9 AN ACT
concerning health insurance; relating to the patient protection
10 act; classifying
obstetricians and gynecologists as primary care
11 providers.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. (a) Any health insurer shall classify an obstetrician or
a
15 gynecologist as a primary care
provider.
16 (b) If any
obstetrician or gynecologist chooses not to be a primary
17 care provider, the health insurer shall
permit a woman insured by the
18 health insurer to receive an annual visit
to an in-network obstetrician or
19 gynecologist for routine gynecological care
from an in-network obstetri-
20 cian or gynecologist without requiring such
woman to first visit a primary
21 care provider, provided that:
22 (1) The care is
medically necessary, including, but not limited to, care
23 that is routine;
24 (2) following
each visit for gynecological care, the obstetrician or gy-
25 necologist communicates with such woman's
primary care provider con-
26 cerning any diagnosis or treatment
rendered; and
27 (3) the
obstetrician or gynecologist confers with the primary care pro-
28 vider before performing any diagnostic
procedure that is not routine gy-
29 necological care rendered during an annual
visit.
30 Sec.
2. This act shall be part of and supplemental to the patient
pro-
31 tection act, cited at K.S.A. 1999 Supp.
40-4601 et seq., and amendments
32 thereto.
33 Sec. 3. This act shall
take effect and be in force from and after its
34 publication in the statute book.
