PROPOSITION to amend article 15 of the constitution of the state
of
10 Kansas by adding a new
section thereto, authorizing the legislature to
11 regulate, license and
tax the operation of raffles by certain bona fide
12 nonprofit
organizations.

14 Be it resolved by the Legislature of the
State of Kansas, two-thirds of the
15 members elected (or
appointed) and qualified to the House of Repre-
16 sentatives and
two-thirds of the members elected (or appointed) and
17 qualified to the
Senate concurring therein:

Section 1. The following proposition to amend the
constitution of the
19 state of Kansas shall be submitted to the
qualified electors of the state
20 for their approval or rejection: Article 15
of the constitution of the state
21 of Kansas is amended by adding a new
section thereto to read as follows:
22 "§ 3d. Regulation of
raffles operated by certain organizations. Not-
23 withstanding the
provisions of section 3 of article 15 of the consti-
24 tution of the state of
Kansas, the legislature may regulate, license
25 and tax the
management, operation and conduct of raffles by bona
26 fide nonprofit
religious, charitable, fraternal, educational and vet-
27 erans' organizations.
The legislature, by law, shall define raffle. No
28 such nonprofit
organization shall contract with a professional raffle
29 or lottery vendor to
operate such a raffle."

Sec. 2. The following statement shall be printed on the
ballot with
31 the amendment as a whole:
32 "Explanatory
statement. The constitution currently prohibits the
33
operation of lotteries except for a state-owned and operated
lot-
34
tery. A raffle is a lottery and is illegal under current law.

"A vote for this proposition would permit the legislature to
regulate,
36
license and tax raffles managed, operated or conducted by bona
37
fide religious, charitable, fraternal, educational and
veterans'
38
nonprofit organizations. This proposition would provide that
the
39
legislature would define, by law, a raffle.

"A vote against this proposition would continue the current
prohi-
41
bition against such raffles."

Sec. 3. This resolution, if approved by two-thirds of
the members
43 elected (or appointed) and qualified to the
House of Representatives and

1 two-thirds of the members elected (or
appointed) and qualified to the
2 Senate, shall be entered on the
journals, together with the yeas and nays.
3 The secretary of state shall cause
this resolution to be published as pro-
4 vided by law and shall cause the
proposed amendment to be submitted
5 to the electors of the state at the
general election in the year 2000 unless
6 a special election is called at a
sooner date by concurrent resolution of
7 the legislature, in which case it
shall be submitted to the electors of the
8 state at such special election.
