9 AN ACT
concerning confined feeding facilities for swine; prohibiting
is-
10 suance of permits for
such facilities located in certain areas; requiring
11 the secretary of
health and environment to adopt certain standards
12 applicable
thereto.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. (a) As used in this section:
16 (1) "Swine
facility," "swine waste retention lagoon or pond" and "per-
17 mit" have the meanings provided by K.S.A.
1999 Supp. 65-1,178, and
18 amendments thereto.
19 (2) "Sensitive
groundwater area" means a geographic area designated
20 by the state corporation commission as
having hydrogeologic, climatic,
21 soil and other characteristics that make
the area's fresh and usable
22 groundwater vulnerable to pollution from
oil and gas activities.

(3) "Site-specific standards" means standards applicable to a
specific
24 location and developed for the protection
of the groundwater at that
25 location.

(b) Notwithstanding any other provision of law, on and after
the ef-
27 fective date of this act and before July 1,
2001, the secretary of health
28 and environment shall not issue any permit
for a swine facility having an
29 animal unit capacity of 1,000 or more and
located in a sensitive ground-
30 water area within groundwater management
district number 2.
31 (c) On and after
July 1, 2001, the secretary of health and environment
32 shall adopt rules and regulations providing
for site-specific standards for
33 swine waste retention lagoons and ponds of
swine facilities having an
34 animal unit capacity of 1,000 or more and
located in a sensitive ground-
35 water management area within groundwater
management district num-
36 ber 2.
37 Sec. 2. This act shall
take effect and be in force from and after its
38 publication in the Kansas register.
