  9             AN  ACT concerning crimes, criminal procedure and punishment; relat-
10             ing to failure to report a crime.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) Any person, other than the victim, who knows or has
14       reason to know that an attempted unlawful sexual act or an unlawful
15       sexual act, as defined in K.S.A. 21-3301 and 21-3501 and amendments
16       thereto, or an attempted inherently dangerous felony or an inherently
17       dangerous felony, as defined in K.S.A. 21-3301 and 21-3436 and amend-
18       ments thereto, is taking place in which the victim is a child of less than
19       18 years of age shall immediately report such crime to any local or state
20       law enforcement agency.
21             (b) Any person participating in good faith in making such a report
22       shall have immunity from liability, civil or criminal, that might otherwise
23       be incurred or imposed.
24             (c) Any person who knowingly fails to report a crime as required by
25       this section shall be guilty of a class B misdemeanor.
26        Sec.  2. This act shall take effect and be in force from and after its
27       publication in the statute book.
