9 AN ACT concerning crimes and punishment; relating to arson; amending
10 K.S.A. 21-3718 and repealing the existing section.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. K.S.A. 21-3718 is hereby amended to read as follows: 21-
14 3718. (a) Arson is knowingly, by means of fire or explosive:
15 (1) Damaging any building or property which is not a dwelling in
16 which another person has any interest without the consent of such other
17 person; or
18 (2) damaging any building or property which is not a dwelling with
19 intent to injure or defraud an insurer or lienholder.;
20 (3) damaging any building or property which is a dwelling in which
21 another person has any interest without the consent of such other person;
22 or
23 (4) damaging any building or property which is a dwelling with intent
24 to injure or defraud an insurer or lienholder.
25 (b) (1) Arson, as described in subsection (a)(1) or (2), is a severity
26 level 5, nonperson felony if the property is damaged to the extent of
27 $50,000 or more.
28 (2) Arson, as described in subsection (a)(1) or (2), is a severity level
29 6, nonperson felony if the property is damaged to the extent of at least
30 $25,000 but less than $50,000.
31 (3) Arson, as described in subsection (a)(1) or (2), is a severity level
32 7, nonperson felony if the property is damaged to the extent of less than
33 $25,000.
34 (c) (1) Arson, as described in subsection (a)(3) or (4), is a severity
35 level 5, person felony if the property is damaged to the extent of $50,000
36 or more.
37 (2) Arson, as described in subsection (a)(3) or (4), is a severity level
38 6, person felony if the property is damaged to the extent of at least $25,000
39 but less than $50,000.
40 (3) Arson, as described in subsection (a)(3) or (4), is a severity level
41 7, person felony if the property is damaged to the extent of less than
42 $25,000.
43 Sec. 2. K.S.A. 21-3718 is hereby repealed.
44 Sec. 3. This act shall take effect and be in force from and after its
45 publication in the statute book.
