  9             AN  ACT concerning the information network of Kansas, Inc.; relating to
10             composition of such network's board; amending K.S.A. 74-9303 and
11             repealing the existing section.

13       Be it enacted by the Legislature of the State of Kansas:
14             Section  1. K.S.A. 74-9303 is hereby amended to read as follows: 74-
15       9303. (a) There is hereby created a body politic and corporate to be known
16       as the information network of Kansas, Inc. INK is hereby constituted as
17       a public instrumentality and the exercise by INK of the authority and
18       powers conferred by this act shall be deemed and held to be the per-
19       formance of an essential governmental function.
20             (b) INK shall be governed by a board consisting of 10 11 members
21       as follows:
22             (1) The president of Kansas, Inc.;
23             (2) the secretary of state;
24             (3) two members who are chief executive officers of agencies of the
25       executive branch, appointed by the governor who shall serve at the plea-
26       sure of the governor;
27             (4) one member appointed by the governor from a list of three Kansas
28       bar association members submitted by such association. Such member
29       shall serve a three-year term;
30             (5) three members from other user associations of a statewide char-
31       acter appointed by the governor from a list of not less than nine individ-
32       uals and their respective user associations compiled initially by the pres-
33       ident of Kansas, Inc. and thereafter by the board of INK and submitted
34       to the governor. No two members appointed pursuant to this paragraph
35       shall represent the same user association. The terms for such members
36       shall be for a period of three years, except initially, when the terms shall
37       be for one, two and three years, respectively;
38             (6) one member appointed by the governor from a list submitted by
39       the president of the Kansas public libraries association and comprised of
40       three librarians employed by public libraries. Following the initial ap-
41       pointment hereunder, such list shall be comprised of librarians of public
42       libraries which subscribe to INK. Such member shall serve a three-year
43       term;

  1             (7) a member of the joint committee on information technology se-
  2       lected by the joint committee; and
  3             (7) (8) the director of information systems and communications who
  4       shall serve as a nonvoting member.
  5             (c) The board shall annually elect one member from the board as
  6       chairperson of INK, another as vice-chairperson and another as secretary.
  7             (d) Five Six members of the board shall constitute a quorum and the
  8       affirmative vote of five six members shall be necessary for any action taken
  9       by the board. No vacancy in the membership of the board shall impair
10       the right of a quorum to exercise all the rights and perform all the duties
11       of the board.
12             (e) The member of the joint committee on information technology
13       serving as a member of the board shall be paid amounts provided in
14       subsection (e) of K.S.A. 75-3223 and amendments thereto. 
15       Sec.  2. K.S.A. 74-9303 is hereby repealed.
16         Sec.  3. This act shall take effect and be in force from and after its
17       publication in the statute book.
