10 AN ACT
concerning the state board of regents; relating to reimburse-
11 ment of moving
expenses for certain state officers and employees;
12 amending K.S.A. 76-727
and repealing the existing section.

14 Be it enacted by the Legislature of the
State of Kansas:
15 Section
1. K.S.A. 76-727 is hereby amended to read as follows: 76-
16 727. (a) The chief executive officer of any
state educational institution,
17 when approved by the state board of
regents, may extend an invitation to
18 any person to meet with representatives of
such state educational insti-
19 tution for the purpose of consultation
preliminary to such person's pos-
20 sible selection as a member of the
unclassified staff at such state educa-
21 tional institution, and in such case, such
state educational institution may
22 pay the actual and necessary travel and
subsistence expenses of such in-
23 vitee in meeting with such representatives.
The state board of regents
24 may extend an invitation to any person to
meet with the state board of
25 regents or with representatives of such
board for the purpose of consul-
26 tation preliminary to such person's
possible selection as chief executive
27 officer of a state educational institution
under the control and supervision
28 of the state board of regents or as
executive officer of the state board of
29 regents, and in such case, the state board
of regents may pay the actual
30 and necessary travel and subsistence
expenses of such invitee and such
31 invitee's spouse in meeting with the board
or with such representatives.
32 The travel and subsistence expenses shall
be paid from funds available or
33 appropriated for travel and subsistence.
Any reimbursement of an in-
34 vitee's travel and subsistence
expenses paid by a state educational
35 institution pursuant to this
subsection shall constitute compensa-
36 tion for the invitee.
37 (b)
(1) Subject to the limitations of rules and regulations
adopted by
38 the secretary of administration, the state
board of regents may agree to
39 reimburse an applicant for the position of
chief executive officer of a state
40 educational institution or an applicant for
any position in the office of the
41 state board of regents for all or part of
the applicant's moving expenses
42 from the applicant's usual place of
residence to the applicant's new place
43 of residence as an inducement to the
applicant to accept such position of

1 employment.
2 (2) The
amount to be paid for moving expenses shall not exceed the
3 amount of the actual moving expenses
verified by receipts or the amount
4 of moving expenses for moving 12,000
pounds of household goods, which-
5 ever is the lesser amount. The
applicant shall be required to sign an
6 agreement that if the applicant
leaves the position of employment within
7 one year from the beginning date of
employment, the applicant will re-
8 imburse the state board of regents
the full amount so paid for moving
9 expenses, and the obligation to repay
shall constitute a lien and setoff by
10 the state against the applicant employee's
unpaid wages or salary. The
11 moving expenses shall be paid from funds
available or appropriated for
12 moving expenses.

(3) Reimbursement for moving expenses may be made to
applicants
14 for positions in the unclassified
service under the Kansas civil service act
15 at state educational institutions other
than chief executive officers in ac-
16 cordance with this section if such
reimbursement is from private funds
17 provided to the state educational
institutions by the endowment associa-
18 tions or other affiliated corporations
of such state educational institutions.
19 Any reimbursement of moving expenses
made to any applicant pur-
20 suant to this subsection shall
constitute compensation for the
21 applicant.
22 (c) The
provisions of K.S.A. 75-3218, and amendments thereto, and
23 subsection (a) of K.S.A. 75-3225, shall not
apply to state educational
24 institutions.
25 (d) The chief
executive officer of any state educational institution, or
26 any person or persons designated by such
officer for the purpose, with
27 the approval of the state board of regents,
may travel to any place or
28 places in the United States for the purpose
of interviewing persons as
29 prospective members of the faculty of such
state educational institution,
30 and in such case, such state educational
institution shall pay the trans-
31 portation and subsistence expenses of
persons making such trips. The
32 travel and subsistence shall be paid at the
same rates and subject to the
33 same limitations as now provided for state
employees for out-of-state
34 travel. The travel and subsistence shall be
paid from funds available or
35 appropriated for travel and
subsistence.
36 Sec. 2. K.S.A. 76-727 is hereby
repealed.
37 Sec. 3. This act shall
take effect and be in force from and after its
38 publication in the statute
book Kansas register.
