10 AN ACT concerning motor vehicles; providing for the issuance of chil-
11 dren's trust fund certain distinctive license plates; amending K.S.A.
12 1998 Supp. 8-1,141 and repealing the existing section.

14 Be it enacted by the Legislature of the State of Kansas:
15 New Section 1. (a) Any owner of one or more passenger vehicles or
16 trucks registered for a gross weight of not more than 16,000 20,000
17 pounds who is a resident of Kansas, upon compliance with the provisions
18 of this section, may be issued one children's trust fund license plate for
19 each such passenger vehicle or truck. Such license plates shall be issued
20 for the same time as other license plates upon proper registration and
21 payment of the regular license fee as provided in K.S.A. 8-143, and
22 amendments thereto, and the presentation of the annual logo use au-
23 thorization statement provided for in subsection (b).
24 (b) The advisory committee on children and families established in
25 K.S.A. 38-1901, and amendments thereto, may authorize the use of their
26 logo to be affixed on license plates as provided by this section. Any royalty
27 payment to such committee derived from this section shall be credited
28 to the family and children trust account of the family and children in-
29 vestment fund, established in K.S.A. 38-1808, and amendments thereto,
30 and, shall be used in accordance with the provisions of paragraph (2) of
31 subsection (c) of K.S.A. 38-1808, and amendments thereto. Any motor
32 vehicle owner may annually apply to the committee for the use of such
33 logo. Upon annual application and payment to the committee in an
34 amount of not less than $25 nor more than $100 as a logo use royalty
35 payment for each children's trust fund plate to be issued, the committee
36 shall issue to the motor vehicle owner, without further charge, a logo use
37 authorization statement, which shall be presented by the motor vehicle
38 owner at the time of registration.
39 (c) Any applicant for a children's trust fund license plate may make
40 application for such plates not less than 60 days prior to such person's
41 renewal of registration date, on a form prescribed and furnished by the
42 director of motor vehicles, and any applicant for the children's trust fund
43 license plates shall provide the annual logo use authorization statement
44 provided for in subsection (b). Application for registration of a passenger
45 or truck and issuance of the license plate under this section shall be made
46 by the owner in a manner prescribed by the director of vehicles upon
47 forms furnished by the director.
48 (d) No registration or children's trust fund license plate issued under
49 this section shall be transferable to any other person.
50 (e) Renewals of registration under this section shall be made an-
51 nually, upon payment of the fee prescribed in subsection (a), in the man-
52 ner prescribed in subsection (b) of K.S.A. 8-132, and amendments
53 thereto. No renewal of registration shall be made to any applicant until
54 such applicant provides the annual logo use authorization statement pro-
55 vided for in subsection (b). If such logo use authorization statement is
56 not presented at the time of registration, the applicant shall be required
57 to comply with K.S.A. 8-143, and amendments thereto, and return the
58 children's trust fund license plate to the county treasurer of such person's
59 residence.
60 (f) The advisory committee on children and families shall:
61 (1) Pay the initial cost of silk-screening for such children's trust fund
62 license plates; and
63 (2) provide to all county treasurers a toll-free telephone number
64 where applicants can call the children's trust fund for information con-
65 cerning the application process or the status of their license plate
66 application.
67 (g) The advisory committee on children and families, with the ap-
68 proval of the director of vehicles and subject to the availability of materials
69 and equipment, shall design a plate to be issued under the provisions of
70 this section.
71 (h) If the requirements of subsection (b) of K.S.A. 1998 Supp.
72 8-1,141, and amendments thereto, have not been complied with on
73 or before January 1, 2001, the provisions of this section shall expire.
74 New Sec. 2. (a) Any owner of one or more passenger vehicles
75 or trucks registered for a gross weight of not more than 20,000
76 pounds who is a resident of Kansas, upon compliance with the pro-
77 visions of this section, may be issued one Kansas association for
78 pregnancy maintenance license plate for each such passenger ve-
79 hicle or truck. Such license plates shall be issued for the same time
80 as other license plates upon proper registration and payment of the
81 regular license fee as provided in K.S.A. 8-143, and amendments
82 thereto, and the presentation of the annual logo use authorization
83 statement provided for in subsection (b).
84 (b) The Kansas association for pregnancy maintenance, may au-
85 thorize the use of their logo to be affixed on license plates as pro-
86 vided by this section. Any royalty payment to such Kansas associ-
87 ation for pregnancy maintenance derived from this section shall be
88 used to provide services for promoting adoption, counselling and
89 meeting the physical needs of pregnant women and their children.
90 Any motor vehicle owner may annually apply to the Kansas asso-
91 ciation for pregnancy maintenance for the use of such logo. Upon
92 annual application and payment to the Kansas association for preg-
93 nancy maintenance in an amount of not less than $25 nor more than
94 $100 as a logo use royalty payment for each Kansas association for
95 pregnancy maintenance plate to be issued, the Kansas association
96 for pregnancy maintenance shall issue to the motor vehicle owner,
97 without further charge, a logo use authorization statement, which
98 shall be presented by the motor vehicle owner at the time of
99 registration.
100 (c) Any applicant for a Kansas association for pregnancy main-
101 tenance license plate may make application for such plates not less
102 than 60 days prior to such person's renewal of registration date, on
103 a form prescribed and furnished by the director of motor vehicles,
104 and any applicant for the Kansas association for pregnancy main-
105 tenance license plates shall provide the annual logo use authoriza-
106 tion statement provided for in subsection (b). Application for reg-
107 istration of a passenger or truck and issuance of the license plate
108 under this section shall be made by the owner in a manner pre-
109 scribed by the director of vehicles upon forms furnished by the
110 director.
111 (d) No registration or Kansas association for pregnancy main-
112 tenance license plate issued under this section shall be transferable
113 to any other person.
114 (e) Renewals of registration under this section shall be made
115 annually, upon payment of the fee prescribed in subsection (a), in
116 the manner prescribed in subsection (b) of K.S.A. 8-132, and amend-
117 ments thereto. No renewal of registration shall be made to any ap-
118 plicant until such applicant provides the annual logo use authori-
119 zation statement provided for in subsection (b). If such logo use
120 authorization statement is not presented at the time of registration,
121 the applicant shall be required to comply with K.S.A. 8-143, and

124 person's residence.
125 (f) The Kansas association for pregnancy maintenance shall pay
126 the initial cost of silk-screening for such Kansas association for
127 pregnancy maintenance license plates.
128 (g) The Kansas association for pregnancy maintenance, with the
129 approval of the director of vehicles and subject to the availability
130 of materials and equipment, shall design a plate to be issued under
131 the provisions of this section.
132 (h) If the requirements of subsection (b) of K.S.A. 1998 Supp.
133 8-1,141, and amendments thereto, have not been complied with on
134 or before January 1, 2001, the provisions of this section shall expire.
135 Sec. \ fs\ 2. 3. K.S.A. 1998 Supp. 8-1,141 is hereby amended to read as
136 follows: 8-1,141. (a) Any new distinctive license plate authorized for is-
137 suance on and after July 1, 1994, shall be subject to the personalized
138 license plate fee prescribed by subsection (c) of K.S.A. 8-132, and amend-
139 ments thereto. This section shall not apply to any distinctive license plate
140 authorized prior to July 1, 1994.
141 (b) The director of vehicles shall not issue any new distinctive license
142 plate authorized for issuance on and after July 1, 1995, unless there is a
143 guarantee of an initial issuance of at least 500 license plates.
144 (c) The provisions of this section shall not apply to distinctive license
145 plates issued under the provisions of K.S.A. 1997 1998 Supp. 8-1,145,
146 and amendments thereto.
147 (d) The provisions of subsection (a), shall not apply to distinctive li-
148 cense plates issued under the provisions of section 1 sections 1 and 2.
149 Sec. \ fs\ 3. 4. K.S.A. 1998 Supp. 8-1,141 is hereby repealed.
150 Sec. \ fs\ 4. 5. This act shall take effect and be in force from and after its
151 publication in the statute book.
