  9             A PROPOSITION to
amend section 2 of article 13 of the constitution of
10             the state of Kansas,
relating to banks.

14             Be it resolved by
the Legislature of the State of Kansas, two-thirds of the
15             members elected (or
appointed) and qualified to the House of Repre-
16             sentatives and
two-thirds of the members elected (or appointed) and
17             qualified to the
Senate concurring therein:

Section  1. The following proposition to amend the
constitution of the
19       state of Kansas shall be submitted to the
qualified electors of the state
20       for their approval or rejection: Section 2
of article 13 of the constitution
21       of the state of Kansas is hereby amended to
read as follows:
22             "§
 2. State not to be stockholder. The state shall not
be a stock-
23             holder in any banking
institution, except that any retirement or pension
24             plan authorized
pursuant to the laws of this state may be a stockholder
25             in any banking
institution."
26        Sec.  2. The following
statement shall be printed on the ballot with
27       the amendment as a whole:
28               "Explanatory
statement. The purpose of this amendment is to allow
29             any retirement or
pension plan authorized pursuant to the laws of this
30             state to be a
stockholder in any banking institution.
31              "A vote for this
amendment would allow any retirement or pension
32             plan authorized
pursuant to the laws of this state to be a stockholder
33             in any banking
institution.
34              "A vote against
this amendment favors retaining the current prohi-
35             bition against the
state and any retirement or pension plan authorized
36             pursuant to the laws
of this state from being a stockholder in any
37             banking
institution."
38             Sec. 
3. This resolution, if approved by two-thirds of the
members
39       elected (or appointed) and qualified to the
House of Representatives and
40       two-thirds of the members elected (or
appointed) and qualified to the
41       Senate, shall be entered on the journals,
together with the yeas and nays.
42       The secretary of state shall cause this
resolution to be published as pro-
43       vided by law and shall cause the proposed
amendment to be submitted
44       to the electors of the state at the general
election in the year 2000 unless
45       a special election is called at a sooner
date by concurrent resolution of

  1       the legislature, in which case it
shall be submitted to the electors of the
  2       state at the special election.
