary education" shall have the meaning
22 ascribed to it in subsection (a) of K.S.A.
74-3249 and amendments
23 thereto.

(e) "Organization" shall have the meaning ascribed to it in
paragraph
25 (32) of K.S.A. 16a-1-301 and amendments
thereto.
26 (f) "Person"
shall have the meaning ascribed to it in paragraph (33)
27 of K.S.A. 16a-1-301 and amendments
thereto.
28 Sec. 2. (a)
(1) No credit card issuer, while on any campus of an in-
29 stitution of postsecondary education, shall
solicit any individual to apply
30 for a credit card.
31 (2) The
provisions of this section shall not apply to the solicitation
of
32 a credit card application by an officer,
agent or employee of a financial
33 institution which has its place of business
located on the campus of the
34 institution of postsecondary education and
such solicitation occurs at the
35 financial institution's place of business
during normal business hours.
36 (b) No officer,
agent or employee of the institution of postsecondary
37 education shall knowingly allow, permit or
authorize any credit card issuer
38 to make any credit card solicitation in
violation of the provisions of sub-
39 section (a).
40 (c) No officer,
agent or employee of the institution of postsecondary
41 education shall knowingly sell or give to
any credit card issuer any list of
42 names or addresses of persons who are
students at or employed by the
43 institution of postsecondary education.

1 Sec.
3. Any person violating any provision of this act shall be
fined
2 not less than $500 nor more than
$5,000 for each violation.
3 Sec. 4. This act
shall take effect and be in force from and after its
4 publication in the statute book.
