9 AN ACT
concerning crimes and punishment; relating to unlawfully dis-
10 arming a law
enforcement officer.

12 Be it enacted by the Legislature of the
State of Kansas:
13 Section
1. (a) Unlawfully disarming a law enforcement officer is:
14 (1) Taking a
weapon, that the officer is authorized by such officer's
15 employer to carry, other than a firearm,
from a law enforcement officer
16 without such officer's consent while such
officer is engaged in the per-
17 formance of such officer's duty and the
person taking the weapon knows
18 or has reason to believe the individual
from whom the weapon is taken
19 is a law enforcement officer; or
20 (2) taking a
firearm, that the officer is authorized by such officer's
21 employer to carry, from a law enforcement
officer without such officer's
22 consent while such officer is engaged in
the performance of such officer's
23 duty and the person taking the firearm
knows or has reason to believe
24 the individual from whom the firearm is
taken is a law enforcement
25 officer.
26 (b) Unlawfully
disarming a law enforcement officer as defined in sub-
27 section (a)(1) is a severity 5, person
felony. Unlawfully disarming a law
28 enforcement officer as defined in
subsection (a)(2) is a severity level 6,
29 person felony.
30 (c) As used in
this subsection, law enforcement officer shall have the
31 same meaning ascribed thereto by K.S.A.
74-5602, and amendments
32 thereto.
33 (d) This section
shall be part of and supplemental to the Kansas crim-
34 inal code.
35 Sec. 2. This act shall
take effect and be in force from and after its
36 publication in the statute book.
