12             AN  ACT concerning the SRS transition oversight committee; continuing
13             the committee in existence; composition; duties; amending K.S.A.
14             1998 Supp. 46-2701 and repealing the existing section.
15      
16       Be it enacted by the Legislature of the State of Kansas:
17             Section  1. K.S.A. 1998 Supp. 46-2701 is hereby amended to read as
18       follows: 46-2701. (a) There is hereby created the SRS transition oversight
19       committee which. In accordance with this section, the SRS transition
20       oversight committee in existence on the effective date of this act is hereby
21       continued in existence. On and after July 1, 2000 1999, the oversight
22       committee shall consist of 12 members as follows:
23             (1) Three members who shall be appointed by the chairperson of the
24       house appropriations committee, from among the members of the house
25       appropriations committee, of whom two are members of the majority
26       party and one is a member of the minority party;
27             (2) three members who shall be appointed by the chairperson of the
28       senate ways and means committee, from among the members of the senate
29       ways and means committee, of whom two are members of the majority
30       party and one is a member of the minority party;
31             (3) two three members who shall be appointed by the speaker of the
32       house of representatives from among the members of the house com-
33       mittee on health and human services, one of whom two shall be a member
34       members of the majority party and one of whom shall be a member of
35       the minority party; and
36             (4) two three members who shall be appointed by the president of
37       the senate from among the members of the senate committee on public
38       health and welfare, one of whom two shall be a member members of the
39       majority party and one of whom shall be a member of the minority party;
40       and
41             (5) two members appointed jointly by the speaker of the house of
42       representatives and the president of the senate from among the members

  1       of the health care reform legislative oversight committee, one of whom
  2       shall be a member of the majority party and one of whom shall be a
  3       member of the minority party.
  4             (b)  (1) The terms of office of all members of the SRS transition over-
  5       sight committee serving on June 30, 1999, are hereby continued until June
  6       30, 2000, and the terms of office of the chairperson and vice-chairperson
  7       of the SRS transition oversight committee serving in such offices on June
  8       30, 1999, are hereby continued until June 30, 2000. For the period from
  9       July 1, 2000, through June 30, 2001, the chairperson of the house appro-
10       priations committee shall appoint the chairperson of the oversight com-
11       mittee for the first year, ending on June 30, and the chairperson of the
12       senate ways and means committee shall appoint the chairperson vice-
13       chairperson of the oversight committee for the second year of its exis-
14       tence. No legislator whose district includes any part of the counties of
15       Shawnee or Cowley shall be eligible to serve as a member of the oversight
16       committee.
17             (2) The terms of office of all members of the SRS transition oversight
18       committee appointed to serve for the period commencing on July 1, 2000,
19       shall expire on January 8, 2001. The terms of office of all members of the
20       SRS transition oversight committee appointed to serve for the period com-
21       mencing on January 8, 2001, shall expire on June 30, 2001.
22             (3) (2) If a vacancy occurs in the office of any member of the SRS
23       transition oversight committee, a successor shall be appointed in the same
24       manner as the original appointment.
25             (c) The oversight committee shall meet on call of the chairperson. All
26       such meetings shall be held in Topeka unless authorized to be held in a
27       different place by the legislative coordinating council. Members of the
28       oversight committee shall receive compensation and travel expenses and
29       subsistence expenses or allowances as provided in K.S.A. 75-3212 and
30       amendments thereto, when attending meetings of such committee.
31             (d)  (1) The oversight committee shall monitor implementation of the
32       transfer of the long-term care programs that were transferred from the
33       secretary of social and rehabilitation services to the secretary of aging.
34       The committee shall specifically examine transfer cost neutrality and the
35       need for additional funding to finance transition costs. The oversight com-
36       mittee shall ensure that the transfer of the long-term care programs does
37       not lead to a loss of services by consumers.
38             (2) The oversight committee shall:
39             (A) monitor, review and make recommendations relating to privati-
40       zation efforts at the state hospitals, the closure of hospital beds, the down-
41       sizing of staff, the closure of Topeka state hospital and Winfield state
42       hospital and training center, the funding of community services and the
43       availability of adequate community services;

  1             (B) monitor and review preparation of an evaluation of the hospital
  2       closure process which emphasizes how the process might be improved if
  3       additional closure efforts are necessary in future years;
  4             (C) review and make recommendations to the legislative coordinating
  5       council relating to selection of a contractor to perform such evaluation of
  6       the hospital closure process; and
  7             (D) cooperate with the Kansas council on developmental disabilities
  8       in developing and reviewing the request for proposal process and in se-
  9       lecting the contractor to perform the hospital closure process evaluation.
10             (3) The oversight committee shall monitor, review and make rec-
11       ommendations relating to (A) privatization of children service programs
12       of the department of social and rehabilitation services including family
13       preservation, foster care and adoption programs, (B) privatization of child
14       support collection programs and any other programs of the department
15       of social and rehabilitation services, and (C) privatization of any pro-
16       grams of the department on aging.
17             (4) The SRS transition oversight committee shall monitor, review and
18       make recommendations relating to federal social welfare reform laws and
19       the regulations and policies implementing such laws and the activities of
20       the department of social and rehabilitation services relating to such fed-
21       eral laws, regulations and policies.
22             (5) The oversight committee shall:
23             (A) Prepare an interim report on findings and recommendations
24       which shall be provided to the legislature on or before the first day of the
25       1997 2000 legislative session; and
26             (B) prepare a final report on findings and recommendations which
27       shall be provided to the legislature legislative coordinating council on
28       or before the first day of the 1998 2001 legislative session; and June 30,
29       2000.
30             (C) prepare an additional interim report relating to how the closure
31       process could be improved, including recommendations for improve-
32       ments in the closure process should closure of similar institutions occur
33       in future years, to be presented separately on or before the first day of
34       the 1997 legislative session, and to prepare an additional final report on
35       such issues to be presented separately to the legislature on or before the
36       first day of the 1998 legislative session.
37             (e)  (1) In accordance with K.S.A. 46-1204 and amendments thereto,
38       the legislative coordinating council may provide for a contractor to per-
39       form an evaluation of the hospital closure process as may be recom-
40       mended by the SRS transition oversight committee.
41             (2) Such contractor shall prepare an evaluation of hospital closure,
42       including, but not limited to, evaluation of the following:
43             (A) Tracking of community placement and hospital transfers;

  1             (B) appropriateness of placements and quality of community services;
  2             (C) changes in capabilities of patients placed in the community and
  3       other hospitals;
  4             (D) consumer, parental and guardianship knowledge of available op-
  5       tions prior to placements;
  6             (E) impact of parental or guardian opinions regarding closure;
  7             (F) changes in community attitudes toward hospital closure and per-
  8       sons with developmental disabilities or severe and persistent mental ill-
  9       ness; and
10             (G) identification of elements of the closure process which are suc-
11       cessful, and the elements which are unsuccessful, including recommen-
12       dations on how the process may be improved.
13             (f) (e) The SRS transition oversight committee is hereby abolished
14       on July 1, 1998 2001 2000
15       [(f) If the health care reform legislative oversight committee es-
16       tablished pursuant to K.S.A. 1998 Supp. 46-2501 et seq., is revived
17       by a law enacted during the 1999 regular session of the legislature,
18       and the effective date of such revival is on or before July 1, 1999,
19       notwithstanding any other provision of law to the contrary, the SRS
20       transition oversight committee members' terms shall expire on June
21       30, 1999, and on and after July 1, 1999, the oversight committee
22       shall consist of 12 members and shall be appointed as follows:
23             [(1) Three members who shall be appointed by the chairperson
24       of the house appropriations committee, from among the members of
25       the house appropriations committee, of whom two are members of
26       the majority party and one is a member of the minority party;
27             [(2) three members who shall be appointed by the chairperson
28       of the senate ways and means committee, from among the members
29       of the senate ways and means committee, of whom two are members
30       of the majority party and one is a member of the minority party;
31             [(3) two members who shall be appointed by the speaker of the
32       house of representatives from among the members of the house com-
33       mittee on health and human services, one of whom shall be a mem-
34       ber of the majority party and one of whom shall be a member of
35       the minority party;
36             [(4) two members who shall be appointed by the president of
37       the senate from among the members of the senate committee on
38       public health and welfare, one of whom shall be a member of the
39       majority party and one of whom shall be a member of the minority
40       party; and
41             [(5) two members appointed jointly by the speaker of the house
42       of representatives and the president of the senate from among the
43       members of the health care reform legislative oversight committee,

  1       one of whom shall be a member of the majority party and one of
  2       whom shall be a member of the minority party.]
  3        Sec.  2. K.S.A. 1998 Supp. 46-2701 is hereby repealed.
  4        Sec.  3. This act shall take effect and be in force from and after its
  5       publication in the Kansas register.
