10             AN  ACT concerning school districts; authorizing the collection of fees
11             for maintenance of kindergarten for full school days; imposing certain
12             limitations.

14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. (a) Subject to the limitations specified in this subsection,
16       the board of education of any school district that maintains kindergarten
17       classes for a full school day consisting of not less than six hours may
18       prescribe and collect fees to off-set the costs incurred by the district as a
19       result of and directly attributable to maintenance of such classes. Fees
20       for maintenance of kindergarten classes for a full school day may be col-
21       lected only to the extent that the costs attributable to maintenance of
22       such classes are in excess of the amount for maintenance of kindergarten
23       that is financed under the school district finance and quality performance
24       act. Fees for the maintenance of kindergarten classes for a full school day
25       may only be assessed against and collected for pupils who attend such
26       classes on a voluntary basis. No such fees may be assessed against or
27       collected for: (1) Pupils who are required to attend such classes in ac-
28       cordance with the provisions of law, rules and regulations of the state
29       board of education or policy of the board of education; or (2) pupils who
30       are exceptional children who are required to attend such classes in ac-
31       cordance with the provisions of an individualized education plan; or (3)
32       pupils who are eligible for free or reduced price meals under the national
33       school lunch act.
34             (b) Revenues from fees collected by a board of education under this
35       section shall be deposited in the general fund of the school district, shall
36       be considered reimbursements to the district for the purpose of the
37       school district finance and quality performance act, and may be expended
38       whether the same have been budgeted or not and amounts so expended
39       shall not be considered operating expenses.
40        Sec.  2. This act shall take effect and be in force from and after its
41       publication in the statute book.
