10 AN ACT
concerning retirement; relating to the Kansas police and fire-
11 men's retirement
system; election for certain retirement coverage;
12 amending K.S.A. 1999
Supp. 74-4955a and repealing the existing
13 section.

15 Be it enacted by the Legislature of the
State of Kansas:
16 Section
1. K.S.A. 1999 Supp. 74-4955a is hereby amended to read
17 as follows: 74-4955a. (1) Except as
provided in subsection (4), each mem-
18 ber of the system who was appointed or
employed prior to July 1, 1989,
19 may elect to be covered by the provisions
of K.S.A. 74-4957a, 74-4958a,
20 74-4960a, 74-4963a and 74-4964a, and
amendments thereto, on the first
21 day of the first payroll period of such
member coinciding with or following
22 the receipt of such election in the office
of the retirement system, only
23 by filing with the board of trustees of the
system prior to January 1, 1990,
24 a written election to be covered by such
provisions. Failure to file such
25 written election shall be presumed to be an
election not to be covered
26 by such provisions. Such election, whether
to become a member or not
27 to become a member, shall be
irrevocable.
28 (2) Each person
appointed or employed on or after July 1, 1989, shall
29 be covered by the provisions of K.S.A.
74-4957a, 74-4958a, 74-4960a, 74-
30 4963a and 74-4964a, and amendments
thereto.
31 (3) The
provisions of this section shall be effective on and after July
32 1, 1989.
33 (4) Each member
of the system who was appointed or employed prior
34 to July 1, 1989, and who did not elect to
be covered by the provisions
35 specified in subsection (1) prior to
January 1, 1990, may elect to be cov-
36 ered by such provisions by filing a written
election as provided in sub-
37 section (1) during the period commencing
July 1, 1990, and ending Sep-
38 tember 30, 1990.
39 (5) Except as
provided in this subsection, each member of the system
40 who was appointed or employed prior to July
1, 1989, and who did not
41 elect to be covered by the provisions
specified in subsection (1) as pro-
42 vided in this section, may elect to be
covered by such provisions by filing
43 a written election as provided in
subsection (1). The provisions of this

1 subsection shall take effect on and
after the date the system receives a
2 private letter ruling from the
internal revenue service that the provisions
3 of this subsection do not contravene
federal law. The period of such
4 election as provided by this
subsection shall commence on the date of
5 receipt by the system of such
private letter ruling October 22, 1999, and
6 shall end 90 days
thereafter on May 19, 2000. Any member who
elects
7 as provided by this subsection shall
pay the cost of such election by means
8 of a single lump-sum payment in an
amount equal to the then present
9 value of the benefits being purchased
as determined by the actuary using
10 the member's attained age, annual
compensation at the time of the pur-
11 chase and the actuarial assumptions and
tables then in use by the system.
12 Sec. 2. K.S.A. 1999 Supp.
74-4955a is hereby repealed.
13 Sec. 3. This act shall
take effect and be in force from and after its
14 publication in the Kansas register.
