9 AN ACT relating to the state library and the state librarian; state library
10 advisory commission; amending K.S.A. 75-2535 and 75-2546 and re-
11 pealing the existing sections.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 75-2535 is hereby amended to read as follows: 75-
15 2535. On and after the effective date of this act, the state librarian shall
16 be appointed by the governor, subject to confirmation by the senate as
17 provided in K.S.A. 75-4315b legislative coordinating council to serve un-
18 der its direction. The state librarian may be removed from office by a vote
19 of five members of the legislative coordinating council taken at any regular
20 meeting of such council. Any person appointed as the state librarian shall
21 hold a graduate degree in library science and shall have not less than five
22 years actual experience in library administration. The state librarian and
23 all employees of the state library shall be in the unclassified service under
24 the Kansas civil service act and shall hold office at the pleasure of the
25 governor. The state librarian appointed by the legislative coordinating
26 council shall receive such compensation as is determined by the legislative
27 coordinating council. The state librarian shall appoint such assistants and
28 employees as are authorized by the legislative coordinating council and
29 shall set their compensation subject to approval of such council. The state
30 librarian, and any of the state librarian's assistants specified by the leg-
31 islative coordinating council, shall receive expenses and allowances for in-
32 state and out-of-state travel as is provided by K.S.A. 75-3212 and amend-
33 ments thereto. The state librarian shall have complete control of the state
34 library, including all extension library services and reader services for the
35 blind and other handicapped persons. The state librarian shall employ a
36 director of reference to administer laws providing for the state library
37 and reference services.
38 Sec. 2. K.S.A. 75-2546 is hereby amended to read as follows: 75-
39 2546. The state library advisory commission in effect immediately prior
40 to the effective date of this act is hereby abolished and in its place there
41 is hereby established a new state library advisory commission which shall
42 consist of eight members. One member of the commission shall be the
43 state librarian who shall be an ex officio member but shall not be a voting
44 member. The Three of the other seven members of the commission shall
45 be appointed by the governor. One member shall be a representative
46 librarian from one of the state educational institutions under the control
47 and supervision of the state board of regents and one member shall be a
48 qualified member of the Kansas federation of women's clubs. The other
49 four members of the commission shall be appointed as follows: One by
50 the president of the senate, one by the speaker of the house of represen-
51 tatives, one by the minority leader of the senate and one by the minority
52 leader of the house of representatives. No member shall be appointed to
53 more than two consecutive terms. Terms of appointive members of the
54 commission shall be for four years and shall expire on June 30 of the year
55 in which the respective terms expire. All members shall be interested in
56 promoting the establishment and developing development of publicly sup-
57 ported free library services in the state and encouraging development of
58 libraries of all types.
59 The commission shall consult and advise with the state librarian from
60 time to time and suggest or recommend to the governor and the state
61 librarian policies, management and services that will best promote and
62 advance the use and usefulness of the state library and its extension serv-
63 ices for the residents of the state. The commission shall organize annually
64 by electing a chairperson and a vice-chairperson. The vice-chairperson
65 shall preside at meetings in the absence of the chairperson. The state
66 librarian shall serve as secretary of the commission. The commission shall
67 hold quarterly meetings and other meetings which may be called by the
68 secretary. The commission shall meet upon request of a majority of the
69 members of the commission. Members of the state library advisory com-
70 mission attending meetings of the commission, or attending a subcom-
71 mittee meeting thereof authorized by the commission, shall be paid
72 amounts provided in subsection (e) of K.S.A. 75-3223, and amendments
73 thereto. Amounts paid under this section shall be paid from appropria-
74 tions to the state library upon warrants of the director of accounts and
75 reports issued pursuant to vouchers approved by the state librarian or a
76 person designated by the state librarian.
77 Sec. 3. K.S.A. 75-2535 and 75-2546 are hereby repealed.
78 Sec. 4. This act shall take effect and be in force from and after its
79 publication in the Kansas register.
