10 AN ACT
concerning retirement; relating to the Kansas public employees
11 retirement system and
retirement systems relating thereto; affiliation;
12 membership; employee
and employer contributions; reduction in
po-
13 sitions in
state government upon retirement of members;
repealing

16 Be it enacted by the Legislature of the
State of Kansas:
17 Section
1. (a) (1) Notwithstanding the provisions of K.S.A.
74-4971
18 and amendments thereto, on or after the
effective date of this act, the
19 Kansas highway patrol may affiliate with
the Kansas police and firemen's
20 retirement system established under the
provisions of K.S.A. 74-4951 et
21 seq. and amendments thereto pursuant
to the provisions of this act for
22 membership in the system of the officers of
the capitol area security
23 patrol. For purposes of such affiliation
for membership in the system of
24 the officers of the capitol area security
patrol, the Kansas highway patrol
25 shall be considered a new participating
employer. The Kansas highway
26 patrol shall make application for
affiliation with such system in the man-
27 ner provided by K.S.A. 74-4954 and
amendments thereto, to be effective
28 on July 1 next following application. The
Kansas highway patrol shall
29 affiliate for membership in the system of
the officers of the capitol area
30 security patrol for prior service credit
for the period commencing on July
31 1, 1995, and ending on the day preceding
the effective date of this act
32 and participating service credit.
33 (2) The Kansas
highway patrol shall appropriate and pay a sum suf-
34 ficient to satisfy any obligations as
certified by the board of trustees of
35 the retirement system and the employer
contributions of the Kansas high-
36 way patrol shall be as provided in K.S.A.
74-4967 and amendments
37 thereto.
38 (b)
(1) Each officer of the capitol area security patrol employed
by
39 the Kansas highway patrol on the date of
affiliation, may become a mem-
40 ber of the Kansas police and firemen's
retirement system on the first day
41 of the payroll period of such member,
coinciding with or following the
42 entry date of the Kansas highway patrol as
provided in this section, only
43 by filing with the board of trustees of the
system, on or before the entry

1 date of the Kansas highway patrol as
provided in this section, a written
2 election to become a member of the
system. Failure to file such written
3 election shall be presumed to be an
election not to become a member of
4 the system. Such election, whether to
become or not to become a mem-
5 ber, shall be irrevocable.
6 (2) Each
officer of the capitol area security patrol who is on an au-
7 thorized leave of absence or is in
the military service on the entry date
8 of the Kansas highway patrol as
provided in this section may become a
9 member of the Kansas police and
firemen's retirement system on the first
10 day of the first payroll period of such
member, coinciding with such mem-
11 ber's return to active employment and
payroll of the Kansas highway
12 patrol, only by filing with the board of
trustees of the system within 10
13 days after such return to active employment
a written election to become
14 a member of the system. Failure to file
such written election shall be
15 presumed to be an election not to become a
member of the system. Such
16 election, whether to become a member or not
to become a member, shall
17 be irrevocable.
18 (c) Every person
who is employed as an officer of the capitol area
19 security patrol on or after the entry date
of the Kansas Highway patrol
20 into the Kansas police and firemen's
retirement system as provided in
21 this section shall become a member of the
Kansas police and firemen's
22 retirement system on the first day of such
employment.
23 (d) If the Kansas
highway patrol affiliates as provided in this act and
24 each officer of the capitol area security
patrol who elects to become a
25 member as provided in this act, the Kansas
highway patrol and each such
26 member shall be subject to the provisions
of K.S.A. 74-4951 et seq. and
27 amendments thereto as applicable.
28 (e) The division
of the budget and the governor shall include in the
29 budget and in the budget request for
appropriations for personnel serv-
30 ices the amount required to satisfy the
employer's obligation under this
31 act as certified by the board of trustees
of the system, and shall present
32 the same to the legislature for allowance
and appropriations.
33 Sec. 2. K.S.A.
1998 Supp. 75-6801 is hereby repealed.
34 Sec. 3.
[2.] This act shall take effect and be in force from
and after
35 its publication in the statute book.
