9 AN ACT
concerning school districts; authorizing establishment and
10 maintenance of teacher
extraordinary performance plans; providing for
11 grants of state
moneys.

13 Be it enacted by the Legislature of the
State of Kansas:
14 Section
1. As used in this act:
15 (a) "Teacher
extraordinary performance plan" means a salary plan
16 which is supplemental to a school
district's regular salary plan and estab-
17 lished and maintained by the board of
education of the school district for
18 the purpose of providing for payment of
additional amounts of compen-
19 sation to teachers for the performance of
extraordinary duties.
20 (b) "Teacher"
means classroom teachers including, in addition to reg-
21 ular kindergarten through grade 12
classroom teachers, special education
22 teachers, practical arts/vocational
education teachers, prekindergarten
23 teachers and reading specialists.

(c) "Extraordinary duties" means, but not by way of
limitation, duties
25 that are required for the operation and
maintenance of summer programs
26 and extraordinary school programs;
evaluation and development of cur-
27 riculum; research and planning for
facilitating integration of curriculum,
28 instruction and assessment; exploration and
development of more effec-
29 tive teaching materials, strategies and
techniques; devising action plans
30 for improvement of pupil attendance and
graduation rates, reducing sus-
31 pension and expulsion rates, enhancing
pupil morale, attitude and satis-
32 faction; formulating staff development and
inservice education activities.
33 Sec. 2. (a)
The board of education of each school district may estab-
34 lish and maintain a teacher extraordinary
performance plan and apply for
35 a grant of state moneys for the purpose of
financing all or a portion of
36 the amount budgeted for maintenance of the
plan.
37 (b) In order to
be eligible to receive a grant of state moneys for the
38 maintenance of a teacher extraordinary
performance plan, a board of
39 education shall submit to the state board
of education an application for
40 a grant and a description of the plan. The
application and description
41 shall be prepared in such form and manner
as the state board shall require
42 and shall be submitted at a time to be
determined and specified by the
43 state board. Approval by the state board of
the plan and the application

1 is prerequisite to the award of a
grant.
2 (c) Each
board of education which is awarded a grant under this act
3 shall make such periodic and special
reports of statistical and financial
4 information to the state board of
education as it may request.
5 Sec.
3. (a) The state board of education shall adopt rules and
regu-
6 lations for the administration of
this act and shall:

(1) Establish standards and criteria for reviewing, evaluating
and ap-
8 proving teacher extraordinary
performance plans and applications of
9 school districts for grants;
10 (2) evaluate and
approve teacher extraordinary performance plans;
11 (3) be
responsible for awarding grants to school districts; and
12 (4) request of
and receive from each school district which is awarded
13 a grant for maintenance of a teacher
extraordinary performance plan re-
14 ports containing information with regard to
the effectiveness of the plan.
15 (b) Within the
limits of appropriations for teacher extraordinary per-
16 formance plans maintained by school
districts, the state board of educa-
17 tion shall determine the amount of grants
to be awarded school districts.
18 In no event shall the amount of a grant to
a school district exceed the
19 amount budgeted and expended by the school
district in the maintenance
20 of a plan. Upon receipt of a grant of state
moneys for maintenance of a
21 teacher extraordinary performance plan, the
amount of the grant shall be
22 deposited in the general fund of the school
district. Moneys deposited in
23 the general fund of school district under
this subsection shall be consid-
24 ered reimbursement for the purpose of the
school district finance and
25 quality performance act.
26 Sec. 4. The state board of
education may provide any board, upon
27 request, with technical advice and
assistance regarding the establishment
28 and maintenance of a teacher extraordinary
performance plan or an ap-
29 plication for a grant of state moneys.
30 Sec. 5. Upon completion of
the 2001-02 school year, the state board
31 of education shall evaluate the grant
program provided for under this act,
32 assess the impact teacher extraordinary
performance plans and the grant
33 program have had on the educational systems
of participating school dis-
34 tricts and on the educational system of the
state as a whole, and make a
35 recommendation to the governor and the
legislature with regard to con-
36 tinuation or termination of the grant
program.
37 Sec. 6. This act shall
take effect and be in force from and after its
38 publication in the statute book.
