  9             AN  ACT concerning state agencies; relating to self-insurance assessment
10             rates; amending K.S.A. 44-576 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. K.S.A. 44-576 is hereby amended to read as follows: 44-
14       576. (a) For each payroll period, each state agency shall certify with each
15       payroll, the amount of each self-insurance assessment for such state
16       agency, not in conflict with appropriations therefor. The director of ac-
17       counts and reports shall transfer the amount of each self-insurance as-
18       sessment for such state agency to the credit of the state workers com-
19       pensation self-insurance fund.
20             (b) Each July 1, the secretary of administration shall determine an-
21       nually the rate of the self-insurance assessment for all state agencies a
22       self-insurance assessment rate for each state agency based upon the ac-
23       cidental injury and occupational disease experience of all state agencies
24       the state agency and the liability of the state workers compensation self-
25       insurance fund as provided in subsection (c) of K.S.A. 44-575, and amend-
26       ments thereto. Such rate shall be expressed as a percentage and shall be
27       the same for all state agencies. The secretary of administration shall utilize
28       actuarial and other professional assistance in determining the rate of the
29       self-insurance assessment rates under this section. On or before each July
30       15 30, the secretary of administration shall notify each state agency of the
31       rate of the such agency's projected self-insurance assessment rate for the
32       next fiscal year and such agency's actual self-insurance assessment rate
33       for the current fiscal year.
34             (c) The amount of the self-insurance assessment for each state agency
35       shall be determined by multiplying the total payroll for each payroll pe-
36       riod of such state agency, by the rate of the by such agency's self-insur-
37       ance rate assessment for the fiscal year. 
38       Sec.  2. K.S.A. 44-576 is hereby repealed.
39        Sec.  3. This act shall take effect and be in force from and after its
40       publication in the statute book.
