10             AN ACT making and concerning appropriations for the fiscal years ending
11             June 30, 1999, June 30, 2000, and June 30, 2001; authorizing certain
12             transfers and fees, imposing certain restrictions and limitations and
13             directing or authorizing certain receipts, disbursements, capital im-
14             provements and acts incidental to the foregoing; amending K.S.A. 1998
15             Supp. 79-2964, as amended by section 94 of 1999 Senate Bill No. 325,
16             and repealing the existing section.
17      
18       Be it enacted by the Legislature of the State of Kansas:
19        Section 1. (a) For the fiscal years ending June 30, 1999, June 30, 2000,
20       and June 30, 2001, appropriations are hereby made, restrictions and lim-
21       itations are hereby imposed, and transfers, fees, receipts, disbursements,
22       and acts incidental to the foregoing are hereby directed or authorized as
23       provided in this act.
24        (b) The agencies named in this act are hereby authorized to initiate
25       and complete the capital improvement projects specified and authorized
26       by this act or for which appropriations are made by this act, subject to
27       the restrictions and limitations imposed by this act.
28        (c) This act shall be known and may be cited as the omnibus appro-
29       priation act of 1999 and shall constitute the omnibus reconciliation spend-
30       ing limit bill for the 1999 regular session of the legislature for purposes
31       of subsection (a) of K.S.A. 75-6702 and amendments thereto.
32        (d) The appropriations made by this act shall not be subject to the
33       provisions of K.S.A. 46-155 and amendments thereto.
34        Sec. 2.
35      
DEPARTMENT OF SOCIAL AND REHABILITATION SERVICES
36        (a) There is appropriated for the above agency from the state general
37       fund for the fiscal year or years specified, the following:
38       [Community based services
39             [For the fiscal year ending June 30, 2000 $1,750,000]
40       Youth services aid and assistance
41             For the fiscal year ending June 30, 1999 $6,428,207
42             For the fiscal year ending June 30, 2000 $4,470,000
43       [Provided, That expenditures shall be made by the above agency

  1       from the youth services aid and assistance account for a contract
  2       for the provision of state-wide legal services under the perma-
  3       nency in child time (PICT): Provided further, That expenditures for
  4       the provision of state-wide legal services under the permanency in
  5       child time (PICT) program shall be made by the above agency from
  6       the youth services aid and assistance account in the amount of at
  7       least $200,000.]

17        (b) On the effective date of this act, of the $1,849,723 appropriated for
18       the above agency for the fiscal year ending June 30, 1999, by section
19       116(a) of 1999 Senate Bill No. 325 from the state general fund in the
20       mental health and retardation services aid and assistance and state insti-
21       tutions operations account, the sum of $454,938 is hereby lapsed.
22        (c) On the effective date of this act, of the $49,982,374 appropriated
23       for the above agency for the fiscal year ending June 30, 1999, by section
24       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
25       general fund in the cash assistance account, the sum of $190,000 is hereby
26       lapsed.
27        (d) On July 1, 1999, of the $53,328,276 appropriated for the above
28       agency for the fiscal year ending June 30, 2000, by section 55(a) of 1999
29       Senate Bill No. 325 from the state general fund in the cash assistance
30       account, the sum of $190,000 is hereby lapsed.
31        (e) In addition to the other purposes for which expenditures may be
32       made by the above agency from the children's health care programs fund
33       for fiscal year 2000, expenditures may be made by the above agency from
34       the children's health care programs fund for fiscal year 2000 for the fol-
35       lowing specified purposes subject to the expenditure limitations pre-
36       scribed therefor:
37       Children's health care programs fund--home and community based services for mental retardation $2,000,000
38       Provided, That all expenditures by the above agency from the children's
39       health care programs fund for fiscal year 2000 from the children's health
40       care programs fund--home and community based services for mental
41       retardation account shall be in addition to any expenditure limitation im-
42       posed on the children's health care programs fund for fiscal year 2000[:

  1       Provided further, That expenditures from this account shall be made
  2       to serve persons known to have applied for and been determined
  3       to need community developmental disability services: And provided
  4       further, That such expenditures shall be managed so as to serve as
  5       many persons as possible: And provided further, That such expend-
  6       itures shall not exceed this amount when serving persons for a full
  7       fiscal year].
8       Children's health care programs fund--home and community based services for physically disabled $1,750,000
  9       Provided, That all expenditures by the above agency from the children's
10       health care programs fund for fiscal year 2000 from the children's health
11       care programs fund--home and community based services for physically
12       disabled account shall be in addition to any expenditure limitation im-
13       posed on the children's health care programs fund for fiscal year 2000.
14        (f) On July 1, 1999, of the $89,635,746 appropriated for the above
15       agency for the fiscal year ending June 30, 2000, by section 55(a) of 1999
16       Senate Bill No. 325 from the state general fund in the state operations
17       account, the sum of $72,832 [$38,701] is hereby lapsed.
18        (g) On July 1, 1999, the position limitation established by section 90(a)
19       of 1999 Senate Bill No. 325 for the department of social and rehabilitation
20       services is hereby decreased from 4,176.0 to 4,170.5.
21        (h) On the effective date of this act, the amounts specified in section
22       120(c) of chapter 203 of the 1998 Session Laws of Kansas as being in-
23       cluded in the mental health and retardation services aid and assistance
24       and state institutions operations account of the state general fund for the
25       following institutions are hereby changed to the amounts specified, but
26       expenditures from the mental health and retardation services aid and
27       assistance and state institutions operations account of the state general
28       fund for any such institution shall not be limited to, or be required to be
29       made in, the amount listed for the institution, as follows: (1) The amount
30       for Kansas neurological institute is hereby decreased from $10,198,356
31       to $10,192,251; (2) the amount for Larned state hospital is hereby de-
32       creased from $8,677,519 to $7,823,934; (3) the amount for Osawatomie
33       state hospital is hereby decreased from $3,693,609 to $2,593,609; (4) the
34       amount for Parsons state hospital and training center is hereby increased
35       from $8,683,907 to $8,686,419; and (5) the amount for Rainbow mental
36       health facility is hereby decreased from $2,391,500 to $2,177,740.
37        (i) On the effective date of this act, the expenditure limitation estab-
38       lished by section 116(o) of 1999 Senate Bill No. 325 on the Larned state
39       hospital fee fund is hereby increased from $2,769,829 to $3,619,829.
40        (j) On the effective date of this act, the expenditure limitation estab-
41       lished by section 116(p) of 1999 Senate Bill No. 325 on the Osawatomie
42       state hospital fee fund is hereby increased from $3,152,948 to $4,252,948.

  1        (k) On the effective date of this act, the expenditure limitation estab-
  2       lished by section 116(r) of 1999 Senate Bill No. 325 on the Rainbow
  3       mental health facility fee fund is hereby increased from $1,036,361 to
  4       $1,236,361.
  5        (l) On July 1, 1999, the amounts specified in section 55(c) of 1999
  6       Senate Bill No. 325 as being included in the mental health and retardation
  7       services aid and assistance and state institutions operations account of the
  8       state general fund for the following institutions are hereby changed to
  9       the amounts specified, but expenditures from the mental health and re-
10       tardation services aid and assistance and state institutions operations ac-
11       count of the state general fund for any such institution shall not be limited
12       to, or be required to be made in, the amount listed for the institution, as
13       follows: (1) The amount for Kansas neurological institute is hereby de-
14       creased from $7,931,823 to $7,871,989; (2) the amount for Larned state
15       hospital is hereby decreased from $11,768,273 to $11,737,209; (3) the
16       amount for Osawatomie state hospital is hereby decreased from
17       $5,988,178 to $5,971,632; (4) the amount for Parsons state hospital and
18       training center is hereby decreased from $5,943,156 to $5,930,007; and
19       (5) the amount for Rainbow mental health facility is hereby decreased
20       from $1,583,476 to $1,547,515.
21        (m) On July 1, 1999, the position limitations established by section
22       90(a) of 1999 Senate Bill No. 325 for the following agencies are hereby
23       increased or decreased, as specified, to the position limitations specified
24       for such agencies: (1) The position limitation for Larned state hospital is
25       hereby decreased from 767.6 to 766.6; (2) the position limitation for Os-
26       awatomie state hospital is hereby decreased from 483.4 to 482.4; (3) the
27       position limitation for Parsons state hospital and training center is hereby
28       decreased from 522.0 to 521.0; and (4) the position limitation for Rainbow
29       mental health facility is hereby decreased from 137.4 to 136.4.
30        (n) In addition to the other purposes for which expenditures may be
31       made by the department of social and rehabilitation services from any
32       moneys appropriated from the state general fund or any special revenue
33       fund for the fiscal year ending June 30, 2000, as authorized by this or
34       other appropriation act of the 1999 regular session of the legislature,
35       expenditures shall be made by the department of social and rehabilitation
36       services from any such moneys appropriated for fiscal year 2000 for the
37       receipt, crediting and disbursement of moneys received by the depart-
38       ment of social and rehabilitation services for payments of support pur-
39       suant to a rule or administrative order issued by the Kansas supreme
40       court, which is hereby authorized to be issued by the Kansas supreme
41       court, directing payments of support, which are made pursuant to any
42       court order entered in this state regardless of the date of the order, to be
43       made to a central unit for the collection and disbursement of support

  1       payments, notwithstanding the provisions of any statute to the contrary.
  2        (o) In addition to the other purposes for which expenditures may be
  3       made by the department of social and rehabilitation services from the
  4       state operations account of the state general fund for the fiscal year ending
  5       June 30, 2000, as authorized by section 55(a) of 1999 Senate Bill No. 325
  6       or by this or other appropriation act of the 1999 regular session of the
  7       legislature, expenditures shall be made by the department of social and
  8       rehabilitation services from the state operations account of the state gen-
  9       eral fund for fiscal year 2000 to conduct a review of, and to adopt appro-
10       priate amendments to, the rules and regulations and the administrative
11       policies of the department of social and rehabilitation services for the
12       purposes of clarifying the definitions of children in need of care, especially
13       in the areas relating to protective custody: Provided, That the secretary
14       of social and rehabilitation services shall submit a report to the legislature
15       by January 10, 2000, setting forth the results of such study and the amend-
16       ments adopted to the rules and regulations and the administrative policies
17       of the department of social and rehabilitation service with respect thereto.
18        (p) In addition to the other purposes for which expenditures may be
19       made by the department of social and rehabilitation services from the
20       state operations account of the state general fund for the fiscal year ending
21       June 30, 2000, as authorized by section 55(a) of 1999 Senate Bill No. 325
22       or by this or other appropriation act of the 1999 regular session of the
23       legislature, expenditures shall be made by the department of social and
24       rehabilitation services from the state operations account of the state gen-
25       eral fund for fiscal year 2000 to conduct a study reviewing the current
26       practices of individuals applying for medicaid medical assistance and all
27       current practices and related administrative policies of the department of
28       social and rehabilitation services regarding applications for medical assis-
29       tance, specifically including the incidence and use of trusts to misrepre-
30       sent an individual's net worth when applying for medicaid medical assis-
31       tance: Provided, That such study shall be conducted in cooperation with
32       the study of these matters by the judicial council: Provided further, That
33       the secretary of social and rehabilitation services shall submit a report to
34       the legislature by January 10, 2000, setting forth the results of such study
35       and any recommendations that the secretary has developed from such
36       study.
37        (q) During the fiscal year ending June 30, 2000, the secretary of social
38       and rehabilitation services, with the approval of the director of the budget,
39       may transfer any part of any item of appropriation for the fiscal year
40       ending June 30, 2000, from the state general fund for the department of
41       social and rehabilitation services to a new account of the state general
42       fund, which is hereby established and which shall be the nursing facilities
43       quality enhancement wage pass-through pursuant to 1999 Senate Bill No.

  1       126 account for fiscal year 2000 from the state general fund for the de-
  2       partment of social and rehabilitation services: Provided, That the secre-
  3       tary of social and rehabilitation services shall certify each such transfer to
  4       the director of accounts and reports and shall transmit a copy of each
  5       such certification to the legislative research department: Provided, how-
  6       ever, That all expenditures from the nursing facilities quality enhance-
  7       ment wage pass-through pursuant to 1999 Senate Bill No. 126 account
  8       shall be made pursuant to an application and selection process for prior-
  9       itization which is hereby authorized and directed to be prescribed in
10       policies adopted by the secretary of aging and, with respect to expendi-
11       tures from the nursing facilities quality enhancement wage pass-through
12       pursuant to 1999 Senate Bill No. 126 account by the department of social
13       and rehabilitation services, which shall be administered by the depart-
14       ment of social and rehabilitation services in accordance with the policies
15       adopted by the secretary of aging.
16        [(r) On July 1, 2000, the director of accounts and reports shall
17       transfer any unencumbered balance in the children's health care
18       programs fund--home and community based services for mental
19       retardation account of the children's health care programs fund
20       to the critical emergency services for CDDOS fund.
21        [(s) There is appropriated for the above agency from the follow-
22       ing special revenue fund or funds for the fiscal year or years spec-
23       ified, all moneys now or hereafter lawfully credited to and avail-
24       able in such fund or funds, except that expenditures other than
25       refunds authorized by law shall not exceed the following:

28        Sec. 3.
29      
DEPARTMENT ON AGING
30        (a) There is appropriated for the above agency from the state general
31       fund for the fiscal year or years specified, the following:
32       Administration
33             For the fiscal year ending June 30, 2000 $392,000 [$423,250]
34       Long term care
35             For the fiscal year ending June 30, 1999 $200,000
36             For the fiscal year ending June 30, 2000 $840,000
37       [Nursing facilities quality enhancement wage pass-through pur-
38       suant to 1999 Senate Bill No. 126
39       [For the fiscal year ending June 30, 2000 $1,725,000]
40        (b) On or before July 15, 1999, and on the 15th day of each month
41       thereafter during the fiscal year ending June 30, 2000, the secretary of
42       aging shall certify to the director of the budget the total amount of moneys
43       which were received by the department on aging during the preceding

  1       month from the federal government and which were deposited in the
  2       state treasury to the credit of the medicaid fund--federal. During the
  3       fiscal year ending June 30, 2000, after receiving one or more certifications
  4       from the secretary of aging under this subsection, the director of the
  5       budget may certify an amount or amounts to the director of accounts and
  6       reports to be transferred from the medicaid fund--federal of the de-
  7       partment on aging to the state general fund for the purpose of reim-
  8       bursing the state general fund for the amount appropriated for the de-
  9       partment on aging from the state general fund in the administration
10       account. Upon receiving each such certification from the director of the
11       budget, the director of accounts and reports shall transfer the amount or
12       amounts certified from the medicaid fund--federal of the department on
13       aging to the state general fund on the dates specified by the director of
14       the budget.
15        (c) On July 1, 1999, the position limitation established by section 90(a)
16       of 1999 Senate Bill No. 325 for the department on aging is hereby in-
17       creased from 155.8 to 157.8.
18        (d) During the fiscal year ending June 30, 2000, the secretary of aging,
19       with the approval of the director of the budget, may transfer any part of
20       any item of appropriation for the fiscal year ending June 30, 2000, which
21       is appropriated from the state general fund for the department on aging
22       by section 54(a) of 1999 Senate Bill No. 325, or by this or other appro-
23       priation act of the 1999 regular session of the legislature, to a new account
24       of the state general fund, which is hereby established and which shall be
25       the nursing facilities quality enhancement wage pass-through pursuant to
26       1999 Senate Bill No. 126 account for fiscal year 2000 from the state
27       general fund for the department on aging: Provided, That the secretary
28       of aging shall certify each such transfer to the director of accounts and
29       reports and shall transmit a copy of each such certification to the legis-
30       lative research department: Provided, however, That all expenditures
31       from the nursing facilities quality enhancement wage pass- through pur-
32       suant to 1999 Senate Bill No. 126 account shall made to pursuant to an
33       application and selection process for prioritization which is hereby au-
34       thorized and directed to be prescribed in policies adopted by the secretary
35       of aging and, with respect to expenditures from the nursing facilities qual-
36       ity enhancement wage pass-through pursuant to 1999 Senate Bill No. 126
37       account by the department on aging, which shall be administered by the
38       department on aging in accordance with the policies adopted by the sec-
39       retary of aging.
40        Sec. 4.
41      
DEPARTMENT OF TRANSPORTATION
42        (a) On the effective date of this act, the expenditure limitation estab-
43       lished by section 136(a) of 1999 Senate Bill No. 325 on the agency op-

  1       erations account of the state highway fund is hereby decreased from
  2       $198,435,474 to $198,348,984.
  3        (b) On July 1, 1999, the position limitation established by section 90(a)
  4       of 1999 Senate Bill No. 325 for the department of transportation is hereby
  5       decreased from 3,118.5 to 3,111.5.
  6        (c) On July 1, 1999, the expenditure limitation established by section
  7       89(b) of 1999 Senate Bill No. 325 on the agency operations account of
  8       the state highway fund is hereby decreased from $205,226,194 to
  9       $204,930,379.
10        (d) In addition to the other purposes for which expenditures may be
11       made by the department of transportation from the state highway fund
12       or from any other special revenue fund for the fiscal year ending June
13       30, 2000, as authorized by section 89 of 1999 Senate Bill No. 325 or by
14       this or other appropriation act of the 1999 regular session of the legisla-
15       ture, expenditures shall be made by the department of transportation
16       from the state highway fund or from any other special revenue fund for
17       fiscal year 2000 to conduct a study to be conducted by personnel of the
18       department of transportation or by a qualified consultant pursuant to a
19       contract entered into therefor, which shall review and study the flooding
20       history and state highway construction history in the flood plain vicinity
21       of the junction of U.S. highway 54 and U.S. highway 69 northeast of Fort
22       Scott, Kansas: Provided, That such study shall include study of bridge
23       number 5 on U.S. highway 69 in Bourbon county in conjunction with the
24       surrounding flood plain: Provided further, That such study shall include
25       a study of the relationship of flooding to existing highway embankments
26       and, in consultation with the chief engineer of the division of water re-
27       sources of the Kansas department of agriculture regarding current flood
28       control and other surface water standards of the division of water re-
29       sources of the Kansas department of agriculture, the development of pro-
30       posals for lessening flood severity in the area: And provided further, That
31       the secretary of transportation shall submit a report to the legislature by
32       January 10, 2000, setting forth the results of such study and any recom-
33       mendations or proposals that have been developed from such study.
34        (e) In addition to the other purposes for which expenditures may be
35       made by the department of transportation from the state highway fund
36       or from any other special revenue fund for the fiscal year ending June
37       30, 2000, as authorized by section 89 of 1999 Senate Bill No. 325 or by
38       this or other appropriation act of the 1999 regular session of the legisla-
39       ture, expenditures shall be made by the department of transportation
40       from the state highway fund or from any other special revenue fund for
41       fiscal year 2000 to conduct a study to be conducted by personnel of the
42       department of transportation or by a qualified consultant pursuant to a
43       contract entered into therefor, which shall review and study the accident

  1       history of the new section of K-96 from northwest of Maize, Kansas, to
  2       south of Hutchinson, Kansas: Provided, That such study shall include the
  3       development of proposals for any changes or modifications to such new
  4       section of K-96 which may address the accident history or otherwise pro-
  5       vide improvements which are intended to reduce the incidence of high-
  6       way accidents on such new section of K-96: Provided further, That the
  7       secretary of transportation shall submit a report to the legislature by Jan-
  8       uary 10, 2000, setting forth the results of such study and any recommen-
  9       dations or proposals that have been developed from such study.
10             [(f) In addition to the other purposes for which expenditures
11       may be made by the department of transportation from the state
12       highway fund for the fiscal years ending June 30, 2000, or June
13       30, 2001, as authorized by section 89 of 1999 Senate Bill No. 325
14       or by this or other appropriation act of the 1999 regular session of
15       the legislature, expenditures shall be made by the department of
16       transportation from the state highway fund for fiscal year 2000 or
17       fiscal year 2001 for the purpose of paying all expenses associated
18       with the authorizing and issuing of bonds authorized by 1999
19       House Bill No. 2071: Provided, That, all contracts for the issuance
20       and sale of such bonds including contracts with financial advisors,
21       attorneys and such other professional services related to the issu-
22       ance and sale of such bonds shall be entered into pursuant to com-
23       petitive bids.]
24        Sec. 5.
25      
KANSAS LOTTERY
26        (a) The director of accounts and reports shall not make any transfers
27       from the lottery operating fund of the Kansas lottery to the state general
28       fund that are prescribed to be made by section 45(e) of 1999 Senate Bill
29       No. 325 and the executive director shall not make any of the calculations,
30       determinations and certifications that are prescribed to be made by sec-
31       tion 45(e) of 1999 Senate Bill No. 325: Provided, That, in lieu thereof,
32       the director of accounts and reports shall make the transfers from the
33       lottery operating fund of the Kansas lottery to the state general fund that
34       are prescribed to be made by subsection (b) of this section and the ex-
35       ecutive director of the Kansas lottery shall perform the calculations, de-
36       terminations and certifications prescribed by subsection (b) of this sec-
37       tion.
38        (b) On June 15, 2000, the executive director of the Kansas lottery shall
39       determine whether the total of all transfers during the fiscal year ending
40       June 30, 2000, from the lottery operating fund to the state gaming rev-
41       enues fund as of June 15, 2000, equals $59,400,000 or more: Provided,
42       That, if the total amount of such transfers is less than $59,400,000 as of
43       June 15, 2000, then the executive director of the Kansas lottery shall

  1       compute the difference between the projected total amount of such trans-
  2       fers during fiscal year 2000 and the actual total of the transfers as of June
  3       15, 2000, and, on June 15, 2000, the executive director of the Kansas
  4       lottery shall certify to the director of accounts and reports the amount
  5       equal to the difference between projected and actual total transfers so
  6       computed: Provided further, That, on or after receiving such certification
  7       and not later than June 20, 2000, the director of accounts and reports
  8       shall transfer the amount certified from the lottery operating fund to the
  9       state general fund for the purpose of enhancing revenues and providing
10       additional moneys for the state general fund if lottery sales fall below a
11       projected total of $198,000,000 during the fiscal year 2000 period for
12       determination of lottery sales and the total of the actual transfers to the
13       state gaming revenues fund do not equal or exceed the projected total of
14       $59,400,000 during fiscal year 2000 by June 15, 2000: Provided, however,
15       That, notwithstanding the amount certified by the executive director of
16       the Kansas lottery to the director of accounts and reports pursuant to this
17       subsection, the amount transferred from the lottery operating fund to the
18       state general fund shall not exceed $732,560.
19        Sec. 6.
20      
KANSAS PUBLIC EMPLOYEES RETIREMENT SYSTEM
21        (a) On the effective date of this act, the expenditure limitation estab-
22       lished by section 137(a) of 1999 Senate Bill No. 325 on expenditures from
23       the Kansas public employees retirement fund for the technology project
24       is hereby decreased from $2,250,000 to $398,745.
25        (b) On July 1, 1999, the expenditure limitation established by section
26       5(e) of chapter 202 of the 1998 Session Laws of Kansas on expenditures
27       from the Kansas public employees retirement fund for the technology
28       project is hereby increased from $600,000 to $2,451,255.
29        (c) There is appropriated for the above agency from the following spe-
30       cial revenue fund or funds for the fiscal year or years specified, all moneys
31       now or hereafter lawfully credited to and available in such fund or funds,
32       except that expenditures other than refunds authorized by law shall not
33       exceed the following:
34       Group insurance reserve fund
35             For the fiscal year ending June 30, 2000 No limit
36       Optional death benefit plan reserve fund
37             For the fiscal year ending June 30, 2000 No limit
38        (d) On July 1, 1999, or as soon as moneys are available therefor, the
39       director of accounts and reports shall transfer $15,000,000 from the group
40       insurance reserve fund of the above agency to the Kansas public employ-
41       ees retirement fund for the purpose of paying a one-time additional re-
42       tirement benefit payment: Provided, That, based on information reported
43       by the actuary of the board of trustees of the Kansas public employees

  1       retirement system and by the executive secretary of the board of trustees,
  2       a portion of the $51,100,000 identified by the actuary as excess funding
  3       in the group insurance reserve fund on June 30, 1998, may be transferred
  4       from the group insurance reserve fund to the Kansas public employees
  5       retirement fund to be used as assets of such fund: Provided, however,
  6       That, of the $51,100,000 that was identified by the actuary as excess fund-
  7       ing, the amount that could be transferred from the group insurance re-
  8       serve fund to the Kansas public employees retirement fund, in the opinion
  9       of the actuary and the executive secretary, should not exceed $23,000,000:
10       Provided further, That, of such excess reserve amount of $23,000,000
11       identified by the actuary, it is hereby declared that it is appropriate that
12       $15,000,000 shall be transferred in fiscal year 2000 from the group in-
13       surance reserve fund to the Kansas public employees retirement fund to
14       be used as assets of such fund in accordance with this act.
15        (e) On July 1, 1999, or as soon as moneys are available, the board of
16       trustees of the Kansas public employees retirement system shall credit
17       $8,000,000 from the excess reserve within the group insurance reserve
18       fund to the group insurance reserve fund for the purpose of using excess
19       contributions in the death and disability benefits program during the fiscal
20       year ending June 30, 1998, to replace $8,000,000 of moneys from the
21       state general fund that shall not be available in fiscal year 2000 from the
22       department of education's KPERS--employer contributions account of
23       the state general fund: Provided, That, based on information reported by
24       the actuary employed of the board of trustees of the Kansas public em-
25       ployees retirement system and by the executive secretary of the board of
26       trustees, a portion of the $51,100,000 identified by the actuary as excess
27       funding in the group insurance reserve fund on June 30, 1998, may be
28       transferred from the group insurance reserve fund to the Kansas public
29       employees retirement fund to be used as assets of such fund: Provided,
30       however, That, of the $51,100,000 that was identified by the actuary as
31       excess funding, the amount that could be transferred from the group
32       insurance reserve fund to the Kansas public employees retirement fund,
33       in the opinion of the actuary and the executive secretary, should not
34       exceed $23,000,000: Provided further, That, of such excess reserve
35       amount of $23,000,000 identified by the actuary, it is hereby declared
36       that it is appropriate that $8,000,000 shall be credited in fiscal year 2000
37       from the excess reserve within the group insurance reserve fund to the
38       group insurance reserve fund to be used in lieu of moneys from the state
39       general fund.
40        (f) In addition to the other purposes for which expenditures may be
41       made by the above agency from the Kansas public employees retirement
42       fund for the fiscal year ending June 30, 2000, as authorized by this or
43       other appropriation act of the 1999 regular session of the legislature,

  1       expenditures may be made by the above agency from the Kansas public
  2       employees retirement fund for fiscal year 2000 for the following specified

  6       care programs fund--project success/wraparound Kansas account shall
  7       be in addition to any expenditure limitation imposed on the children's
  8       health care programs fund for fiscal year 2000: Provided further, That all
  9       expenditures from this account shall be for grants awarded by the state
10       board of education to school districts applying therefor to implement
11       mental health support services in the school setting that focus on violence
12       prevention: And provided further, That, in order to be eligible for a grant
13       from this account, a school district must show evidence of a collaborative
14       effort with a local community mental health center and a local commu-
15       nities in schools program.
16        (c) On July 1, 1999, of the 1,763,838,086 appropriated for the above
17       agency for the fiscal year ending June 30, 2000, by section 57(a) of 1999
18       Senate Bill No. 325 from the state general fund in the general state aid
19       account, the sum of $8,933,000 is hereby lapsed.
20        (d) On July 1, 1999, of the $76,890,000 appropriated for the above
21       agency for the fiscal year ending June 30, 2000, by section 57(a) of 1999
22       Senate Bill No. 325 from the state general fund in the supplemental
23       general state aid account, the sum of $321,000 is hereby lapsed.
24        (e) On July 1, 1999, of the $91,696,756 appropriated for the above
25       agency for the fiscal year ending June 30, 2000, by section 57(a) of 1999
26       Senate Bill No. 325 from the state general fund in the KPERS--employer
27       contributions account, the sum of $8,240,435 is hereby lapsed.
28        (f) On July 1, 1999, the expenditure limitation established by section
29       57(a) of 1999 Senate Bill No. 325 on the expenditures from the reappro-
30       priated balance in the KPERS--employer contributions account is hereby
31       increased from $733,969 to $1,233,969.
32        (g) On July 1, 1999, the matching requirement imposed on school dis-
33       tricts by section 57(a) of 1999 Senate Bill No. 325 for purposes of match-
34       ing grants from the state general fund for the parent education program
35       is hereby increased from an amount which is equal to not less than 50%
36       of the grant to an amount that is equal to not less than 75% of the grant.
37        (h) All expenditures from the children's health care programs fund--
38       parent education program account of the children's health care programs
39       fund for the fiscal year ending June 30, 2000, as prescribed in section
40       57(g) of 1999 Senate Bill No. 325, shall be matched by the school district
41       receiving the grant in an amount which is equal to not less than 75% of
42       the grant.

  1        (i) On July 1, 1999, the limitation imposed by section 57(a) of 1999
  2       Senate Bill No. 325 on the amount of moneys in the unencumbered
  3       balance in the general state aid account of the state general fund that, in
  4       excess of which, an amount of not to exceed $2,000,000 shall be trans-
  5       ferred to the inservice education aid account of the state general fund of
  6       the department of education to be used to fund approved inservice ed-
  7       ucation programs as authorized by K.S.A. 72-9601 et seq., and amend-
  8       ments thereto, is hereby increased from $29,750,914 to $37,795,914.
  9        (j) Expenditures made by the department of education from the school
10       district capital improvements fund as provided for in section 57(b) of 1999
11       Senate Bill No. 325 shall only be made for the payment of general obli-
12       gation bonds approved by the voters under the authority of K.S.A. 72-
13       6761 and amendments thereto.
14        Sec. 8.

STATE BOARD OF INDIGENTS' DEFENSE SERVICES
16        (a) There is appropriated for the above agency from the state general
17       fund for the fiscal year or years specified, the following:

20        (b) In addition to the other purposes for which expenditures may be
21       made by the state board of indigents' defense services from the indigents'
22       defense services fund for the fiscal year ending June 30, 2000, as author-
23       ized by section 35(b) of 1999 Senate Bill No. 325, expenditures may be
24       made by the state board of indigents' defense services for fiscal year 2000
25       from the indigents' defense services fund for fiscal year 2000, for salaries
26       and wages of attorneys who are officers or employees of the state board
27       of indigents' defense services.
28        Sec. 9.
29      
JUDICIAL BRANCH
30        (a) There is appropriated for the above agency from the state general
31       fund for the fiscal year or years specified, the following:
32       Operating expenditures
33             For the fiscal year ending June 30, 2000 $522,936
34       Foster care legal services grant
35             For the fiscal year ending June 30, 2000 $200,000
36       Provided, That all expenditures from the foster care legal services grant
37       account shall be for a grant to Kansas legal services, inc., for statewide
38       foster care legal services, including guardian ad litem and other legal
39       representation services, to be provided in accordance with a grant agree-
40       ment administered by the judicial administrator which is hereby author-
41       ized to be entered into by the judicial administrator: Provided further,
42       That such grant agreement shall provide for regular reporting to the ju-
43       dicial administrator of the legal services provided under such grant and

  1       which shall provide that the activities of the grantee and the provision of
  2       such legal services under the grant agreement shall be subject to audit
  3       under the legislative post audit act: Provided, however, That expenditures
  4       for such statewide foster care legal services grant under a grant agreement
  5       with Kansas legal services, inc., shall be made only upon certification by
  6       the judicial administrator to the director of accounts and reports that
  7       private moneys are available to match the expenditure of state moneys
  8       on the basis of $1 of nonstate moneys from Kansas legal services, inc., to
  9       $4 of state moneys from this account.
10        (b) Notwithstanding the provisions of section 36(a) of 1999 Senate Bill
11       No. 325, no expenditures shall be made by the above agency from the
12       judiciary operations account of the state general fund for any additional
13       amounts of compensation, in the discretion of the supreme court, for an
14       additional amount or amounts of compensation for fiscal year 2000 for
15       any justice of the supreme court, any judge of the court of appeals, any
16       district judge or any district magistrate judge in accordance with or pur-
17       suant to the provisions of the provisos to the judiciary operations account
18       of the state general fund in section 36(a) of 1999 Senate Bill No. 325:
19       Provided, That expenditures shall be made by the above agency from the
20       judiciary operations account of the state general fund in accordance with
21       this section for an additional annual amount of compensation of $1,609
22       for each justice of the supreme court, each judge of the court of appeals
23       and for each district judge for fiscal year 2000: Provided further, That
24       such expenditures from the judiciary operations account for such addi-
25       tional amount of compensation for each such justice of the supreme court,
26       judge of the court of appeals and district judge shall be made each payroll
27       period chargeable to fiscal year 2000 in substantially equal amounts, ad-
28       justed to the nearest $.01, in the same manner and at the same times that
29       compensation is payable to such justice in accordance with K.S.A. 75-
30       3120f and amendments thereto, to such judge of the court of appeals in
31       accordance with K.S.A. 75-3120h and amendments thereto, and to such
32       district judge in accordance with K.S.A. 75-3120g and amendments
33       thereto: And provided further, That such additional annual amount of
34       compensation shall be deemed to be part of the annual salary of each
35       judge of the court of appeals or district judge for all purposes of the annual
36       salary for any other public officer whose compensation is fixed in accord-
37       ance with or with reference to the annual salary of any judge of the court
38       of appeals or district judge: And provided further, That expenditures shall
39       be made from the judiciary operations account for an additional annual
40       amount of compensation of $805 for each district magistrate judge for
41       fiscal year 2000: And provided further, That expenditures shall be made
42       by the above agency from the judiciary operations account of the state
43       general fund in accordance with this section for such additional amount

  1       of compensation for each such district magistrate judge shall be made
  2       each payroll period chargeable to fiscal year 2000 in substantially equal
  3       amounts, adjusted to the nearest $.01, in the same manner and at the
  4       same times that compensation is payable to such district magistrate judge
  5       in accordance with K.S.A. 75-3120k and amendments thereto: And pro-
  6       vided further, That all of the provisos to the judiciary operations account
  7       of the state general fund in section 36(a) of 1999 Senate Bill No. 325
  8       relating to providing for expenditures from the judiciary operations ac-
  9       count of the state general fund for additional amounts of compensation,
10       in the discretion of the supreme court, for fiscal year 2000 for any justice
11       of the supreme court, any judge of the court of appeals, any district judge
12       or any district magistrate judge, shall be and are hereby declared to be
13       null and void and of no force or effect.
14        Sec. 10.
15      
JUDICIAL COUNCIL
16        (a) In addition to the other purposes for which expenditures may be
17       made by the judicial council from the operating expenditures account of
18       the state general fund or from any special revenue fund for the fiscal year
19       ending June 30, 2000, as authorized by section 34(a) of 1999 Senate Bill
20       No. 325 or by this or other appropriation act of the 1999 regular session
21       of the legislature, expenditures shall be made by the judicial council from
22       the operating expenditures account of the state general fund or from any
23       special revenue fund for fiscal year 2000 for an advisory committee of the
24       judicial council to conduct a study, in cooperation with the department
25       of social and rehabilitation services, of all laws and rules and regulations
26       that are applicable to the use of trusts by individuals to misrepresent the
27       individual's net worth when applying for medicaid medical assistance
28       from the department of social and rehabilitation services: Provided, That
29       such study shall be conducted in cooperation with the review of these
30       matters by the department of social and rehabilitation services: Provided
31       further, That the judicial council shall submit a report to the legislature
32       by January 10, 2000, setting forth the results of such study and any rec-
33       ommendations that have been developed from such study.
34        Sec. 11.

ATTORNEY GENERAL
36        (a) There is appropriated for the above agency from the state general
37       fund for the fiscal year or years specified, the following:

  6       $30,689,343.
  7        (b) On July 1, 1999, of the $31,051,780 appropriated for the above
  8       agency for the fiscal year ending June 30, 2000, by section 44(a) of 1999
  9       Senate Bill No. 325 from the state general fund in the operating expend-
10       itures account, the sum of $16,855 is hereby lapsed.
11        (c) On July 1, 1999, the position limitation established by section 90(a)
12       of 1999 Senate Bill No. 325 for the department of revenue is hereby
13       decreased from 1,182.5 to 1,181.5.
14        (d) On July 1, 1999, the expenditure limitation established by section
15       44(b) of 1999 Senate Bill No. 325 on the division of vehicles operating
16       fund is hereby increased from $36,100,246 to $36,291,988.
17        (e) On July 1, 1999, the expenditure limitation established by section
18       44(b) of 1999 Senate Bill No. 325 on the salaries and wages account of
19       the division of vehicles operating fund is hereby decreased from
20       $18,955,496 to $17,196,532.
21        (f) There is appropriated for the above agency from the state general
22       fund for the fiscal year or years specified, the following:
23       Train and grain rebate program
24             For the fiscal year ending June 30, 2000 $926,000
25       Provided, That expenditures from the train and grain rebate account of
26       the state general fund shall be made to reimburse state sales and use taxes
27       paid on all sales of materials and services purchased for the original con-
28       struction, reconstruction, repair or replacement of grain storage facilities,
29       including railroad sidings providing access thereto, and all sales of ma-
30       terials and services purchased by any class II or III railroad as classified
31       by the federal surface transportation board for the construction, renova-
32       tion, repair or replacement of class II or III railroad track and facilities
33       used directly in interstate commerce, all in accordance with administra-
34       tive policies and procedures adopted by the secretary of revenue, includ-
35       ing any necessary forms: Provided, however, That all such reimburse-
36       ments from this account shall be based on valid receipts for taxes paid
37       for taxable transactions occurring on or after July 1, 1999: Provided fur-
38       ther, That in the event any such track or facility for which materials and
39       services were purchased sales tax exempt is not operational for five years
40       succeeding the allowance of such exemption, the total amount of sales
41       tax which would have been payable except for the operation of this sub-
42       section shall be recouped in accordance with rules and regulations
43       adopted for such purpose by the secretary of revenue.

DEPARTMENT OF ADMINISTRATION
  3        (a) On July 1, 1999, the position limitation established by section 90(a)
  4       of 1999 Senate Bill No. 325 for the department of administration is
  5       hereby increased from 884.4 to 889.4.
  6        (b) There is appropriated for the above agency from the following spe-
  7       cial revenue fund or funds for the fiscal year or years specified, all moneys
  8       now or hereafter lawfully credited to and available in such fund or funds,
  9       except that expenditures other than refunds authorized by law shall not
10       exceed the following:

13        (c) During the fiscal years ending June 30, 1999, and June 30, 2000,
14       upon certification by the secretary of administration to the director of

17       to finance expenses related to efforts by the state of Kansas to recover
18       damages incidental to construction defects on capital projects involving
19       state facilities, the director of accounts and reports shall transfer an
20       amount equal to the insufficient amount from the architectural services
21       recovery fund to the construction defects recovery fund: Provided, That
22       the total of all such amounts transferred pursuant to this subsection dur-
23       ing fiscal year 1999 shall not exceed $200,000 and the total of all amounts
24       transferred pursuant to this subsection during fiscal year 2000 shall not
25       exceed $200,000.
26        (d) On the effective date of this act, the expenditure limitation estab-
27       lished by section 109(b) of 1999 Senate Bill No. 325 on the architectural
28       services recovery fund is hereby increased from $1,247,596 to $1,271,856.
29        (e) On July 1, 1999, the expenditure limitation established by section
30       42(b) of 1999 Senate Bill No. 325 on the architectural services recovery
31       fund is hereby increased from $1,255,164 to $1,497,412.
32        (f) On July 1, 1999, of the $18,043,940 appropriated for the above
33       agency for the fiscal year ending June 30, 2000, by section 42(a) of 1999
34       Senate Bill No. 325 from the state general fund in the department of
35       administration operations account, the sum of $690 is hereby lapsed.

26       fiscal year ending June 30, 2000, by section 161(a) of 1999 Senate Bill
27       No. 325 for the capital improvement project to renovate Ellsworth hall
28       is hereby lapsed and the renovate Ellsworth hall--special revenue fund

26       pitality) account, the sum of $20,115 is hereby lapsed.
27        (b) On the effective date of this act, of the $26,725,417 appropriated
28       for the above agency for the fiscal year ending June 30, 1999, by section
29       132(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
30       general fund in the agricultural experiment stations (including official

23       on the securities act fee fund is hereby increased from $1,878,834 to
24       $1,944,643.
25        (b) On July 1, 1999, the position limitation established for the fiscal
26       year ending on June 30, 2000, by section 22 of 1999 Senate Bill No. 325
27       for the office of the securities commissioner of Kansas is hereby increased
28       from 27.0 to 28.8.
29        (c) On July 1, 2000, the expenditure limitation established for the fiscal

23       rectional facility to the juvenile justice federal fund of the juvenile justice
24       authority.
25        (k) In addition to the other purposes for which expenditures may be
26       made from the children's health care programs fund for the fiscal year
27       ending June 30, 2000, expenditures may be made by the above agency
28       from the children's health care programs fund for fiscal year 2000 for the
29       following specified purposes subject to the expenditure limitations pre-
30       scribed therefor:
31       Children's health care programs fund--prevention program grants $4,000,000
32       Provided, That all expenditures by the above agency from the children's
33       health care programs fund for fiscal year 2000 from the children's health
34       care programs fund--prevention program grants account shall be in ad-
35       dition to any expenditure limitation imposed on the children's health care
36       programs fund for fiscal year 2000: Provided further, That money
37       awarded as grants from this account is not an entitlement to communities,
38       but a grant that must meet conditions prescribed by the above agency for
39       appropriate outcomes: And provided further, That the juvenile justice
40       authority shall submit a detailed plan as to how communities will expend
41       money awarded as grants from this account and shall report such details
42       to the joint committee on corrections and juvenile justice oversight before

17        (l) (1) On the effective date of this act, the position limitation estab-
18       lished by section 150 of chapter 203 of the 1998 Session Laws of Kansas
19       for the juvenile justice authority is hereby increased from 590.0 to 610.0.
20        (2) The number of full-time and regular part-time positions equated
21       to full-time, excluding seasonal and temporary positions, paid from ap-
22       propriations for fiscal year 2000 made in this or other appropriation act
23       of the 1999 regular session of the legislature for the juvenile justice au-
24       thority shall not exceed 610.0, except upon approval of the state finance
25       council.
26        (m) There is appropriated for the above agency from the state insti-
27       tutions building fund for the fiscal year ending June 30, 1999, for the
28       capital improvement project or projects specified as follows:
29       Juvenile facility planning needs $1,000,000
30        (n) There is appropriated for the above agency from the state institu-
31       tions building fund for the fiscal year ending June 30, 2000, for the capital
32       improvement project or projects specified as follows:
33       Capital improvements--rehabilitation, remodeling, renovation and repair of juvenile correctional facilities $1,307,123
34       Provided, That the commissioner of juvenile justice is hereby authorized
35       to transfer moneys during fiscal year 2000 from the capital improve-
36       ments--rehabilitation, remodeling, renovation and repair of juvenile cor-
37       rectional facilities account of the state institutions building fund to an
38       account or accounts of the state institutions building fund of any insti-
39       tution or facility under the jurisdiction of the commissioner of juvenile
40       justice to be expended during fiscal year 2000 by the institution or facility

  1       for capital improvement projects approved by the commissioner of ju-
  2       venile justice.
3       Juvenile facility planning needs $4,000,000
  4        Sec. 50. (a) On July 1, 1999, or as soon thereafter as moneys are avail-
  5       able therefor, the director of accounts and reports shall transfer
  6       $11,280,841 from the state general fund to the children's health care
  7       programs fund.
  8        (b) On July 1, 2000, or as soon thereafter as moneys are available there-
  9       for, the director of accounts and reports shall transfer $11,280,841 from
10       the children's health care programs fund to the state general fund.
11        (c) During the fiscal year ending June 30, 2000, and June 30, 2001,
12       notwithstanding any provisions of K.S.A. 1998 Supp. 38-2008 and amend-
13       ments thereto, the director of accounts and reports shall deposit all mon-
14       eys received as tobacco settlement funds as prescribed by this section:
15       Provided, That the director of accounts and reports shall deposit in the
16       state treasury to the credit of the tobacco settlement reserve fund of the
17       department of administration the amount equal to the total amount of
18       such moneys received as tobacco settlement fund, less the amount of
19       moneys that are required to be transferred from the children's health
20       care programs fund to the state general fund as prescribed by subsection
21       (b).
22        Sec. 51.

DEPARTMENT OF ADMINISTRATION
24        (a) There is appropriated for the above agency from the following spe-
25       cial revenue fund or funds for the fiscal year or years specified, all moneys
26       now or hereafter lawfully credited to and available in such fund or funds,
27       except that expenditures other than refunds authorized by law shall not

38        Sec. 52.

STATE BOARD OF REGENTS
40        (a) There is appropriated for the above agency from the following spe-
41       cial revenue fund or funds for the fiscal year or years specified, all moneys
42       now or hereafter lawfully credited to and available in such fund or funds,
43       except that expenditures other than refunds authorized by law shall not

  2       International economic and educational outreach programs fund
3             For the fiscal year ending June 30, 2000 $110,000
  4       Provided, That the state board regents is hereby authorized to transfer
  5       moneys from the international economic and educational outreach pro-
  6       grams fund to an appropriate special revenue fund or account of the
  7       restricted fees fund of any state educational institution under its jurisdic-
  8       tion participating in an existing international economic and educational
  9       outreach programs: Provided further, That all moneys transferred from
10       the international economic and educational outreach programs fund to a
11       special revenue fund or an account of the restricted fees fund of a state
12       educational institution under the jurisdiction of the state board of regents
13       shall be expended for the support and expansion of an existing interna-
14       tional economic and educational outreach program.
15        (b) On July 15, 1999, or as soon thereafter as moneys are available, the
16       director of accounts and reports shall transfer $110,000 from the Kansas
17       economic development endowment account of the state economic de-
18       velopment initiatives fund of the department of commerce and housing
19       to the international economic and educational outreach programs fund of
20       the state board of regents.
21        [Sec. 53.

[LEGISLATIVE COORDINATING COUNCIL
23        [(a) Any unencumbered balance in the legislative coordinating
24       council--Kansas public employees retirement system defined con-
25       tribution plan evaluation and study account of the state general
26       fund of the above agency in excess of $100 as of June 30, 1999, is
27       hereby reappropriated for fiscal year 2000.]
28        Sec. 53 [54]. On July 1, 1999, K.S.A. 1998 Supp. 79-2964, as amended
29       by section 94 of 1999 Senate Bill No. 325, is hereby amended to read as
30       follows: 79-2964. There is hereby created the county and city revenue
31       sharing fund. All moneys transferred or credited to such fund under the
32       provisions of this act or any other law shall be allocated and distributed
33       in the manner provided herein. The director of accounts and reports in
34       each year on July 15 and December 10, shall make transfers in equal
35       amounts which in the aggregate equal 3.5% of the total retail sales and
36       compensating taxes credited to the state general fund pursuant to articles
37       36 and 37 of chapter 79 of the Kansas Statutes Annotated and acts amen-
38       datory thereof and supplemental thereto during the preceding calendar
39       year from the state general fund to the county and city revenue sharing
40       fund, except that: (a) The transfers on July 15 and December 10 of each
41       year shall be in equal amounts which in the aggregate equal 2.823% of
42       such taxes credited to the state general fund during the preceding cal-
43       endar year; and (b) the amount of the transfer on each such date during

  1       state fiscal year 2000 shall be equal to 101.7% 100.0% of the amount
  2       transferred on the same date during state fiscal year 1999. All such trans-
  3       fers are subject to reduction under K.S.A. 75-6704 and amendments
  4       thereto. All transfers made in accordance with the provisions of this sec-
  5       tion shall be considered to be demand transfers from the state general
  6       fund.
  7        Sec. 54 [55]. (a) In accordance with appropriations for the fiscal year
  8       ending June 30, 2000, made by this or other appropriation act of the 1999
  9       regular session of the legislature:
10        (1) The governor is hereby authorized and directed to modify the pay
11       plan for fiscal year 1999 in accordance with this subsection (a)(1) and to
12       adopt such pay plan as so modified. The existing pay plan for fiscal year
13       1999 shall be modified to provide for an increase of 1.0% in the pay rates
14       of such pay plan. The pay plan adopted by the governor under this sub-
15       section (a)(1) shall be the pay plan for the classified service under the
16       Kansas civil service act and shall be effective on the first day of the first
17       biweekly payroll period which is chargeable to the fiscal year ending June
18       30, 2000. Such pay plan shall be subject to modification and approval as
19       provided under K.S.A. 75-2938 and amendments thereto and to any en-
20       actment of the legislature applicable thereto.
21        (2) (A) The governor is hereby authorized and directed to modify or
22       authorize the modification of the salaries of state officers and employees
23       who are in the unclassified service under the Kansas civil service act and
24       whose salaries are subject to approval by the governor under K.S.A. 75-
25       2935b or 75-2935c and amendments thereto to provide for base salary
26       increases, to be effective on the first day of the first payroll period which
27       is chargeable to the fiscal year ending on June 30, 2000, and to be dis-
28       tributed on a merit basis from a merit salary increase pool, the average
29       of such increases shall not exceed 3.5% of the base salaries of such officers
30       and employees.
31        (B) Each elected state official of the executive branch of state govern-
32       ment, including the state board of education, and the Kansas technology
33       enterprise corporation, Kansas, Inc., the state board of regents and the
34       board of trustees of the Kansas public employees retirement system, in
35       each such official or board's discretion, are hereby authorized and di-
36       rected to modify or to authorize the modification of the salaries of the
37       state officers and employees of such official or board, who are in the
38       unclassified service under the Kansas civil service act and whose salaries
39       are not subject to approval by the governor under K.S.A. 75-2935b or 75-
40       2935c and amendments thereto, to provide for base salary increases to
41       be effective on the first day of the first payroll period which is chargeable
42       to the fiscal year ending June 30, 2000, and to be distributed on a merit
43       basis from a merit salary increase pool, the average of such increases shall

  1       not exceed 3.5% of the base salaries of such officers and employees of
  2       such official or board. The provisions of this subsection (a)(2)(B) shall not
  3       authorize or provide any salary increase for the governor, lieutenant gov-
  4       ernor, secretary of state, state treasurer, commissioner of insurance, at-
  5       torney general, or to any member of any state board, commission, council
  6       or committee receiving per diem compensation as provided by statute.
  7        (b) On and after June 13, 1999, in addition to the other purposes for
  8       which expenditures may be made by the governor's department from the
  9       governor's department account of the state general fund for the fiscal
10       year ending June 30, 2000, expenditures shall be made by the governor's
11       department from the governor's department account of the state general
12       fund for fiscal year 2001 for an additional amount of biweekly compen-
13       sation for the governor equal to the amount required to provide, along
14       with the amount of biweekly compensation otherwise payable, an aggre-
15       gate amount of compensation of $3,528.54 per biweekly pay period: Pro-
16       vided, That expenditures for such purpose shall be made in the same
17       manner and at the same times that biweekly compensation is payable to
18       the governor for the biweekly pay periods which commence on or after
19       June 13, 1999, and which are chargeable to fiscal year 2000.
20        (c) On and after June 13, 1999, in addition to the other purposes for
21       which expenditures may be made by the lieutenant governor from the
22       operations account of the state general fund for the fiscal year ending
23       June 30, 2000, expenditures shall be made by the lieutenant governor
24       from the operations account of the state general fund for fiscal year 2000
25       for an additional amount of biweekly compensation for the lieutenant
26       governor equal to the amount required to provide, along with the amount
27       of biweekly compensation otherwise payable, an aggregate amount of
28       compensation of $998.04 per biweekly pay period: Provided, That ex-
29       penditures for such purpose shall be made in the same manner and at
30       the same times that biweekly compensation is payable to the lieutenant
31       governor for the biweekly pay periods which commence on or after June
32       13, 1999, and which are chargeable to fiscal year 2000.
33        (d) On and after June 13, 1999, in addition to the other purposes for
34       which expenditures may be made by the secretary of state from the op-
35       erating expenditures account of the state general fund for the fiscal year
36       ending June 30, 2000, expenditures shall be made by the secretary of
37       state from the operating expenditures account of the state general fund
38       for fiscal year 2000 for an additional amount of biweekly compensation
39       for the secretary of state equal to the amount required to provide, along
40       with the amount of biweekly compensation otherwise payable, an aggre-
41       gate amount of compensation of $2,741.15 per biweekly pay period: Pro-
42       vided, That expenditures for such purpose shall be made in the same
43       manner and at the same times that biweekly compensation is payable to

  1       the secretary of state for the biweekly pay periods which commence on
  2       or after June 13, 1999, and which are chargeable to fiscal year 2000.
  3        (e) On and after June 13, 1999, in addition to the other purposes for
  4       which expenditures may be made by the attorney general from the op-
  5       erating expenditures account of the state general fund for the fiscal year
  6       ending June 30, 2000, expenditures shall be made by the attorney general
  7       from the operating expenditures account of the state general fund for
  8       fiscal year 2000 for an additional amount of biweekly compensation for
  9       the attorney general equal to the amount required to provide, along with
10       the amount of biweekly compensation otherwise payable, an aggregate
11       amount of compensation of $3,152.24 per biweekly pay period: Provided,
12       That expenditures for such purpose shall be made in the same manner
13       and at the same times that biweekly compensation is payable to the at-
14       torney general for the biweekly pay periods which commence on or after
15       June 13, 1999, and which are chargeable to fiscal year 2000.
16        (f) On and after June 13, 1999, in addition to the other purposes for
17       which expenditures may be made by the state treasurer from the oper-
18       ating expenditures account of the state general fund for the fiscal year
19       ending June 30, 2000, expenditures shall be made by the state treasurer
20       from the operating expenditures account of the state general fund for
21       fiscal year 2000 for an additional amount of biweekly compensation for
22       the state treasurer equal to the amount required to provide, along with
23       the amount of biweekly compensation otherwise payable, an aggregate
24       amount of compensation of $2,741.15 per biweekly pay period: Provided,
25       That expenditures for such purpose shall be made in the same manner
26       and at the same times that biweekly compensation is payable to the state
27       treasurer for the biweekly pay periods which commence on or after June
28       13, 1999, and which are chargeable to fiscal year 2000.
29        (g) On and after June 13, 1999, in addition to the other purposes for
30       which expenditures may be made by the insurance department from the
31       insurance department service regulation fund for the fiscal year ending
32       June 30, 2000, expenditures shall be made by the insurance department
33       from the insurance department service regulation fund for fiscal year
34       2000 for an additional amount of biweekly compensation for the com-
35       missioner of insurance equal to the amount required to provide, along
36       with the amount of biweekly compensation otherwise payable, an aggre-
37       gate amount of compensation of $2,741.15 per biweekly pay period: Pro-
38       vided, That expenditures for such purpose shall be made in the same
39       manner and at the same times that biweekly compensation is payable to
40       the commissioner of insurance for the biweekly pay periods which com-
41       mence on or after June 13, 1999, and which are chargeable to fiscal year
42       2000.
43        (h) (1) In addition to the other purposes for which expenditures may

  1       be made by each state agency from appropriations made for the fiscal
  2       year ending June 30, 2000, expenditures shall be made by each state
  3       agency from the appropriations made for fiscal year 2000 for an additional
  4       amount of per diem compensation equal to the amount required to pro-
  5       vide, along with the amount of per diem compensation otherwise payable,
  6       an aggregate amount of compensation of $74.58 per calendar day for each
  7       member of a board for any calendar day occurring on or after June 13,
  8       1999, for which per diem compensation is payable to such member of a
  9       board under K.S.A. 75-3212 or 75-3223 and amendments thereto at the
10       rate prescribed by subsection (a) of K.S.A. 46-137a and amendments
11       thereto: Provided, That expenditures for such purpose shall be made in
12       the same manner and at the same times that per diem compensation is
13       payable to such member of a board for the biweekly pay periods for which
14       such per diem compensation for calendar days occurring on or after June
15       13, 1999, is payable and which are chargeable to fiscal year 2000.
16        (2) As used in this subsection (h), (A) "state agency" means any state
17       agency of the executive branch of state government (i) which has appro-
18       priations made for the fiscal year ending June 30, 2000, by 1999 Senate
19       Bill No. 325, this act or any other appropriation act of the 1999 regular
20       session of the legislature, and (ii) which is, or which makes expenditures
21       for, any board; and
22        (B) "board" means any board, commission, committee, task force,
23       panel or other body in the executive branch of state government, includ-
24       ing any advisory body, having one or more members who are entitled to
25       receive per diem compensation for attendance at meetings of such body,
26       or attendance at meetings authorized by such body of a subcommittee or
27       other subsidiary group of such body, as provided in K.S.A. 75-3212 or
28       75-3223 and amendments thereto at the rate prescribed by subsection (a)
29       of K.S.A. 46-137a and amendments thereto.
30        (i) In addition to the other purposes for which expenditures may be
31       made by the Kansas turnpike authority for the period commencing June
32       13, 1999, and ending June 30, 2000, expenditures shall be made by the
33       Kansas turnpike authority for such period for an additional amount of per
34       diem compensation equal to the amount required to provide, along with
35       the amount of per diem compensation otherwise payable, an aggregate
36       amount of compensation of $74.58 per calendar day for each member of
37       the Kansas turnpike authority for any calendar day occurring on or after
38       June 13, 1999, for which per diem compensation is payable to such mem-
39       ber under K.S.A. 68-2003 and amendments thereto who is entitled, in
40       accordance with K.S.A. 75-3223 and amendments thereto, to receive such
41       per diem compensation as provided in K.S.A. 75-3212 and amendments
42       thereto at the rate prescribed by subsection (a) of K.S.A. 46-137a and
43       amendments thereto: Provided, That expenditures for such purpose shall

  1       be made in the same manner and at the same times that per diem com-
  2       pensation is payable to such member of the Kansas turnpike authority for
  3       the appropriate pay periods for which such per diem compensation for
  4       calendar days occurring on or after June 13, 1999, and prior to July 1,
  5       2000, is payable by the Kansas turnpike authority.
  6        (j) In addition to the other purposes for which expenditures may be
  7       made by the legislature from the operations (including official hospitality)
  8       account of the state general fund for the fiscal year ending June 30, 2000,
  9       expenditures shall be made by the legislature from the operations (in-
10       cluding official hospitality) account of the state general fund for fiscal year
11       2000 (1) for an additional amount of per diem compensation equal to the
12       amount required to provide, along with the amount of per diem com-
13       pensation otherwise payable, an aggregate amount of compensation of
14       $74.58 per calendar day for each member of the legislature for service at
15       the regular session or any special session of the legislature for any calendar
16       day occurring on or after June 13, 1999, and (2) for an additional amount
17       of per diem compensation equal to the amount required to provide, along
18       with the amount of per diem compensation otherwise payable, an aggre-
19       gate amount of compensation of $74.58 per calendar day for each mem-
20       ber of the legislature and for any other public officer or person for any
21       calendar day occurring on or after June 13, 1999, for which per diem
22       compensation is payable from appropriations for the legislature to such
23       member of the legislature, public officer or person under K.S.A. 75-3212
24       or 75-3223 and amendments thereto at the rate prescribed by subsection
25       (a) of K.S.A. 46-137a and amendments thereto: Provided, That expend-
26       itures for such purposes shall be made in the same manner and at the
27       same times that per diem compensation is payable to such members of
28       the legislature, public officials and persons for the biweekly pay periods
29       for which such per diem compensation for calendar days occurring on or
30       after June 13, 1999, is payable and which are chargeable to fiscal year
31       2000.
32        (k) On and after June 13, 1999, in addition to the other purposes for
33       which expenditures may be made by the legislature from the operations
34       (including official hospitality) account of the state general fund for the
35       fiscal year ending June 30, 2000, expenditures shall be made by the leg-
36       islature from the operations (including official hospitality) account of the
37       state general fund for fiscal year 2000 for an additional amount of bi-
38       weekly compensation for the following legislative officers equal to the
39       amount required to provide, along with the amount of biweekly compen-
40       sation otherwise payable, an aggregate amount of compensation per bi-
41       weekly pay period for such legislative officers as follows: (1) For the pres-
42       ident of the senate and the speaker of the house of representatives equal
43       to the amount required to provide an aggregate amount of $454.18 per

  1       biweekly pay period for services performed in connection with discharg-
  2       ing the duties assigned to the respective positions, (2) for the speaker pro
  3       tem of the house of representatives, the vice president of the senate, the
  4       assistant majority leaders of the senate and house of representatives, and
  5       the assistant minority leaders of the senate and house of representatives
  6       equal to the amount required to provide an aggregate amount of $231.81
  7       per biweekly pay period for services performed in connection with dis-
  8       charging the duties assigned to the respective positions, (3) for the chair-
  9       person of the senate committee on ways and means and the chairperson
10       of the house of representatives committee on appropriations equal to the
11       amount required to provide an aggregate amount of $365.24 per biweekly
12       pay period for services performed in connection with discharging the
13       duties assigned to the respective positions, (4) for the majority leaders of
14       the senate and house of representatives equal to the amount required to
15       provide an aggregate amount of $409.75 per biweekly pay period for
16       services performed in connection with discharging the duties assigned to
17       the respective positions, and (5) the minority leaders of the senate and
18       house of representatives equal to the amount required to provide an ag-
19       gregate amount of $409.75 per biweekly pay period for services per-
20       formed in connection with discharging the duties assigned to the respec-
21       tive positions: Provided, That expenditures for such purpose shall be
22       made in the same manner and at the same times that biweekly compen-
23       sation is payable to such legislative officers under K.S.A. 46-137b and
24       amendments thereto for the biweekly pay periods which commence on
25       or after June 13, 1999, and which are chargeable to fiscal year 2000.
26        (l) In addition to the other purposes for which expenditures may be
27       made by the legislative coordinating council from the legislative coordi-
28       nating council-operations account of the state general fund for the fiscal
29       year ending June 30, 2000, expenditures shall be made by the legislative
30       coordinating council from the legislative coordinating council-operations
31       account of the state general fund for fiscal year 2000 for an additional
32       amount of per diem compensation equal to the amount required to pro-
33       vide, along with the amount of per diem compensation otherwise payable,
34       an aggregate amount of compensation of $74.58 per calendar day for each
35       member of the legislative coordinating council for any calendar day oc-
36       curring on or after June 13, 1999, for which per diem compensation is
37       payable from appropriations for the legislative coordinating council under
38       K.S.A. 46-1209 and amendments thereto to such member as provided in
39       K.S.A. 75-3212 and amendments thereto at the rate prescribed by sub-
40       section (a) of K.S.A. 46-137a and amendments thereto: Provided, That
41       expenditures for such purposes shall be made in the same manner and
42       at the same times that per diem compensation is payable to such members
43       of the legislative coordinating council for the biweekly pay periods for

  1       which such per diem compensation is payable for calendar days occurring
  2       on or after June 13, 1999, and which are chargeable to fiscal year 2000.
  3        (m) In addition to the other purposes for which expenditures may be
  4       made by the division of post audit from the operations (including legis-
  5       lative post audit committee) account of the state general fund for the
  6       fiscal year ending June 30, 2000, expenditures shall be made by the di-
  7       vision of post audit from the operations (including legislative post audit
  8       committee) account of the state general fund for fiscal year 2000 (1) for
  9       an additional amount of per diem compensation equal to the amount
10       required to provide, along with the amount of per diem compensation
11       otherwise payable, an aggregate amount of compensation of $74.58 per
12       calendar day for each member of the legislative post audit committee for
13       any calendar day occurring on or after June 13, 1999, for which per diem
14       compensation is payable from appropriations for the division of post audit
15       under K.S.A. 46-1104 and amendments thereto to such member as pro-
16       vided in K.S.A. 75-3212 and amendments thereto at the rate prescribed
17       by subsection (a) of K.S.A. 46-137a and amendments thereto, and (2) for
18       an additional amount of per diem compensation equal to the amount
19       required to provide, along with the amount of per diem compensation
20       otherwise payable, an aggregate amount of compensation of $74.58 per
21       calendar day for each member of the contract audit committee for any
22       calendar day occurring on or after June 13, 1999, for which per diem
23       compensation is payable from appropriations for the division of post audit
24       under K.S.A. 46-1120 and amendments thereto to such member as pro-
25       vided in K.S.A. 75-3223 and amendments thereto at the rate prescribed
26       by subsection (a) of K.S.A. 46-137a and amendments thereto: Provided,
27       That expenditures for such purposes shall be made in the same manner
28       and at the same times that per diem compensation is payable to such
29       members of the legislative post audit committee or contract audit com-
30       mittee for the biweekly pay periods for which such per diem compensa-
31       tion is payable for calendar days occurring on or after June 13, 1999, and
32       which are chargeable to fiscal year 2000.
33        (n) In addition to the other purposes for which expenditures may be
34       made by the judicial branch from the judiciary operations account of the
35       state general fund for the fiscal year ending June 30, 2000, expenditures
36       shall be made by the judicial branch from the judiciary operations account
37       of the state general fund for fiscal year 2000 (1) for an additional amount
38       of per diem compensation equal to the amount required to provide, along
39       with the amount of per diem compensation otherwise payable, an aggre-
40       gate amount of compensation of $74.58 per calendar day for each mem-
41       ber of the advisory council on dispute resolution for any calendar day
42       occurring on or after June 13, 1999, for which per diem compensation is
43       payable to such member of the advisory council on dispute resolution

  1       under K.S.A. 5-505 and amendments thereto who is entitled, in accord-
  2       ance with subsection (e) of K.S.A. 75-3223 and amendments thereto, to
  3       receive such per diem compensation as provided in K.S.A. 75-3212 and
  4       amendments thereto at the rate prescribed by subsection (a) of K.S.A.
  5       46-137a and amendments thereto; and (2) for an additional amount of
  6       per diem compensation equal to the amount required to provide, along
  7       with the amount of per diem compensation otherwise payable, an aggre-
  8       gate amount of compensation of $74.58 per calendar day for each retired
  9       justice or judge who performs judicial service or duties under K.S.A. 20-
10       2616 and amendments thereto for each calendar day occurring on or after
11       June 13, 1999, for which per diem compensation is payable to such retired
12       justice or judge under K.S.A. 20-2616 and amendments thereto: Pro-
13       vided, That expenditures for such purposes shall be made in the same
14       manner and at the same times that per diem compensation is payable to
15       such members of the advisory council on dispute resolution or to such
16       retired justices or judges for the biweekly pay periods for which such per
17       diem compensation for calendar days occurring on or after June 13, 1999,
18       is payable and which are chargeable to fiscal year 2000.
19        (o) In addition to the other purposes for which expenditures may be
20       made by the judicial council from the operating expenditures account of
21       the state general fund for the fiscal year ending June 30, 2000, expendi-
22       tures shall be made by the judicial council from the operating expendi-
23       tures account of the state general fund for fiscal year 2000 for an addi-
24       tional amount of per diem compensation equal to the amount required
25       to provide, along with the amount of per diem compensation otherwise
26       payable, an aggregate amount of compensation of $74.58 per calendar
27       day for each member of the judicial council and for each regularly ap-
28       pointed member of a special committee of the judicial council who is not
29       a member of the judicial council for any calendar day occurring on or
30       after June 13, 1999, for which per diem compensation is payable to such
31       member of the judicial council or a special committee thereof under
32       K.S.A. 20-2206 and amendments thereto at the rate of compensation in
33       accordance with K.S.A. 75-3212 and amendments thereto at the rate pre-
34       scribed by subsection (a) of K.S.A. 46-137a and amendments thereto:
35       Provided, That expenditures for such purposes shall be made in the same
36       manner and at the same times that per diem compensation is payable to
37       such members of the judicial council or special committees thereof for
38       the biweekly pay periods for which such per diem compensation for cal-
39       endar days occurring on or after June 13, 1999, is payable and which are
40       chargeable to fiscal year 2000.
41        Sec. 55 [56]. Appeals to exceed position limitations. (a) The limitations
42       imposed by this act on the number of full-time and regular part-time
43       positions equated to full-time, excluding seasonal and temporary posi-

  1       tions, paid from appropriations for the fiscal year ending June 30, 1999,
  2       made in this act or in any appropriation act of the 1998 regular session
  3       of the legislature or in any other appropriation act of the 1999 regular
  4       session of the legislature may be exceeded upon approval of the state
  5       finance council.
  6        (b) The limitations imposed by this act on the number of full-time and
  7       regular part-time positions equated to full-time, excluding seasonal and
  8       temporary positions, paid from appropriations for the fiscal year ending
  9       June 30, 2000, made in this act or in any other appropriation act of the
10       1999 regular session of the legislature may be exceeded upon approval of
11       the state finance council.
12        Sec. 56 [57]. Appeals to exceed expenditure limitations. Upon written
13       application to the governor and approval of the state finance council,
14       expenditures from special revenue funds may exceed the amounts spec-
15       ified in this act.
16        Sec. 57 [58]. Savings. (a) Any unencumbered balance as of June 30,
17       1999, in any special revenue fund, or account thereof, of any state agency
18       named in this act which is not otherwise specifically appropriated or lim-
19       ited by this or other appropriation act of the 2000 regular session of the
20       legislature, is hereby appropriated for the fiscal year ending June 30,
21       2000, for the same use and purpose as the same was heretofore appro-
22       priated.
23        (b) Any unencumbered balance in any special revenue fund, or account
24       thereof, of any state agency named in section 22 of 1999 Senate Bill No.
25       325 which is not otherwise specifically appropriated or limited for fiscal
26       year 2001 by this or other appropriation act of the 1999 or 2000 regular
27       session of the legislature, is hereby appropriated for fiscal year 2001 for
28       the same use and purpose as the same was heretofore appropriated.
29        Sec. 58 [59]. Federal grants. (a) Each federal grant or other federal
30       receipt which is received by a state agency named in this act and which
31       is not otherwise appropriated to that state agency by this or other appro-
32       priation act of the 1999 regular session of the legislature, is hereby ap-
33       propriated for the fiscal year ending June 30, 2000, for that state agency
34       for the purpose set forth in such federal grant or receipt, except that no
35       expenditure shall be made from and no obligation shall be incurred
36       against any such federal grant or other federal receipt, which has not been
37       previously appropriated or reappropriated or approved for expenditure
38       by the governor, until the governor has authorized the state agency to
39       make expenditures therefrom.
40        (b) Each federal grant or other federal receipt which is received by a
41       state agency named in section 22 of 1999 Senate Bill No. 325 and which
42       is not otherwise appropriated to that state agency for fiscal year 2001 by
43       this or other appropriation act of the 1999 or 2000 regular session of the

  1       legislature, is hereby appropriated for fiscal year 2001 for that state agency
  2       for the purpose set forth in such federal grant or receipt, except that no
  3       expenditure shall be made from and no obligation shall be incurred
  4       against any such federal grant or other federal receipt, which has not been
  5       previously appropriated or reappropriated or approved for expenditure
  6       by the governor, for fiscal year 2001, until the governor has authorized
  7       the state agency to make expenditures from such federal grant or other
  8       federal receipt for fiscal year 2001.
  9        Sec. 59 [60]. Any transfers of money during the fiscal year ending June
10       30, 2000, from any special revenue fund of any state agency named in
11       this act to the audit services fund of the division of post audit under K.S.A.
12       46-1121 and amendments thereto shall be in addition to any expenditure
13       limitation imposed on any such fund for the fiscal year ending June 30,
14       2000.
15        Sec. 60 [61]. Any correctional institutions building fund appropriation
16       heretofore appropriated to any state agency named in this or other ap-
17       propriation act of the 1999 regular session of the legislature, and having
18       an unencumbered balance as of June 30, 1999, in excess of $100 is hereby
19       reappropriated for the fiscal year ending June 30, 2000, for the same uses
20       and purposes as originally appropriated unless specific provision is made
21       for lapsing such appropriation.
22        Sec. 61 [62]. Any Kansas educational building fund appropriation here-
23       tofore appropriated to any institution named in this or other appropriation
24       act of the 1999 regular session of the legislature and having an unencum-
25       bered balance as of June 30, 1999, in excess of $100 is hereby reappro-
26       priated for the fiscal year ending June 30, 2000, for the same use and
27       purpose as originally appropriated, unless specific provision is made for
28       lapsing such appropriation.
29        Sec. 62 [63]. Any state institutions building fund appropriation here-
30       tofore appropriated to any state agency named in this or other appropri-
31       ation act of the 1999 regular session of the legislature and having an
32       unencumbered balance as of June 30, 1999, in excess of $100 is hereby
33       reappropriated for the fiscal year ending June 30, 2000, for the same use
34       and purpose as originally appropriated, unless specific provision is made
35       for lapsing such appropriation.
36        [Sec. 64. For the fiscal year ending June 30, 1999, appropriations
37       are hereby made, restrictions and limitations are hereby imposed,
38       and transfers disbursements, procedures and acts incidental to the
39       foregoing are hereby directed or authorized as provided in this
40       sections 63 through 77.
41        [Sec. 65. The department of revenue is hereby authorized and

13        [Sec. 78. (a) Except as otherwise provided by this act, the direc-
14       tor of accounts and reports is hereby authorized and directed to
15       draw warrants on the state treasurer in favor of the claimants spec-
16       ified in this act, upon vouchers duly executed by the state agencies
17       directed to pay the amounts specified in such sections to the claim-
18       ants or their legal representatives or duly authorized agents, as
19       provided by law.
20        [(b) The director of accounts and reports shall secure prior to
21       the payment of any amount to any claimant, other than amounts
22       authorized to be paid pursuant to section 2 as motor-vehicle fuel
23       tax refunds or as transactions between state agencies as provided
24       by this act, a written release and satisfaction of all claims and rights
25       against the state of Kansas and any agencies, officers and employ-
26       ees of the state of Kansas regarding their respective claims.]
27        Sec. 63 [79]. On July 1, 1999, K.S.A. 1998 Supp. 79-2964, as amended
28       by section 94 of 1999 Senate Bill No. 325, is hereby repealed.
29        Sec. 64 [80]. This act shall take effect and be in force from and after
30       its publication in the Kansas register.
