10 AN ACT relating
to managed care; classifying physicians practicing ob-
11 stetrics or gynecology
as primary care physicians.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. Each health insurer shall permit a woman insured by the
15 health insurer to visit an in-network
obstetrician or gynecologist for rou-
16 tine gynecological care from an in-network
obstetrician or gynecologist
17 up to two times each calendar year without
requiring such woman to first
18 visit a primary care provider, provided
that:
19 (a) The care is
medically necessary, including, but not limited to, care
20 that is routine;
21 (b) following
each visit for gynecological care, the obstetrician or gy-
22 necologist communicates with such woman's
primary care provider con-
23 cerning any diagnosis or treatment
rendered; and
24 (c) the
obstetrician or gynecologist confers with such woman's pri-
25 mary care provider before performing any
diagnostic procedure that is
26 not routine gynecological care rendered
during any such visit.
27 Sec.
2. This act shall be part of and supplemental to the patient
pro-
28 tection act, cited at K.S.A. 1999 Supp.
40-4601 et seq., and amendments
29 thereto.
30 Sec. 3. This act shall
take effect and be in force from and after its
31 publication in the statute book.
