9 AN ACT concerning state officers and employees; relating to the state
10 cafeteria plan; establishing a short-term disability program; amending
11 K.S.A. 75-6512 and repealing the existing section.

13 Be it enacted by the Legislature of the State of Kansas:
14 New Section 1. Subject to provisions of appropriation acts, the sec-
15 retary of administration may establish and administer a short-term disa-
16 bility program for all state officers and employees. In accordance with
17 this section, the secretary of administration shall establish the provisions
18 and procedures of such program and shall inform all state officers and
19 employees of such provisions and procedures.
20 Sec. 2. K.S.A. 75-6512 is hereby amended to read as follows: 75-
21 6512. (a) Subject to the provisions of appropriations acts, the secretary of
22 administration is hereby authorized to may establish and administer a
23 cafeteria plan pursuant to the provisions of section 125 of the federal
24 internal revenue code of 1986 which. Such plan shall be available to per-
25 sons who are officers or employees of the state and who are qualified to
26 participate in the state health care benefits program and which. Such plan
27 shall include, but not be limited to, provisions under which such officers
28 and employees may agree to:
29 (1) Receive reduced compensation and (1);
30 (2) have the state's contribution under K.S.A. 75-6508, and amend-
31 ments thereto, cover costs of dependent benefit coverage or other ben-
32 efits under the state health care benefits program which would otherwise
33 be payable by such officers and employees, and (2);
34 (3) receive benefits under the state employee dependent care assis-
35 tance program under K.S.A. 75-6520, and amendments thereto; and
36 (4) receive any additional benefits established by the secretary under
37 section 125 of federal internal revenue code of 1986.
38 (b) Any reduction in compensation for any person pursuant to any
39 such cafeteria plan shall not reduce the compensation of such person for
40 purposes of the employment security law, workers compensation act or
41 the purposes of determining contributions and benefits under the Kansas
42 public employees retirement system or any retirement system adminis-
43 tered by the board of trustees of the Kansas public employees retirement

1 system.
2 (c) Implementation of any such cafeteria plan and any additions or
3 deletions thereto shall be subject to approval of the secretary of admin-
4 istration to assure adequate data processing resources therefor within the
5 division of information systems and communications of the department
6 of administration.
7 Sec. 3. K.S.A. 75-6512 is hereby repealed.
8 Sec. 4. This act shall take effect and be in force from and after its
9 publication in the statute book.
