10 AN ACT
concerning electric transmission lines; relating to certain
hear-
11 ings; amending K.S.A.
66-1,178 and 66-1,179 and repealing the exist-
12 ing sections.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. K.S.A. 66-1,178 is hereby amended to read as follows:
66-
16 1,178. (a) No electric utility may
begin site preparation for or construction
17 of an electric transmission line, or
exercise the right of eminent domain
18 to acquire any interest in land in
connection with the site preparation for
19 a construction of any such line without
first acquiring a siting permit from
20 the commission. Whenever any
such electric utility desires to obtain such
21 a permit, it the
utility shall file an application with the commission
setting
22 forth therein that it
the utility proposes to construct an electric transmis-
23 sion line and specifying the proposed
location thereof, the names and
24 addresses of the landowners of record whose
land or interest therein is
25 proposed to be acquired in connection with
the construction of such a
26 the line and such other information
as may be required by the
27 commission.

(b) Thereupon Upon the filing of an
application pursuant to subsec-
29 tion (a), the commission shall fix a
time for a public hearing on such
30 application, which shall be not more than
60 120 days from the date the
31 application was filed, to determine the
necessity for and the reasonable-
32 ness of the location of the proposed
electric transmission line. The com-
33 mission shall fix the place for hearing,
which may be in any county through
34 which the electric transmission line is
proposed to traverse.
35 (c) The
commission may conduct an evidentiary hearing on an ap-
36 plication filed pursuant to this section
at such time and place as the com-
37 mission deems appropriate.
38 Sec.
2. K.S.A. 66-1,179 is hereby amended to read as follows:
66-
39 1,179. The commission shall publish notice
of the time, place and subject
40 matter of such the
public hearing provided for by K.S.A. 66-1,178 and
41 amendments thereto in newspapers
having general circulation in every
42 county through which the electric
transmission line is proposed to trav-
43 erse once each week for three
(3) consecutive weeks, the last publication

1 to be not less than five
(5) days before such hearing date. The
commission
2 may order the applicant to publish
such notice and submit an affidavit of
3 publication, evidencing the dates
of publication and the newspapers in
4 which the notice appeared, to the
commission prior to the hearing. Writ-
5 ten notice by certified mail of such
hearing and a copy of the application
6 shall be served not less than
twenty (20) 20 days prior to the hearing
date
7 upon all landowners, as shown by the
application.
8 Sec. 3. K.S.A. 66-1,178
and 66-1,179 are hereby repealed.
9 Sec. 4. This act
shall take effect and be in force from and after its
10 publication in the statute book.
