9 AN ACT
concerning historic preservation; amending K.S.A. 75-2721 and
10 repealing the existing
section.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section
1. K.S.A. 75-2721 is hereby amended to read as follows:
75-
14 2721. (a) The state historical society
shall have the following historic pres-
15 ervation powers and duties:
16 (1) Undertake a
statewide survey to identify and document historic
17 properties, including all those owned by
the state, its instrumentalities
18 and political subdivisions.
19 (2) Prepare and
maintain a state register of historic places, which shall
20 include all those listed on the national
register of historic places. The
21 historical society shall adopt standards
for the listing and maintenance of
22 historic properties on the state register
consistent with relevant federal
23 standards for preservation and care of
historic properties.
24 (3) Prepare the
state's preservation plan, review such plan annually
25 and make appropriate revisions.
26 (4) Within limits
of available resources, acquire historic properties by
27 gift, purchase, devise or bequest;
preserve, restore and administer such
28 properties; and transfer such properties
when authorized by law.
29 (5) Establish
standards and criteria for the acquisition of historic
30 properties and for the preservation,
restoration, maintenance and oper-
31 ation of properties under the jurisdiction
of the agency, and, when
32 deemed proper, to charge reasonable
admission fees to such properties.
33 (6) Undertake the
procedures necessary to qualify the state for par-
34 ticipation in sources of federal aid for
historic preservation purposes.
35 (7) Provide
information concerning historic properties within the
36 state to the agencies and instrumentalities
of the federal, state and local
37 governments and, where appropriate, to
private individuals and
38 organizations.
39 (8) Cooperate
with federal, state and local government agencies in
40 the planning and conduct of specific
undertakings affecting historic prop-
41 erties and preservation objectives and in
overall land-use planning.
42 (9) Disburse
federal and state funds to local governments and private
43 agencies and individuals for historic
preservation work; establish stan-

1 dards of eligibility to receive such
funds; and enter into maintenance
2 agreements with local governments and
private agencies concerning his-
3 toric properties.

(10) Participate in national and international conferences and
pro-
5 grams concerning historic
preservation and cooperate with federal offi-
6 cials and agencies in the conduct of
such activities.

(11) Subject to limitations of staff and resources, provide
technical
8 and financial assistance to local
historic preservation organizations and
9 private parties involved in historic
preservation activities.
10 (12) Assist,
where possible, in developing public interest in historic
11 preservation through the development and
implementation of interpre-
12 tive programs for historic properties and
through the management of the
13 state's historical marker program.
14 (13) Develop an
ongoing program of historical, architectural and ar-
15 cheological research and development, to
include continuing surveys, ex-
16 cavation, scientific recording,
interpretation and publication of the state's
17 historical, architectural, archeological
and cultural resources. A reasona-
18 ble charge may be made for
publications.
19 (14) Request that
the attorney general take action authorized under
20 subsection (d) of K.S.A. 75-2724 and
amendments thereto against any
21 person or entities who fail to obtain any
demolition or building permit
22 required by local or state law.
23 (15) Cooperate
with federal, state and local government agencies and
24 organizations to promote heritage
tourism and historic preservation ac-
25 tivities in Kansas.
26 (b) The state
historic preservation officer shall adopt rules and reg-
27 ulations to implement and administer the
provisions of K.S.A. 75-2715
28 through 75-2725, and amendments
thereto.
29 Sec. 2. K.S.A. 75-2721 is hereby
repealed.
30 Sec. 3. This act shall
take effect and be in force from and after its
31 publication in the statute book.
