9 AN ACT concerning alcoholic and cereal malt beverages; requiring
10 server permits.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. (a) Any person licensed under the liquor control act or the
14 club and drinking establishment act which employee participates in any
15 manner in the sale of alcoholic liquor in the original package for con-
16 sumption off the premises or in the mixing, selling or serving of alcoholic
17 liquor or cereal malt beverage for consumption on the premises where
18 served or sold and any employee of a person licensed under the liquor
19 control act or the club and drinking establishment act which employee
20 participates in any manner in the sale of alcoholic liquor in the original
21 package for consumption off the premises or in the mixing, selling or
22 serving of alcoholic liquor or cereal malt beverage for consumption on
23 the premises where served or sold shall have a valid server permit issued
24 pursuant to this act.
25 (b) No licensee shall participate in any manner in the sale of alcoholic
26 liquor in the original package for consumption off the premises or mix,
27 sell or serve any alcoholic liquor or cereal malt beverage for consumption
28 on the premises unless such licensee has a valid server permit. A licensee
29 shall not permit any employee to participate in any manner in the sale of
30 alcoholic liquor in the original package for consumption off the premises
31 or to mix, sell or serve any alcoholic liquor or cereal malt beverage for
32 consumption on the premises unless such employee has a valid server
33 permit.
34 (c) No person shall participate in any manner in the sale of alcoholic
35 liquor in the original package for consumption off the premises or mix,
36 sell or serve alcoholic liquor or cereal malt beverage for consumption on
37 the premises unless such person has a temporary or permanent permit
38 required by this act.
39 (d) A person holding a server permit shall make the server permit
40 available at any time while on duty for immediate inspection by any agent
41 of the director or by any other law enforcement officer.
42 Sec. 2. (a) An applicant for a server permit shall:
43 (1) Be at least 18 years of age;

1 (2) not have had a permit revoked or be under suspension;
2 (3) authorize a criminal records check to be conducted by the Kansas
3 bureau of investigation and the release of the information to the instruc-
4 tor, subject to applicable laws, rules and regulations regarding disclosure
5 of such records;
6 (4) submit evidence of successful completion of an approved alcohol
7 server education program and examination; and
8 (5) submit any other information required by the director.
9 (b) The applicant shall pay the cost of conducting the background
10 check required by subsection (a).
11 (c) The application for a server permit shall be submitted in the man-
12 ner provided by rules and regulations adopted by the director and shall
13 be accompanied by a fee of $35.
14 (d) A server permit shall be valid only upon premises where the sale
15 of alcoholic liquor or cereal malt beverage is authorized by the liquor
16 control act or the club and drinking establishment act.
17 (e) A server permit shall not be used by any person other than the
18 person to whom it is issued. A licensee shall verify the identification of
19 the permittee and determine that the permittee has in possession a valid
20 server permit before allowing the permittee to mix, sell or serve alcoholic
21 liquor or cereal malt beverage for consumption.
22 Sec. 3. (a) If a server permit is lost, mutilated or destroyed, the per-
23 mittee may apply for a duplicate permit in the manner provided by the
24 director. A fee of $10 shall be imposed for a duplicate permit.
25 (b) If the name of a permittee is changed, the permittee shall apply
26 for a new server permit in the manner provided by the director. Such
27 application shall be accompanied by a fee of $10.
28 Sec. 4. An alcohol server education program shall include, but not
29 be limited to, information relating to:
30 (1) The physiological and behavioral effects of alcohol;
31 (2) factors affecting the rate at which alcohol is absorbed in the
32 bloodstream;
33 (3) potential alcohol-related problems in professional and social
34 settings;
35 (4) recognizing problem customers and methods of dealing with such
36 customers;
37 (5) the effects of combining the use of alcohol and other legal or
38 illegal drugs;
39 (6) the availability of community treatment programs for alcohol and
40 other drug abuse;
41 (7) advertising and marketing strategies to encourage safe and re-
42 sponsible drinking; and
43 (8) state laws concerning the sale, possession and consumption of

1 beer, alcohol and other drugs.
2 Sec. 5. The director shall:
3 (a) Establish minimum qualifications for server education program
4 instructors;
5 (b) certify server education program instructors;
6 (c) establish minimum course requirements for server education pro-
7 grams and approve programs which meet such requirements;
8 (d) maintain lists of approved server education programs and certified
9 instructors;
10 (e) establish procedures for instructor recertification;
11 (f) establish procedures relating to application for and issuance and
12 renewal of server permits;
13 (g) establish conditions under which a licensee may be exempt from
14 the requirements of this act; and
15 (h) adopt any rules and regulations necessary for the implementation
16 and enforcement of this act.
17 Sec. 6. Applications for renewal of permits shall be submitted in the
18 same manner as provided for submission of initial permits and shall be
19 accompanied by a fee of $35. No permit shall be issued to a person who
20 does not qualify for an initial permit.
21 The director may require pursuant to rules and regulations applicants
22 for renewal to complete additional hours of server education as a condi-
23 tion of renewal of a permit.
24 Sec. 7. (a) The director may deny, suspend or revoke a server permit
25 in accordance with the Kansas administrative procedures act if:
26 (1) The permittee has made false statements on the permit
27 application;
28 (2) the permittee is not eligible for employment by a licensee pur-
29 suant to the applicable provisions of the liquor control act, the club and
30 drinking establishment act or any rules and regulations adopted pursuant
31 thereto;
32 (3) the permittee has not completed successfully the server education
33 program and examination; and
34 (4) the permittee has performed or permitted any act which would
35 constitute a violation of any provision of the liquor control act, the club
36 and drinking establishment act or any rules and regulations adopted pur-
37 suant thereto.
38 (b) If a permittee violates any provision of the liquor control act, the
39 club and drinking establishment act or any rule and regulation adopted
40 pursuant thereto, the director may revoke or suspend either the server
41 permit of the employee or the license of the licensee upon whose prem-
42 ises the violation occurred, or both the permittee and the licensee.
43 (c) A civil fine not to exceed $1,000 may be imposed in addition to

1 or in lieu of suspension or revocation.
2 Sec. 8. The director shall remit all moneys received from fees im-
3 posed pursuant to this act to the state treasurer at least monthly. Upon
4 receipt, the entire amount shall be deposited in the state treasury and
5 credited to the server permit fee fund, which is hereby created. Moneys
6 in the server permit fee fund shall be used solely for the purpose of
7 administering and implementing the provisions of this act and rules and
8 regulations adopted thereunder. All expenditures from such fund shall be
9 made in accordance with appropriation acts upon warrants of the director
10 of accounts and reports issued pursuant to vouchers approved by the
11 director or by a person or persons designated by the director.
12 Sec. 9. This act shall take effect and be in force from and after Jan-
13 uary 1, 2000, and its publication in the statute book.
