  7             AN  ACT concerning insurance companies; property and casualty insur-
  8             ers; flood insurance.

10       Be it enacted by the Legislature of the State of Kansas:
11             Section  1. (a) No property or casualty insurer shall sell a policy in-
12       suring real property of any description and its contents against loss by fire
13       or any of the risks usually insured against in their insurance policies
14       unless:
15             (1) A written notice appears in not less than 10-point boldface type
16       on the front page of each new or renewal policy issued that the policy
17       does not cover losses due to flood;
18             (2) each applicant or proposed insured acknowledges in writing that
19       the applicant or proposed insured is familiar with the water damage ex-
20       clusions contained in the policy; and
21             (3) each applicant or proposed insured is informed that flood insur-
22       ance may be available through the national flood insurance program.
23             (b) The property or casualty insurer shall inform each policyholder
24       on or before the date of the renewal of the policy that the policy does
25       not cover losses due to flood and that flood insurance may be available
26       through the national flood insurance program.
27             (c) The provisions of subsection (a) shall not apply to any policy that
28       does provide coverage for losses due to flood if the coverage is equivalent
29       to the coverage provided by the national flood insurance program.
30        Sec.  2. This act shall take effect and be in force from and after its
31       publication in the statute book.
