10             AN  ACT concerning emergency medical services; relating to attendants;
11             amending K.S.A. 1999 Supp. 65-6133 and repealing the existing
12             section.
13      
14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. K.S.A. 1999 Supp. 65-6133 is hereby amended to read as
16       follows: 65-6133. (a) An attendant's or instructor-coordinator's certificate
17       may be denied, revoked, limited, modified or suspended by the board or
18       the board may refuse to renew such certificate upon proof that such
19       individual:
20             (1) Has made intentional misrepresentations in obtaining a certificate
21       or renewing a certificate;
22             (2) has performed or attempted to perform activities not authorized
23       by statute at the level of certification held by the individual;
24             (3) has demonstrated incompetence as defined by rules and regula-
25       tions adopted by the board or has provided inadequate patient care as
26       determined by the board;
27             (4) has violated or aided and abetted in the violation of any provision
28       of this act or the rules and regulations promulgated thereunder;
29             (5) has been convicted of a felony under any state or federal statute
30       or has been convicted of a crime involving a violation of the uniform
31       controlled substances act or a crime specified in article 34 or 35 of chapter
32       21 of the Kansas Statutes Annotated with the exception of K.S.A. 21-3416,
33       21-3418, 21-3422, 21-3422a, 21-3423, 21-3424, 21-3428, 21-3430 or 21-
34       3434, and amendments thereto, and, after investigation by the board, it
35       is determined that such person individual has not been sufficiently re-
36       habilitated to warrant the public trust;
37             (6) has demonstrated an inability to perform authorized activities with
38       reasonable skill and safety by reason of illness, alcoholism, excessive use
39       of drugs, controlled substances or any physical or mental condition; or
40             (7) has engaged in unprofessional conduct, as defined by rules and
41       regulations adopted by the board.
42             (b) The board may limit, modify, revoke or suspend an attendant's or
43       instructor-coordinator's certificate or the board may refuse to renew such

  1       certificate in accordance with the provisions of the Kansas administrative
  2       procedure act. 
  3       Sec.  2. K.S.A. 1999 Supp. 65-6133 is hereby repealed.
  4        Sec.  3. This act shall take effect and be in force from and after its
  5       publication in the statute book.
