9 AN ACT
concerning abortions; imposing requirements after the per-
10 formance of an
abortion; relating to certain reports.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section
1. If a physician determines, prior to the performance of
an
14 abortion, that the gestational age of a
fetus is 22 or more weeks, the
15 remains of such fetus shall be sent to the
pathology department of the
16 University of Kansas for examination. The
examination shall determine,
17 but shall not be limited to determining,
cause of death, gestational age,
18 fetal abnormalities and viability of such
fetus. Such report shall be trans-
19 mitted to the secretary of health and
environment. Information obtained
20 by the secretary under this section shall
be used only for statistical pur-
21 poses. Such information shall be included
in any publication of statistics
22 reported pursuant to K.S.A. 65-445, and
amendments thereto.
23 As used in this
section, "viability" shall have the same meaning ascribed
24 thereto by K.S.A. 65-6701 et seq.,
and amendments thereto.
25 Sec. 2. This act shall
take effect and be in force from and after its
26 publication in the statute book.
