12             AN ACT making and concerning appropriations for the fiscal years ending
13             June 30, 2000, and June 30, 2001, for state agencies; authorizing cer-
14             tain transfers, capital improvement projects and fees, imposing certain
15             restrictions and limitations, and directing or authorizing certain re-
16             ceipts, disbursements and acts incidental to the foregoing.

19       Be it enacted by the Legislature of the State of Kansas:
20        Section 1. (a) For the fiscal years ending June 30, 2000, and June 30,
21       2001, appropriations are hereby made, restrictions and limitations are
22       hereby imposed, and transfers, capital improvement projects, fees, re-
23       ceipts, disbursements and acts incidental to the foregoing are hereby di-
24       rected or authorized as provided in this act.
25        (b) The agencies named in this act are hereby authorized to initiate
26       and complete the capital improvement projects specified and authorized
27       by this act or for which appropriations are made by this act, subject to
28       the restrictions and limitations imposed by this act.
29        Sec. 2.
30      
STATE FAIR BOARD
31        (a) There is appropriated for the above agency from the following spe-
32       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
33       moneys now or hereafter lawfully credited to and available in such fund
34       or funds, except that expenditures other than refunds authorized by law
35       shall not exceed the following:
36       State fair capital improvements fund No limit
37       Grandstand renovation project fund No limit
38       Grandstand cost of issuance fund No limit
39       Grandstand principal and interest fund No limit
40       Grandstand renovation reserve fund No limit
41       Grandstand rebate fund No limit

1       EDIF--capital improvements fund $100,000
  2        (b) On or before the 10th of each month during the fiscal year ending
  3       June 30, 2001, the director of accounts and reports shall transfer from
  4       the state general fund to the state fair capital improvements fund interest
  5       earnings based on: (1) The average daily balance of moneys in the state
  6       fair capital improvements fund for the preceding month; and (2) the net
  7       earnings rate for the pooled money investment portfolio for the preceding
  8       month.
  9        (c) On July 15, 2000, or as soon thereafter as moneys are available, the
10       director of accounts and reports shall transfer $100,000 from the Kansas
11       economic development endowment account of the state economic de-
12       velopment initiatives fund of the department of commerce and housing
13       to the EDIF--capital improvements fund of the state fair board.
14        Sec. 3.
15      
DEPARTMENT OF SOCIAL AND REHABILITATION SERVICES
16        (a) There is appropriated for the above agency from the state institu-
17       tions building fund for the fiscal year ending June 30, 2001, for the capital
18       improvement project or projects specified as follows:
19       Rehabilitation and repair projects $3,987,897
20       Provided, That the secretary of social and rehabilitation services is hereby
21       authorized to transfer moneys during fiscal year 2001 from the rehabili-
22       tation and repair projects account to a rehabilitation and repair account
23       for any institution, as defined by K.S.A. 76-12a01 or 76-12a18 and amend-
24       ments thereto, for projects approved by the secretary of social and re-
25       habilitation services: Provided further, That expenditures also may be
26       made from this account during fiscal year 2001 for the purposes of re-
27       habilitation and repair for facilities of the department of social and re-
28       habilitation services other than any institution, as defined by K.S.A. 76-
29       12a01 or 76-12a18 and amendments thereto: And provided further, That
30       no expenditures shall be made from this account for Rainbow mental
31       health facility other than capital improvements to maintain the buildings
32       and facilities, to comply with the requirements of applicable life safety
33       codes, or to correct conditions that would endanger the health or safety
34       of individuals at the Rainbow mental health facility.
35        (b) In addition to the purposes for which expenditures may be made
36       by the above agency from the other state fees fund for fiscal year 2001,
37       expenditures may be made by the above agency from the other state fees
38       fund for fiscal year 2001 for the following capital improvement project or
39       projects, subject to the expenditure limitations prescribed therefor:
40       Area office rehabilitation and repair $166,000
41       Provided, That expenditures from the area office rehabilitation and repair
42       account shall be in addition to any expenditure limitation imposed on the
43       other state fees fund for fiscal year 2001.

  1        (c) On the effective date of this act, any unencumbered balance in each
  2       of the following accounts of the state institutions building fund is hereby
  3       lapsed: Institutional rehabilitation & repair projects account of Rainbow
  4       mental health facility.
  5        (d) No moneys appropriated for fiscal year 2000 by chapter 132 or 160
  6       of the 1999 Session Laws of Kansas or 2000 Senate Bill No. 39 or for
  7       fiscal year 2001 by this act or any other appropriation act of the 2000
  8       regular session of the legislature for the department of social and reha-
  9       bilitation services or any other state agency shall be expended to close
10       Rainbow mental health facility unless the closing of Rainbow mental
11       health facility is specifically authorized by act of the legislature.
12        Sec. 4.

KANSAS STATE SCHOOL FOR THE BLIND
14        (a) There is appropriated for the above agency from the state institu-
15       tions building fund for the fiscal year ending June 30, 2001, for the capital
16       improvement project or projects specified as follows:
17       Rehabilitation and repair projects $58,270
18       Fire alarm system upgrade $78,390
19        Sec. 5.
20      
KANSAS STATE SCHOOL FOR THE DEAF
21        (a) There is appropriated for the above agency from the state institu-
22       tions building fund for the fiscal year ending June 30, 2001, for the capital
23       improvement project or projects specified as follows:
24       Rehabilitation and repair projects, air-conditioning $188,000
25       Pool and laundry roof replacement $200,000
26       Roberts building renovation $341,200
27        Sec. 6.

DEPARTMENT OF CORRECTIONS
29        (a) There is appropriated for the above agency from the state general
30       fund for the fiscal year ending June 30, 2001, for the capital improvement
31       project or projects specified as follows:
32       Debt service payment for the revenue refunding bondissue $6,226,000
33       Debt service payment for the Wichita work release facilitybond issue $167,000
34       Debt service payment for the Ellsworth correctional facil-ity at Ellsworth, Kansas $1,462,000
35       Debt service payment for the reception and diagnostic unitrelocation bond issue $948,000
36        (b) There is appropriated for the above agency from the correctional
37       institutions building fund for the fiscal year ending June 30, 2001, for the
38       capital improvement project or projects specified as follows:

1       Debt service payment for the revenue refunding bondissues $1,000,000
2       Capital improvements--rehabilitation, remodeling, reno-vation and repair of correctional institutions $4,004,010
  3       Provided, That the secretary of corrections is hereby authorized to trans-
  4       fer moneys during fiscal year 2001 from the capital improvements--re-
  5       habilitation, remodeling, renovation and repair of correctional institutions
  6       account of the correctional institutions building fund to an account or
  7       accounts of the correctional institutions building fund of any institution
  8       or facility under the jurisdiction of the secretary of corrections to be
  9       expended during fiscal year 2001 by the institution or facility for capital
10       improvement projects, including security improvement projects and haz-
11       ardous waste cleanup at Lansing correctional facility, approved by the
12       secretary of corrections.
13        (c) There is appropriated for the above agency from the following spe-
14       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
15       moneys now or hereafter lawfully credited to and available in such fund
16       or funds, except that expenditures other than refunds authorized by law
17       shall not exceed the following:
18       Violent offenders incarceration and truth in sentencing incentive grants--federal fund No limit
19       Refunding lease revenue bond issue--principal and inter-est fund--A-1 bonds No limit

27       number 538 (Hutchinson range tower).
28        Sec. 7.

STATE HISTORICAL SOCIETY
30        (a) On July 1, 2000, any unencumbered balance in excess of $100 as
31       of June 30, 2000, in each of the following capital improvement accounts
32       of the state general fund is hereby reappropriated for fiscal year 2001:
33       Rehabilitation and repair projects; construct storage bay #3.
34        (b) There is hereby appropriated for the above agency from the follow-

  1       ing special revenue fund or funds for the fiscal year ending June 30, 2001,
  2       all moneys now or hereafter lawfully credited to and available in such
  3       fund or funds, except that expenditures shall not exceed the following:
4       Historical society capital improvements fund No limit
  5        (c) In addition to the other purposes for which expenditures may be
  6       made by the above agency from the historical society capital improve-
  7       ments fund for fiscal year 2001, expenditures may be made by the above
  8       agency for the following capital improvement project or projects, subject
  9       to the expenditure limitations prescribed therefor:
10       First Territorial Capitol $71,000
11       Fort Hays Blockhouse $50,000
12        (d) On July 15, 2000, or as soon thereafter as moneys are available, the
13       director of accounts and reports shall transfer $121,000 from the Kansas
14       economic development endowment account of the state economic de-
15       velopment initiatives fund of the department of commerce and housing
16       to the historical society capital improvements fund.
17        Sec. 8.

INSURANCE DEPARTMENT
19        (a) There is appropriated for the above agency from the following spe-
20       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
21       moneys now or hereafter lawfully credited to and available in such fund
22       or funds, except that expenditures shall not exceed the following:
23       Insurance building principal and interest payment fund No limit
24       Insurance department rehabilitation and repair fund No limit
25        Sec. 9.

DEPARTMENT OF ADMINISTRATION
27        (a) There is appropriated for the above agency from the state general
28       fund for the fiscal year ending June 30, 2001, for the capital improvement
29       project or projects specified as follows:
30       Energy conservation improvements--debt service $2,494,994
31       Any unencumbered balance in excess of $100 as of June 30, 2000, in each
32       of the following capital improvement accounts is hereby reappropriated
33       for fiscal year 2001: Rehabilitation and repair for state facilities; fire and
34       safety alarms--statehouse; roof repair at center section and rotunda--
35       statehouse; judicial center carpet replacement; judicial center renovation
36       planning; statehouse grounds and facility improvements; memorial hall
37       security; statehouse committee room planning, remodel and relocation;
38       Cedar Crest repair and renovation.
39        (b) There is appropriated for the above agency from the following spe-
40       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
41       moneys now or hereafter lawfully credited to and available in such fund
42       or funds, except that expenditures shall not exceed the following:
43       Master lease program fund No limit

1       State buildings depreciation fund $0
  2        (c) In addition to the other purposes for which expenditures may be
  3       made from the state budget stabilization fund for fiscal year 2001, ex-
  4       penditures may be made by the above agency from the state budget sta-
  5       bilization fund for fiscal year 2001 from any unencumbered balance as of
  6       June 30, 2000, in each of the following capital improvement accounts of
  7       the state budget stabilization fund: Statehouse elevators renovation; state-
  8       house grounds & facility improvements; statehouse fire and safety alarms:
  9       Provided, That the expenditures for fiscal year 2001 from the unencum-
10       bered balance of any such account shall not exceed the amount of the
11       unencumbered balance in such account on June 30, 2000: Provided fur-
12       ther, That all expenditures from the state budget stabilization fund for
13       the fiscal year 2001 from the unencumbered balance in any such account
14       shall be in addition to any expenditure limitation imposed on the state
15       budget stabilization fund for the fiscal year 2001.
16        (d) In addition to the other purposes for which expenditures may be
17       made by the above agency from the building and ground fund for fiscal
18       year 2001, expenditures may be made by the above agency from the
19       following capital improvement account or accounts of the building and
20       ground fund for fiscal year 2001 for the following capital improvement
21       project or projects, subject to the expenditure limitations prescribed
22       therefor:
23       Paint and grounds shop--debt service No limit
24        (e) In addition to the other purposes for which expenditures may be
25       made by the above agency from the state buildings depreciation fund for
26       fiscal year 2001, expenditures may be made by the above agency from
27       the following capital improvement account or accounts of the state build-
28       ings depreciation fund for fiscal year 2001 for the following capital im-
29       provement project or projects, subject to the expenditure limitations pre-
30       scribed therefor:
31       Rehabilitation and repair $100,000
32       Docking fire suppression system installation $300,000
33       Landon fire suppression system installation $250,000
34       Landon electrical system failure mode study $130,000
35       Docking renovation--debt service No limit
36       Landon & Statehouse steam tunnel and walkway planningand construction $345,500

39       Provided, That all expenditures from each such capital improvement ac-
40       count shall be in addition to any expenditure limitation imposed on the
41       state buildings depreciation fund for fiscal year 2001.

  1        (f) In addition to the other purposes for which expenditures may be
  2       made by the above agency from the state buildings depreciation fund for
  3       fiscal year 2001, expenditures may be made by the above agency from
  4       the state buildings depreciation fund for fiscal year 2001 from the unen-
  5       cumbered balance as of June 30, 2000, in each capital improvement ac-
  6       count of the state buildings depreciation fund for one or more projects
  7       approved for prior fiscal years: Provided, That expenditures from the
  8       unencumbered balance in any such account shall not exceed the amount
  9       of the unencumbered balance in such account on June 30, 2000: Provided
10       further, That all expenditures from any such account shall be in addition
11       to any expenditure limitation imposed on the state buildings depreciation
12       fund for fiscal year 2001.
13        (g) In addition to the other purposes for which expenditures may be
14       made by the above agency from the state buildings operating fund for
15       fiscal year 2001, expenditures may be made by the above agency from
16       the following capital improvement account or accounts of the state build-
17       ings operating fund for fiscal year 2001 for the following capital improve-
18       ment project or projects, subject to the expenditure limitations prescribed
19       therefor:
20       Landon state office building--debt service No limit
21       Memorial hall--debt service No limit
22       Energy conservation projects No limit
23        (h) In addition to the other purposes for which expenditures may be
24       made by the above agency from the motor pool service fund for fiscal
25       year 2001, expenditures may be made by the above agency from the
26       following capital improvement account or accounts of the motor pool
27       service fund for fiscal year 2001 for the following capital improvement
28       project or projects, subject to the expenditure limitations prescribed
29       therefor:

31        (i) In addition to the other purposes for which expenditures may be
32       made from the intragovernmental printing service fund for fiscal year
33       2001, expenditures may be made by the above agency from the following
34       capital improvement account or accounts of the intragovernmental print-
35       ing service fund for fiscal year 2001 for the following capital improvement
36       project or projects, subject to the expenditure limitations prescribed
37       therefor:

DEPARTMENT OF COMMERCE AND HOUSING
41        (a) In addition to the other purposes for which expenditures may be
42       made from the Kansas economic development endowment account of the
43       state economic development initiatives fund for fiscal year 2001, moneys

  1       may be expended by the above agency from the Kansas economic devel-
  2       opment endowment account of the state economic development initia-
  3       tives fund for fiscal year 2001 for the following capital improvement pro-
  4       ject or projects, subject to the expenditure limitations prescribed therefor:
5       Construct new travel information center near Goodland $100,000
6       Rehabilitation and repair--travel information centers $15,000
  7       Provided, That all expenditures by the above agency from the rehabili-
  8       tation and repair--travel information centers subaccount of the Kansas
  9       economic development endowment account of the state economic de-
10       velopment initiatives fund for fiscal year 2001 shall be in addition to any
11       expenditure limitation imposed on the Kansas economic development
12       endowment account of the state economic development initiatives fund
13       for fiscal year 2001.
14        (b) In addition to the other purposes for which expenditures may be
15       made by the department of commerce and housing from the publication
16       and other sales fund for fiscal year 2001, expenditures may be made by
17       the above agency from the publication and other sales fund for fiscal year
18       2001 for the following capital improvement project or projects, subject
19       to the expenditure limitations prescribed therefor:
20       Construct new travel information center near Goodland $100,000
21        Sec. 11.

FORT HAYS STATE UNIVERSITY
23        (a) There is appropriated for the above agency from the following spe-
24       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
25       moneys now or hereafter lawfully credited to and available in such fund
26       or funds, except that expenditures shall not exceed the following:

21       ance, cost of interest on the bonds during the construction of the project
22       and required reserves for the payment of principal and interest on the
23       bonds: Provided further, That such capital improvement project is hereby
24       approved for Kansas state university for the purposes of subsection (b) of
25       K.S.A. 74-8905 and amendments thereto and the authorization of the
26       issuance of bonds by the Kansas development finance authority in ac-
27       cordance with that statute: And provided further, That all moneys re-
28       ceived from the issuance of any such bonds shall be deposited in the state
29       treasury to the credit of this fund.
30       Ackert hall addition--federal fund No limit
31       Ackert hall addition--gifts and grants fund No limit
32       Ackert hall addition--special revenue fund No limit
33       Provided, That Kansas state university may make expenditures from the
34       Ackert hall addition--special revenue fund for the project to construct
35       an addition to Ackert hall in addition to the expenditure of other moneys
36       appropriated therefor: Provided, however, That expenditures from this
37       fund for such capital improvement project shall not exceed $1,500,000

  1       plus all amounts required for costs of any bond issuance, costs of interest
  2       on any bond issued or obtained for such capital improvement project and
  3       any required reserves for payment of principal and interest on any bond:
  4       Provided further, That such capital improvement project is hereby ap-
  5       proved for Kansas state university for the purposes of subsection (b) of
  6       K.S.A. 74-8905 and amendments thereto and the authorization of the
  7       issuance of bonds by the Kansas development finance authority in ac-
  8       cordance with that statute: And provided further, That all moneys re-
  9       ceived from the issuance of any such bonds shall be deposited in the state
10       treasury to the credit of this fund.
11       Student and staff parking garage--special revenue fund No limit
12       Provided, That Kansas state university may make expenditures from the
13       student and staff parking garage--special revenue fund for the capital
14       improvement project to construct a parking garage in addition to the
15       expenditure of other moneys appropriated therefor: Provided, however,
16       That expenditures from this fund for such capital improvement project
17       shall not exceed $10,500,000 plus all amounts required for costs of any
18       bond issuance, costs of interest on any bond issued or obtained for such
19       capital improvement project and any required reserves for payment of
20       principal and interest on any bond: Provided further, That such capital
21       improvement project is hereby approved for Kansas state university for
22       the purposes of subsection (b) of K.S.A. 74-8905 and amendments thereto
23       and the authorization of the issuance of bonds by the Kansas development
24       finance authority in accordance with that statute: And provided further,
25       That all moneys received from the issuance of any such bonds shall be
26       deposited in the state treasury to the credit of this fund.
27       Football stadium expansion--special revenue fund No limit
28       Provided, That Kansas state university may make expenditures from the
29       football expansion--special revenue fund for the capital improvement
30       project to expand the football stadium in addition to the expenditure of
31       other moneys appropriated therefor: Provided, however, That expendi-
32       tures from this fund for such capital improvement project shall not exceed
33       $16,000,000 plus all amounts required for costs of any such bond issuance,
34       costs of interest on any bonds issued or obtained for such capital im-
35       provement projects and any required reserves for payment of principal
36       and interest on any bond: Provided further, That such capital improve-
37       ment is hereby approved for Kansas state university for the purposes of
38       subsection (b) of K.S.A. 74-8905 and amendments thereto and the au-
39       thorization of the issuance of bonds by the Kansas development finance
40       authority in accordance with that statute: And provided further, That all
41       moneys received from the issuance of any such bonds shall be deposited
42       in the state treasury to the credit of this fund.
43        (c) In addition to the other purposes for which expenditures may be

  1       made by the above agency from the restricted fees fund for the fiscal year
  2       ending June 30, 2001, expenditures may be made by the above agency
  3       from the appropriate account or accounts of the restricted fees fund dur-
  4       ing fiscal year 2001 for the following capital improvement project or pro-
  5       jects, subject to the expenditure limitations prescribed therefor:
6       Biological and agricultural engineering research storagebuilding No limit

10        (d) In addition to the other purposes for which expenditures may be
11       made by the above agency from the student union renovation and expan-
12       sion fund for fiscal year 2001, expenditures may be made by the above
13       agency from the student union renovation and expansion fund for fiscal
14       year 2001 for costs associated with roof repair on an existing portion of
15       the student union building.
16        (e) In addition to the other purposes for which expenditures may be
17       made by the above agency from the sponsored research overhead fund
18       for fiscal year 2001, expenditures may be made by the above agency from
19       the sponsored research overhead fund for the fiscal year 2001 for the
20       following capital improvement project or projects, subject to the expend-
21       iture limitations prescribed therefor:
22       Accelerated testing laboratory garage addition No limit
23       Accelerated testing laboratory storage/equipment shed No limit
24       Salina national gas machinery laboratory No limit
25        (f) During the fiscal year ending June 30, 2001, Kansas state university
26       is hereby authorized to make expenditures to raze Dennison hall and to
27       raze portions of building no. 025 (Seaton hall).

35       ing fiscal year 2001 for the following capital improvement project or pro-

25        (a) In addition to the other purposes for which expenditures may be
26       made by the above agency from the employment security administration
27       fund for fiscal year 2001, expenditures may be made by the above agency
28       from the employment security administration fund for fiscal year 2001
29       from moneys made available to the state under section 903 of the federal
30       social security act, as amended: Provided, That expenditures from this
31       fund during fiscal year 2001 of moneys made available to the state under
32       section 903 of the federal social security act, as amended, shall be made
33       only for the following capital improvement purposes: (1) For major main-
34       tenance of existing buildings used by the department of human resources
35       for employment security purposes; (2) for paving, landscaping and ac-
36       quiring fixed equipment as may be required for the use and operation of
37       such buildings; or (3) for any combination of these purposes: Provided
38       further, That expenditures from this fund for fiscal year 2001 of moneys

  1       made available to the state under section 903 of the federal social security
  2       act, as amended, for such capital improvement purposes shall not exceed
  3       $75,000 plus the amounts of unencumbered balances as of June 30, 2000,
  4       for capital improvement projects approved for fiscal years prior to fiscal
  5       year 2001: And provided further, That all expenditures from this fund for
  6       any such capital improvement purposes or projects shall be in addition
  7       to any expenditure limitation imposed on the employment security ad-
  8       ministration fund for fiscal year 2001.
  9        (b) There is appropriated for the above agency from the following spe-
10       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
11       moneys now or hereafter lawfully credited to and available in such fund
12       or funds, except that expenditures shall not exceed the following:
13       Complete remodeling of agency headquarters fund No limit
14       Provided, That the department of human resources may make expendi-
15       tures from the complete remodeling of agency headquarters fund for the
16       capital improvement project to remodel the agency headquarters: Pro-
17       vided, however, That expenditures from this fund for such capital im-
18       provement project shall not exceed $1,905,000, plus all amounts required
19       for cost of bond issuance, cost of interest on the bonds issued for such
20       capital improvement project and any required reserves for the payment

22       improvement project is hereby approved for the department of human
23       resources for the purposes of subsection (b) of K.S.A. 74-8905 and
24       amendments thereto and the authorization of the issuance of bonds by

26       And provided further, That all moneys received from the issuance of any
27       such bonds shall be deposited in the state treasury to the credit of this
28       fund.
29        Sec. 21.

KANSAS COMMISSION ON VETERANS AFFAIRS
31        (a) There is appropriated for the above agency from the state institu-
32       tions building fund for the fiscal year ending June 30, 2001, for the capital
33       improvement project or projects specified as follows:
34       Soldiers' home repair and rehabilitation projects $100,000
35       Veterans' home repair and rehabilitation projects $80,000
36        (b) There is appropriated for the above agency from the following spe-
37       cial revenue fund or funds for the fiscal year ending June 30, 2001, all

14        (a) In addition to the other purposes for which expenditures may be
15       made from the highway patrol training center fund for fiscal year 2001,
16       expenditures may be made by the above agency from the highway patrol
17       training center fund for fiscal year 2001 to make debt service payments
18       for the Kansas highway patrol training center at Salina for the bonds
19       issued for such project pursuant to subsection (b) of section 6 of chapter
20       326 of the 1992 Session Laws of Kansas.
21        (b) In addition to the other purposes for which expenditures may be
22       made from the highway patrol training center fund for fiscal year 2001,
23       expenditures may be made by the above agency from the highway patrol
24       training center fund for fiscal year 2001 for the following capital improve-
25       ment project or projects, subject to the expenditure limitation prescribed
26       therefor:

  3        (a) There is appropriated for the above agency from the state general
  4       fund for the fiscal year ending June 30, 2001, for the capital improvement

  6       Any unencumbered balance in excess of $100 as of June 30, 2000, in each
  7       of the following capital improvement accounts of the state general fund
  8       is hereby reappropriated for fiscal year 2001: Rehabilitation and repair;
  9       handicapped accessibility renovation.
10       Any unencumbered balance in excess of $100 as of June 30, 2000, in each
11       of the following capital improvement accounts of the state general fund
12       is hereby reappropriated for fiscal year 2001: Matching grant for devel-
13       opment of wetlands project at Milford reservoir: Provided, That expend-
14       itures for fiscal year 2001 may be made from the matching grant for
15       development of wetlands project at Milford reservoir account by the sec-
16       retary of wildlife and parks only upon verification by the chairperson of
17       WILDSCAPE that federal funds are available from the U.S. army corps
18       of engineers for development of the Milford wetlands: Provided, however,
19       That funds provided by the Kansas department of wildlife and parks to
20       WILDSCAPE shall not be used to finance the administrative costs of
21       WILDSCAPE.
22        (b) There is appropriated for the above agency from the following spe-
23       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
24       moneys now or hereafter lawfully credited to and available in such fund
25       or funds, except that expenditures shall not exceed the following:

30        (c) On July 1, 2000, or as soon thereafter as moneys are available, the

34        (d) On July 1, 2000, or as soon thereafter as moneys are available, the
35       director of accounts and reports shall transfer $200,000 from the state
36       highway fund of the department of transportation to the bridge mainte-
37       nance fund of the department of wildlife and parks.
38        (e) In addition to the other purposes for which expenditures may be
39       made by the above agency from the migratory waterfowl propagation and
40       protection fund for fiscal year 2001, expenditures may be made by the
41       above agency from the migratory waterfowl propagation and protection
42       fund for fiscal year 2001 from the unencumbered balance as of June 30,
43       2000, in each existing capital improvement account of the migratory wa-

  1       terfowl propagation and protection fund: Provided, That all expenditures
  2       from the unencumbered balance of any such account shall not exceed the
  3       amount of the unencumbered balance in such account on June 30, 2000:

18       imposed on the boating fee fund for fiscal year 2001 and shall be in

21        (g) In addition to the other purposes for which expenditures may be
22       made by the above agency from the state budget stabilization fund for
23       fiscal year 2001, expenditures may be made by the above agency from
24       the state budget stabilization fund for fiscal year 2001 from the unencum-
25       bered balance as of June 30, 2000, in each existing capital improvement
26       account of the above agency in the state budget stabilization fund: Pro-
27       vided, That expenditures from the unencumbered balance of any such
28       existing capital improvement account shall not exceed the amount of the
29       unencumbered balance in such account on June 30, 2000: Provided fur-
30       ther, That all expenditures from the unencumbered balance of any such

10       flood aid fund are hereby transferred to and imposed on the federal flood
11       aid account of the federal grants fund and the federal flood aid fund is
12       hereby abolished.
13        (r) On July 1, 2000, the director of accounts and reports shall transfer
14       all moneys in the renovation of Cheyenne Bottoms--federal fund to the
15       Cheyenne Bottoms account of the federal grants fund. On July 1, 2000,
16       all liabilities of the renovation of Cheyenne Bottoms--federal fund are
17       hereby transferred to and imposed on the Cheyenne Bottoms account of
18       the federal grants fund and the renovation of Cheyenne Bottoms--federal
19       fund is hereby abolished.
20        (s) On July 1, 2000, the director of accounts and reports shall transfer
21       all moneys in the rails- to-trails federal fund to the trail development
22       account of the federal grants fund. On July 1, 2000, all liabilities of the
23       rails-to-trails federal fund are hereby transferred to and imposed on the
24       trail development account of the federal grants fund and the rails-to-trails
25       federal fund is hereby abolished.
26        (t) On July 1, 2000, the director of accounts and reports shall transfer
27       all moneys in the clean lakes fund--federal fund to the clean lakes ac-
28       count of the federal grants fund. On July 1, 2000, all liabilities of the clean
29       lakes fund--federal fund are hereby transferred to and imposed on the
30       clean lakes account of the federal grants fund and the clean lakes fund--
31       federal fund is hereby abolished.
32        (u) On July 1, 2000, the director of accounts and reports shall transfer
33       all moneys in the renovation of Cheyenne Bottoms--bureau of recla-
34       mation--federal fund to the Cheyenne Bottoms account of the federal
35       grants fund. On July 1, 2000, all liabilities of the renovation of Cheyenne
36       Bottoms--bureau of reclamation--federal fund are hereby transferred to
37       and imposed on the Cheyenne Bottoms account of the federal grants fund
38       and the renovation of Cheyenne Bottoms--bureau of reclamation--fed-
39       eral fund is hereby abolished.
40        (v) On July 1, 2000, the director of accounts and reports shall transfer
41       all moneys in the Cheyenne Bottoms project gift fund to the department
42       of wildlife and parks private gifts and donations fund. On July 1, 2000,
43       all liabilities of the Cheyenne Bottoms project gift fund are hereby trans-

  1       ferred to and imposed on the department of wildlife and parks private
  2       gifts and donations fund and the Cheyenne Bottoms project gift fund is
  3       hereby abolished.
  4        (w) On July 1, 2000, the director of accounts and reports shall transfer
  5       all moneys in the EDIF--Prairie Spirt rails/trails project grant fund in
  6       the department of wildlife and parks to the Kansas economic develop-
  7       ment endowment account of the state economic development initiatives
  8       fund of the department of commerce and housing and the EDIF--Prairie
  9       Spirit rails trails project grant fund of the department of wildlife and parks
10       is hereby abolished.
11        (x) On July 1, 2000, the director of accounts and reports shall transfer
12       all moneys in the boating development account of the boating fee fund
13       to the boating fee fund boating access and development account of the
14       boating fee fund. On July 1, 2000, all liabilities of the boating development
15       account of the boating fee fund are hereby transferred to and imposed
16       on the boating fee fund boating access and development account of the
17       boating fee fund and the boating development account of the boating fee
18       fund is hereby abolished.
19        (y) On July 1, 2000, the director of accounts and reports shall transfer
20       all moneys in the reservoir facility development account of the wildlife
21       fee fund to the wildlife fee fund angler facilities improvements account
22       of the wildlife fee fund. On July 1, 2000, all liabilities of the reservoir
23       facility development account of the wildlife fee fund are hereby trans-
24       ferred to and imposed on the wildlife fee fund angler facilities improve-
25       ments account of the wildlife fee fund and the reservoir facility devel-
26       opment account of the wildlife fee fund is hereby abolished.
27        (z) On July 1, 2000, the director of accounts and reports shall transfer
28       all moneys in the fisheries projects account of the wildlife fee fund to the
29       wildlife fee fund angler facilities improvements account of the wildlife
30       fee fund. On July 1, 2000, all liabilities of the fisheries projects account
31       of the wildlife fee fund are hereby transferred to and imposed on the
32       wildlife fee fund angler facilities improvements account of the wildlife
33       fee fund and the fisheries projects account of the wildlife fee fund is
34       hereby abolished.
35        (aa) On July 1, 2000, the director of accounts and reports shall transfer
36       all moneys in the fisheries projects--capital improvements account of the
37       wildlife fee fund to the wildlife fee fund angler facilities improvements
38       account of the wildlife fee fund. On July 1, 2000, all liabilities of the
39       fisheries projects--capital improvements account of the wildlife fee fund
40       are hereby transferred to and imposed on the wildlife fee fund angler
41       facilities improvements account of the wildlife fee fund and the fisheries
42       projects--capital improvements account of the wildlife fee fund is hereby
43       abolished.

  1        (bb) On July 1, 2000, the director of accounts and reports shall transfer
  2       all moneys in the wildlife fee fund ADA renovation fishery enhancements
  3       account of the wildlife fee fund to the wildlife fee fund ADA renovation
  4       account of the wildlife fee fund. On July 1, 2000, all liabilities of the
  5       wildlife fee fund ADA renovation fishery enhancements account of the
  6       wildlife fee fund are hereby transferred to and imposed on the wildlife
  7       fee fund ADA renovation account of the wildlife fee fund and the wildlife
  8       fee fund ADA renovation fishery enhancements account of the wildlife
  9       fee fund is hereby abolished.
10        (cc) On July 1, 2000, the director of accounts and reports shall transfer
11       all moneys in the state fishing lake dam repair account of the wildlife fee
12       fund to the wildlife fee fund state fishing lake projects account of the
13       wildlife fee fund. On July 1, 2000, all liabilities of the state fishing lake
14       dam repair account of the wildlife fee fund are hereby transferred to and
15       imposed on the wildlife fee fund state fishing lake projects account of the
16       wildlife fee fund and the state fishing lake dam repair account of the
17       wildlife fee fund is hereby abolished.
18        (dd) On July 1, 2000, the director of accounts and reports shall transfer
19       all moneys in the renovate state fishing lakes account of the wildlife fee
20       fund to the wildlife fee fund state fishing lake projects account of the
21       wildlife fee fund. On July 1, 2000, all liabilities of the renovate state fishing
22       lakes account of the wildlife fee fund are hereby transferred to and im-
23       posed on the wildlife fee fund state fishing lake projects account of the
24       wildlife fee fund and the renovate state fishing lakes account of the wild-
25       life fee fund is hereby abolished.
26        (ee) On July 1, 2000, any unencumbered balance as of June 30, 2000,
27       in each of the following accounts of the wildlife fee fund is hereby lapsed:
28       Wildlife fee fund shooting range development; Pratt museum renovation;
29       renovate Cheyenne Bottoms; wildlife fee fund flood damage repair in
30       wildlife areas; Wichita education center; dam maintenance and repair.
31        (ff) On July 1, 2000, the director of accounts and reports shall transfer
32       all moneys in the construct boat slips at Prairie Dog state park account
33       of the parks fee fund to the rehabilitation and repair projects account of
34       the parks fee fund. On July 1, 2000, all liabilities of the construct boat
35       slips at Prairie Dog state park account of the parks fee fund are hereby
36       transferred to and imposed on the rehabilitation and repair projects ac-
37       count of the parks fee fund and the construct boat slips at Prairie Dog
38       state park account of the parks fee fund is hereby abolished.

  4       abilities act compliance projects, state fire marshal code compliance pro-
  5       jects, and improvements to classroom projects for institutions of higher
  6       education account to an account or accounts of the Kansas educational
  7       building fund of any institution under the control and supervision of the
  8       state board of regents to be expended by the institution for projects ap-
  9       proved by the state board of regents: Provided, however, That no ex-
10       penditures shall be made from any such account until the proposed pro-
11       jects have been reviewed by the joint committee on state building
12       construction.
13       Debt service--revenue bonds issued for major remodelingand new construction projects at state educationalinstitutions $15,000,000
14        Sec. 26.

ADJUTANT GENERAL
16        (a) There is appropriated for the above agency from the following spe-
17       cial revenue fund or funds for the fiscal year ending June 30, 2001, all
18       moneys now or hereafter lawfully credited to and available in such fund
19       or funds, except that expenditures shall not exceed the following:
20       Comprehensive armory construction and rehabilitationfund No limit
21       Provided, That the adjutant general is hereby authorized to make ex-
22       penditures from the comprehensive armory construction and rehabilita-
23       tion fund for capital improvement projects for acquisition, construction,
24       equipping, furnishing, renovation, reconstruction and repair of armories
25       or for payment of debt service on revenue bonds issued to finance such
26       projects: Provided further, That the adjutant general may make expend-
27       itures from this fund for the payment of debt service on revenue bonds
28       issued to finance such projects: And provided further, That, prior to the
29       issuance of any bonds authorized by this section or making the first ex-
30       penditure from this fund for any such capital improvement project, the
31       adjutant general shall first advise and consult with the joint committee
32       on state building construction regarding the scope of projects proposed
33       and the availability of alternative funding for all or part of the costs of
34       such capital improvement projects: And provided further, That capital
35       improvement projects for the acquisition, construction, equipping, fur-
36       nishing, renovation, reconstruction and repair of armories are hereby ap-
37       proved for the adjutant general for the purposes of subsection (b) of

  1       K.S.A. 74-8905 and amendments thereto and the authorization of one or
  2       more series of revenue bonds by the Kansas development finance au-
  3       thority in accordance with that statute: And provided further, That the
  4       aggregate amount of all such revenue bonds issued shall not exceed
  5       $22,000,000 plus all amounts required for costs of any bond issuance,
  6       costs of interest on any bond issued or obtained for one or more of such
  7       capital improvement projects and any required reserves for payment of
  8       principal and interest on any such bonds: And provided further, That all
  9       moneys received from issuance of any such bonds shall be deposited in
10       the state treasury and credited to this fund.
11        [Sec. 27. (a) During the fiscal years ending June 30, 2000, and
12       June 30, 2001, notwithstanding the provisions of K.S.A. 74-8905
13       and amendments thereto, no bonds shall be issued by the Kansas
14       development finance authority for any capital improvement pro-
15       ject for the construction or expansion of any prison or any other
16       correctional facility for the department of corrections unless such
17       capital improvement project has been specifically approved by act
18       of the legislature for the department of corrections for the pur-
19       poses of subsection (b) of K.S.A. 74-8905 and amendments thereto
20       and the authorization of the issuance of bonds by the Kansas de-
21       velopment finance authority in accordance with that statute for
22       such capital improvement project.
23        [(b) During the fiscal years ending June 30, 2000, and June 30,
24       2001, notwithstanding the provisions of K.S.A. 74-8905 and
25       amendments thereto, the state finance council shall not approve
26       any capital improvement project for the construction or expansion
27       of any prison or any other correctional facility for the department
28       of corrections for the purposes of subsection (b) of K.S.A. 74-8905
29       and amendments thereto and the authorization of the issuance of
30       bonds by the Kansas development finance authority in accordance
31       with that statute for any such capital improvement project.]
32        Sec. 27. [28.] Appeals to exceed expenditure limitations. Upon written
33       application to the governor and approval of the state finance council,
34       expenditures from special revenue funds may exceed the amounts spec-
35       ified in this act.
36        Sec. 28. [29.] Savings. Any unencumbered balance as of June 30, 2000,
37       in any special revenue fund, or account thereof, of any state agency named
38       in this act which is not otherwise specifically appropriated or limited by
39       this or other appropriation act of the 2000 regular session of the legisla-
40       ture, is hereby appropriated for the fiscal year ending June 30, 2001, for
41       the same use and purpose as the same was heretofore appropriated.
42        Sec. 29. [30.] Any correctional institutions building fund appropriation
43       heretofore appropriated to any state agency named in this or other ap-

  1       propriation act of the 2000 regular session of the legislature, and having
  2       an unencumbered balance as of June 30, 2000, in excess of $100 is hereby
  3       reappropriated for the fiscal year ending June 30, 2001, for the same uses
  4       and purposes as originally appropriated unless specific provision is made
  5       for lapsing such appropriation.
  6        Sec. 30. [31.] Any Kansas educational building fund appropriation
  7       heretofore appropriated to any institution named in this or other appro-
  8       priation act of the 2000 regular session of the legislature and having an
  9       unencumbered balance as of June 30, 2000, in excess of $100 is hereby
10       reappropriated for the fiscal year ending June 30, 2001, for the same use
11       and purpose as originally appropriated, unless specific provision is made
12       for lapsing such appropriation.
13        Sec. 31. [32.] Any state institutions building fund appropriation here-
14       tofore appropriated to any state agency named in this or other appropri-
15       ation act of the 2000 regular session of the legislature and having an
16       unencumbered balance as of June 30, 2000, in excess of $100 is hereby
17       reappropriated for the fiscal year ending June 30, 2001, for the same use
18       and purpose as originally appropriated, unless specific provision is made
19       for lapsing such appropriation.
20        Sec. 32. [33.] This act shall take effect and be in force from and after
21       its publication in the Kansas register.
