11             AN ACT making and concerning appropriations for the fiscal year ending
12             June 30, 1999, for the state bank commissioner, state board of healing
13             arts, state department of credit unions, Kansas dental board, consumer
14             credit commissioner, office of the securities commissioner of Kansas,
15             state board of veterinary examiners, attorney general, secretary of
16             state, state board of indigents' defense services, Kansas human rights
17             commission, state corporation commission, department of administra-
18             tion, department of revenue, Kansas racing and gaming commission,
19             department of revenue -- homestead property tax refunds, Kansas
20             commission on veterans affairs, department of health and environ-
21             ment, department of social and rehabilitation services, department of
22             education, state library, Fort Hays state university, Kansas state uni-
23             versity extension systems and agriculture research programs, Kansas
24             state university veterinary medical center, Emporia state university,
25             Pittsburg state university, university of Kansas, university of Kansas
26             medical center, department of corrections, state fire marshal, Kansas
27             parole board, Kansas highway patrol, juvenile justice authority, attor-
28             ney general -- Kansas bureau of investigation, board of examiners

35             human resources, department of commerce and housing, and
36             judicial council and real estate appraisal board; authorizing cer-
37             tain transfers and capital improvement projects, imposing certain re-
38             strictions and limitations, and directing or authorizing certain receipts
39             and disbursements and acts incidental to the foregoing.
40      
41       Be it enacted by the Legislature of the State of Kansas:
42             Section 1. (a) For the fiscal year ending June 30, 1999, appropriations

  1       are hereby made, restrictions and limitations are hereby imposed, and
  2       transfers, capital improvement projects, fees, receipts, disbursements and
  3       acts incidental to the foregoing are hereby directed or authorized as pro-
  4       vided in this act.
  5             Sec. 2.
  6      
STATE BANK COMMISSIONER
  7        (a) On the effective date of this act, the expenditure limitation estab-
  8       lished for the fiscal year ending June 30, 1999, by section 65(a) of chapter
  9       203 of the 1998 Session Laws of Kansas on the bank commissioner fee
10       fund is hereby decreased from $3,803,313 to $3,674,981.
11        (b) On the effective date of this act, the position limitation established
12       for the fiscal year ending June 30, 1999, by section 65(b) of chapter 203
13       of the 1998 Session Laws of Kansas for the state bank commissioner is
14       hereby decreased from 70.0 to 67.0.
15             Sec. 3.
16      
STATE BOARD OF HEALING ARTS
17        (a) On the effective date of this act, the expenditure limitation estab-
18       lished for the fiscal year ending on June 30, 1999, by section 22(a) of
19       chapter 202 of the 1998 Session Laws of Kansas on the healing arts fee
20       fund is hereby increased from $1,682,384 to $1,697,802 $1,855,802.
21             Sec. 4.

STATE DEPARTMENT OF CREDIT UNIONS
23        (a) On the effective date of this act, the expenditure limitation estab-
24       lished for the fiscal year ending on June 30, 1999, by section 70(a) of
25       chapter 203 of the 1998 Session Laws of Kansas on the credit union fee
26       fund is hereby decreased from $777,140 to $726,461.
27             Sec. 5.

KANSAS DENTAL BOARD
29        (a) On the effective date of this act, the expenditure limitation estab-
30       lished for the fiscal year ending June 30, 1999, by section 21(b) of chapter
31       202 of the 1998 Session Laws of Kansas on the dental board fee fund is
32       hereby increased from $222,937 to $228,533.
33             Sec. 6.
34      
CONSUMER CREDIT COMMISSIONER
35        (a) On the effective date of this act, the expenditure limitation estab-
36       lished for the fiscal year ending June 30, 1999, by section 74(a) of chapter
37       203 of the 1998 Session Laws of Kansas on the consumer credit fee fund
38       is hereby decreased from $405,411 to $392,593.
39             Sec. 7.

OFFICE OF THE SECURITIES COMMISSIONER OF KANSAS
41        (a) On the effective date of this act, the expenditure limitation estab-
42       lished for the fiscal year ending on June 30, 1999, by section 12(a) of
43       chapter 202 of the 1998 Session Laws of Kansas on the securities act fee

  1       fund is hereby increased from $1,824,334 to $1,839,615: Provided, That
  2       expenditures from the securities act fee fund for the fiscal year
  3       ending June 30, 1999, for official hospitality shall not exceed $600.
  4             Sec. 8.
  5      
STATE BOARD OF VETERINARY EXAMINERS
  6        (a) On the effective date of this act, the expenditure limitation estab-
  7       lished by section 82(a) of chapter 203 of the 1998 Session Laws of Kansas
  8       on the veterinary examiners fee fund is hereby decreased from $244,153
  9       to $218,315.
10             Sec. 9.
11      
ATTORNEY GENERAL
12        (a) On the effective date of this act, the director of accounts and reports
13       shall transfer $339,887 from the operating expenditures relating to inter-
14       state water rights regarding the Republican river and its tributaries ac-
15       count of the state general fund of the above agency to the additional
16       operating expenditures for investigation and litigation regarding interstate
17       water rights account of the state general fund of the above agency.
18             Sec. 10.
19      
SECRETARY OF STATE
20        (a) During each month of the fiscal year ending June 30, 1999, the
21       secretary of state shall certify to the director of accounts and reports the
22       amount equal to the product of $1 multiplied by the number of annual
23       reports received by the secretary of state during the preceding month
24       from professional corporations, domestic or foreign corporations, corpo-
25       rations organized not for profit, domestic or foreign limited liability com-
26       panies, domestic or foreign limited partnerships or any other entities pur-
27       suant to statute, which include the receipt of an annual franchise tax or
28       privilege fee. Upon receipt of each such certification, the director of ac-
29       counts and reports shall transfer an amount equal to the amount certified
30       from the state general fund to the franchise fee recovery fund of the
31       secretary of state.
32             Sec. 11.
33      
STATE BOARD OF INDIGENTS' DEFENSE SERVICES
34        (a) On the effective date of this act, the director of accounts and reports
35       shall transfer $7,862 from the capital defense operations account of the
36       state general fund of the above agency to the operating expenditures
37       account of the state general fund of the above agency.
38             Sec. 12.
39      
KANSAS HUMAN RIGHTS COMMISSION
40        (a) On the effective date of this act, of the $1,439,671 appropriated for
41       the above agency for the fiscal year ending on June 30, 1999, by section
42       101(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
43       general fund in the operating expenditures account, the sum of $15,707

  1       is hereby lapsed.
  2             Sec. 13.
  3      
STATE CORPORATION COMMISSION
  4        (a) On the effective date of this act, the expenditure limitation estab-
  5       lished by section 51(c) of chapter 202 of the 1998 Session Laws of Kansas
  6       on the aggregate expenditures from the public service regulation fund,
  7       the motor carriers license fees fund and the conservation fee fund is
  8       hereby decreased from $12,715,456 to $12,548,451.
  9        (b) On the effective date of this act, or as soon thereafter as moneys
10       are available, the director of accounts and reports shall transfer $400,000
11       from the abandoned oil and gas well fund of the state corporation com-
12       mission to the state general fund.
13             Sec. 14.
14      
DEPARTMENT OF ADMINISTRATION
15        (a) During the fiscal year ending June 30, 1999, the state long-term
16       care ombudsman shall prepare and submit to the secretary of aging a
17       billing invoice each month in the amount equal to 1/12 of $209,855 for
18       long-term care ombudsman services performed by the state long-term
19       care ombudsman and the office of the state long-term care ombudsman
20       within the department of administration for the department on aging:
21       Provided, That the amount to be billed may be adjusted as provided in
22       writing by agreement between the state long-term care ombudsman and
23       the secretary of aging: Provided further, That the amount specified in the
24       monthly invoice shall be paid from the appropriate fund or funds of the
25       department on aging into the older Americans act long term care om-
26       budsman federal fund of the department of administration.
27        (b) On the effective date of this act, the expenditure limitation estab-
28       lished by section 42(j) of chapter 202 of the 1998 Session Laws of Kansas
29       on the architectural services recovery fund is hereby increased from
30       $1,176,173 to $1,247,596.
31        (c) On the effective date of this act, the expenditure limitation estab-
32       lished by section 42(b) of chapter 202 of the 1998 Session Laws of Kansas
33       on the salaries and wages and other operating expenditures account of
34       the cafeteria benefits fund is hereby increased from $1,117,897 to
35       $1,868,998.
36        (d) On the effective date of this act, or as soon thereafter as moneys
37       are available, the director of accounts and reports shall transfer
38       $1,983,535 from the state general fund to the state emergency fund.
39        (e) During the fiscal year ending June 30, 1999, upon certification by
40       the director of the budget to the director of accounts and reports that the
41       unencumbered balance in the state emergency fund is insufficient to pay
42       an amount that is necessary to finance an action approved by the state
43       finance council pursuant to K.S.A. 75-3713, 75-3713a, 75-3713b, 75-

  1       3713c or 75-3713d and amendments thereto, the director of accounts and
  2       reports shall transfer an amount equal to the insufficient amount from
  3       the state general fund to the state emergency fund: Provided, That the
  4       total of all amounts transferred from the state general fund to the state
  5       emergency fund pursuant to this subsection during fiscal year 1999 shall
  6       not exceed $10,000,000.
  7        (f) (e) On the effective date of this act, the Kansas savings incentive --
  8       accounts and reports account of the state general fund of the department
  9       of administration is hereby redesignated as the Kansas savings incentive
10       -- department of administration account of the state general fund of the
11       department of administration.
12        (g) (f) On the effective date of this act, of the $132,054 appropriated
13       for the above agency for the fiscal year ending June 30, 1999, by section
14       104(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
15       general fund in the policy analysis initiatives account, the sum of $83,909
16       is hereby lapsed.
17             Sec. 15.
18      
DEPARTMENT OF REVENUE
19        (a) On the effective date of this act, the expenditure limitation estab-
20       lished by section 44(d) of chapter 202 of the 1998 Session Laws of Kansas
21       on the division of vehicles operating fund is hereby increased from
22       $30,402,477 to $30,624,572.
23        (b) On the effective date of this act, the expenditure limitation estab-
24       lished by section 44(e) of chapter 202 of the 1998 Session Laws of Kansas
25       on the salaries and wages account of the division of vehicles operating
26       fund is hereby decreased from $16,942,522 to $16,665,197.
27        (c) On the effective date of this act, the expenditure limitation estab-
28       lished by section 107(b) of chapter 203 of the 1998 Session Laws of Kan-
29       sas on the electronic databases fee fund is hereby increased from
30       $2,350,000 to $3,440,000.
31        (d) On the effective date of this act, the expenditure limitation estab-
32       lished by section 107(b) of chapter 203 of the 1998 Session Laws of Kan-
33       sas on the state bingo regulation fund is hereby decreased from $361,530
34       to $338,077.
35             Sec. 16.
36      
KANSAS RACING AND GAMING COMMISSION
37        (a) On the effective date of this act, notwithstanding the provisions of
38       any other law to the contrary, the director of accounts and reports shall
39       transfer $150,000 from the racing reimbursable expense fund of the above
40       agency to the racing investigative expense fund of the above agency. state
41       general fund for the purpose of reimbursing costs of salaries for
42       employees of the above agency who worked at race facilities, as
43       defined in K.S.A. 1998 Supp. 74-8802, and amendments thereto,

  1       and whose compensation was paid from moneys transferred from
  2       the state general fund.
  3        (b) On the effective date of this act, the director of accounts and
  4       reports shall transfer $60,557 from the horse fair racing benefit
  5       fund to the state racing fund for the purpose of reimbursing costs
  6       of salaries for employees of the above agency who worked at race
  7       track facilities, as defined in K.S.A. 1998 Supp. 74-8802, and
  8       amendments thereto, during county fairs.
  9        (c) On the effective date of this act, the expenditure limitation
10       established by section 109(a) of chapter 203 of the 1998 Session
11       Laws of Kansas on the state racing fund is hereby decreased from
12       $3,124,974 to $3,010,231.
13             Sec. 17.
14      
DEPARTMENT OF REVENUE -- HOMESTEAD PROPERTY TAX REFUNDS
15        (a) There is appropriated for the above agency from the state general
16       fund the following:
17       Homestead tax refunds $1,500,000
18       Provided, That expenditures may be made from the homestead tax refunds account for
19       refund payments under the homestead property tax refund act and for refund payments
20       under K.S.A. 79-4530 and amendments thereto.
21             Sec. 18.
22      
KANSAS COMMISSION ON VETERANS AFFAIRS
23        (a) There is appropriated for the above agency from the state general
24       fund the following:
25       Operating expenditures -- veterans affairs $16,180
26       Operating expenditures -- Kansas soldiers' home $149,735
27        (b) There is appropriated for the above agency the following special
28       revenue fund or funds all moneys now or hereafter lawfully credited to
29       and available in such fund or funds, except that expenditures, other than
30       refunds authorized by law shall not exceed the following:
31       Soldiers' home outpatient clinic fund $33,000
32        (c) In addition to the other purposes for which expenditures may be
33       made from the state budget stabilization fund for fiscal year 1999, ex-
34       penditures may be made by the above agency from the state budget sta-
35       bilization fund for fiscal year 1999 for the following specified purpose
36       subject to the expenditure limitation prescribed therefor:
37       Outpatient clinic startup costs $26,665
38       Provided, That all expenditures by the above agency from the state budget stabilization fund
39       for fiscal year 1999 for the outpatient clinic startup costs shall be in addition to any ex-
40       penditure limitation imposed on the state budget stabilization fund for fiscal year 1999.
41        (d) On the effective date of this act, the expenditure limitation estab-
42       lished by section 116(a) of chapter 203 of the 1998 Session Laws of Kansas
43       on expenditures from the reappropriated balance in the operating ex-

  1       penditures -- veterans affairs account of the state general fund is hereby
  2       increased from $5,577 to $11,252.
  3        (e) On the effective date of this act, the expenditure limitation estab-
  4       lished by section 116(b) of chapter 203 of the 1998 Session Laws of Kan-
  5       sas on the soldiers' home fee fund is hereby decreased from $3,427,965
  6       to $3,420,929.
  7             Sec. 19.
  8      
DEPARTMENT OF HEALTH AND ENVIRONMENT
  9        (a) There is appropriated for the above agency from the state general
10       fund the following:
11       AIDS medication shortfall $250,000
12        (b) On the effective date of this act, the expenditure limitation estab-
13       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
14       sas on the title XIX fund is hereby increased from $3,829,197 to
15       $3,854,855.
16             (c) On the effective date of this act, the expenditure limitation estab-
17       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
18       sas on the voluntary cleanup fund is hereby increased from $249,044 to
19       $250,998.
20        (d) On the effective date of this act, the expenditure limitation estab-
21       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
22       sas on the nuclear safety emergency preparedness special revenue fund
23       is hereby increased from $214,543 to $214,905.
24        (e) On the effective date of this act, the expenditure limitation estab-
25       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
26       sas on the waste tire management fund is hereby increased from
27       $1,204,052 to $1,710,872.
28        (f) On the effective date of this act, the expenditure limitation estab-
29       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
30       sas on the environmental response fund is hereby increased from
31       $1,161,379 to $1,516,173.
32        (g) On the effective date of this act, the expenditure limitation estab-
33       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
34       sas on the mined-land reclamation fund is hereby increased from $25,000
35       to $1,071,827.
36        (h) On the effective date of this act, the expenditure limitation estab-
37       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
38       sas on the medicare fund -- federal is hereby increased from $2,033,357
39       to $2,312,666.
40        (i) On the effective date of this act, the expenditure limitation estab-
41       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
42       sas on the disease prevention and health promotion federal grants fund
43       is hereby increased from $1,840,733 to $1,883,727.

  1        (j) On the effective date of this act, the expenditure limitation estab-
  2       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
  3       sas on the federal air quality program fund is hereby increased from
  4       $929,859 to $931,454.
  5        (k) On the effective date of this act, the expenditure limitation estab-
  6       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
  7       sas on the federal occupational health and safety statistics program fund
  8       is hereby increased from $140,015 to $150,251.
  9        (l) On the effective date of this act, the expenditure limitation estab-
10       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
11       sas on the other federal grants fund is hereby increased from $1,152,637
12       to $1,586,969.
13        (m) On the effective date of this act, the expenditure limitation estab-
14       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
15       sas on the wetlands protection -- federal fund is hereby increased from
16       $25,791 to $26,509.
17        (n) On the effective date of this act, the expenditure limitation estab-
18       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
19       sas on the breast and cervical cancer program and detection fund is
20       hereby increased from $1,558,092 to $1,864,500.
21        (o) On the effective date of this act, the expenditure limitation estab-
22       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
23       sas on the title IV-E -- federal fund is hereby increased from $566,477
24       to $566,836.
25        (p) On the effective date of this act, the expenditure limitation estab-
26       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
27       sas on the title I -- P.L. 99-457 child development -- federal fund is
28       hereby increased from $2,841,537 to $3,151,113.
29        (q) On the effective date of this act, the expenditure limitation estab-
30       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
31       sas on the federal title X family planning fund is hereby increased from
32       $1,555,864 to $1,717,385.
33        (r) On the effective date of this act, the expenditure limitation estab-
34       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
35       sas on the lead poisoning prevention -- federal fund is hereby increased
36       from $199,763 to $213,650.
37        (s) On the effective date of this act, the expenditure limitation estab-
38       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
39       sas on the radiological environmental cooperative monitoring -- federal
40       fund is hereby increased from $21,840 to $22,139.
41        (t) On the effective date of this act, the expenditure limitation estab-
42       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
43       sas on the early childhood developmental services -- federal fund is

  1       hereby increased from $56,000 to $56,321.
  2        (u) On the effective date of this act, the expenditure limitation estab-
  3       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
  4       sas on the underground storage tank fund -- federal is hereby increased
  5       from $170,719 to $252,038.
  6        (v) On the effective date of this act, the expenditure limitation estab-
  7       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
  8       sas on the census of traumatic occupational fatalities -- federal fund is
  9       hereby increased from $75,748 to $77,302.
10        (w) On the effective date of this act, the expenditure limitation estab-
11       lished by section 117(b) of chapter 203 of the 1998 Session Laws of Kan-
12       sas on the gifts, grants and donations fund is hereby increased from
13       $1,248,055 to $1,532,168.
14             Sec. 20.
15      
DEPARTMENT OF SOCIAL AND REHABILITATION SERVICES
16        (a) There is appropriated for the above agency from the state general
17       fund the following:
18       State operations $140,853
19       Youth services aid and assistance $4,178,207
20       Community based services $14,309,666
21       Other medical assistance $14,204,129
22       Mental health and retardation services aid and assistance and state insti-tutions operations $2,506,100 $1,199,823
23       Provided, That expenditures shall be made from the mental health and retardation
24       services aid and assistance and state institutions account and from other moneys
25       available to the department of social and rehabilitation services so that the home
26       and community based services/mental retardation waiver is fully funded within the
27       existing resources of the department to the extent that any individual receiving
28       services under HCBS/MR waiver will continue to receive the same level of services
29       for the entire fiscal year ending June 30, 1999.
30        (b) On the effective date of this act, the $8,317,100 appropriated for
31       the above agency for the fiscal year ending June 30, 1999, by section
32       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
33       general fund in the adult care homes account is hereby lapsed.
34        (c) On the effective date of this act, of the $717,491 appropriated for
35       the above agency for the fiscal year ending June 30, 1999, by section
36       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
37       general fund in the sex predator program account, the sum of $283,000
38       is hereby lapsed.
39        (d) (1) On the effective date of this act, the $3,206,000 appropriated
40       for the above agency for the fiscal year ending June 30, 1999, by section
41       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
42       general fund in the child support pass-through account is hereby lapsed.

  1        (2) On the effective date of this act, the appropriation for the above
  2       agency for the fiscal year ending June 30, 1999, by section 120(a) of
  3       chapter 203 of the 1998 Session Laws of Kansas of any unencumbered
  4       balance in the child support pass-through account of the state general
  5       fund is hereby lapsed.
  6        (e) On the effective date of this act, of the $4,265,911 appropriated for
  7       the above agency for the fiscal year ending June 30, 1999, by section
  8       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
  9       general fund in the alcohol and drug abuse services grants account, the
10       sum of $465 is hereby lapsed.
11        (f) On the effective date of this act, of the $43,627,493 appropriated
12       for the above agency for the fiscal year ending June 30, 1999, by section
13       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
14       general fund in the youth services aid and assistance account, the sum of
15       $82,920 is hereby lapsed.
16        (f) On the effective date of this act, the expenditure limitation
17       established by section 45(e) of Chapter 202 of the 1998 Session
18       Laws of Kansas on the state operations account of the social serv-
19       ices clearing fund is hereby increased from $248,572,117 to
20       $278,306,968.
21        (g) On the effective date of this act, of the $2,779,970 appropriated for
22       the above agency for the fiscal year ending June 30, 1999, by section
23       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
24       general fund in the vocational rehabilitation aid and assistance account,
25       the sum of $213,590 is hereby lapsed.
26        (h) On the effective date of this act, of the $49,982,374 appropriated
27       for the above agency for the fiscal year ending June 30, 1999, by section
28       120(a) of chapter 203 of the 1998 Session Laws of Kansas from the state
29       general fund in the cash assistance account, the sum of $896 $896,016
30       is hereby lapsed.
31        (i) On the effective date of this act, the expenditure limitation estab-
32       lished by section 120(b) of chapter 203 of the 1998 Session Laws of Kan-
33       sas on the social welfare fund is hereby decreased from $57,948,036 to
34       $57,099,428.
35        (j) On the effective date of this act, the expenditure limitation estab-
36       lished by section 120(b) of chapter 203 of the 1998 Session Laws of Kan-
37       sas on expenditures for state operations from the social welfare fund is
38       hereby increased from $8,795,972 to $13,469,797.
39        (k) On the effective date of this act, the expenditure limitation estab-

24        (r) On the effective date of this act, the expenditure limitation estab-

26       sas on the Rainbow mental health facility fee fund is hereby increased
27       from $375,706 to $1,036,361.
28        (s) On the effective date of this act, the expenditure limitation
29       established for the fiscal year ending June 30, 1999, by section
30       120(b) of chapter 203 of the 1998 Session Laws of Kansas on the
31       Kansas neurological institute foster grandparents program--fed-
32       eral fund is hereby increased from $270,000 to no limit.
33        (t) On the effective date of this act, of the $86,157,768 appro-
34       priated for the above agency for the fiscal year ending June 30,
35       1999, by section 120(a) of chapter 202 of the 1998 Session Laws of
36       Kansas from the state general fund in the state operations account,
37       the sum of $2,358,302 is hereby lapsed.
38        (u) On the effective date of this act, the director of accounts and
39       reports shall transfer $400,000 from the Larned state hospital fee
40       fund to the state general fund.
41        (v) On the effective date of this act, the director of accounts and
42       reports shall transfer $600,000 from the Osawatomie state hospital
43       fee fund to the state general fund.

  1        (w) (1) On and after the effective date of this act, the director of
  2       accounts and reports shall not make the transfers of interest earn-
  3       ings prescribed by section 120(n) of chapter 203 of the 1998 Ses-
  4       sion Laws of Kansas from the state general fund to the family and
  5       children trust account of the family and children investment fund
  6        (2) On the effective date of this act, or as soon thereafter as
  7       moneys are available therefor, the director of accounts and reports
  8       shall transfer from the family and children trust account of the
  9       family and children investment fund to the family and children
10       endowment account of the family and children investment fund
11       the amount that equals the aggregate of all amounts transferred
12       from the state general fund to the family and children trust ac-
13       count of the family and children investment fund prior to the ef-
14       fective date of this act during fiscal year 1999 pursuant to section
15       120(n) of chapter 203 of the 1998 Session Laws of Kansas.
16        (3) On or before the 10th day of each month commencing after
17       the effective date of this act during fiscal year 1999, and on or
18       before the 10th day of each month thereafter during fiscal year
19       1999, the director of accounts and reports shall transfer from the
20       state general fund to the family and children endowment account
21       of the family and children investment fund the amount equal to
22       the interest earnings of the family and children endowment ac-
23       count of the family and children investment fund which shall be
24       based upon: (1) The average daily balance of moneys in the family
25       and children endowment account of the family and children in-
26       vestment fund for the preceding month, and (2) the net earnings
27       rate of the pooled money investment board portfolio for the pre-
28       ceding month.
29        (x) On the effective date of his act, the director of accounts and
30       reports shall transfer $500,000 from the state operations account
31       of the state general fund to the childrens health insurance account
32       of the state general fund: Provided, That the secretary of social and
33       rehabilitation services is hereby authorized and directed to in-
34       crease the shrinkage rate for the field operations program for fis-
35       cal year 1999 for the purposes of this transfer of $500,000: Provided
36       further, That this $500,000 shall be used to provide the state gen-
37       eral fund matching amount to match $1,500,000 of Title XXI fund-
38       ing for any provider of managed health of Title XIX and Title XXI
39       health care recipients.

20        (a) On the effective date of this act, the expenditure limitation estab-

24              (b) (1) On the effective date of this act, the director of accounts
25       and reports shall reduce the expenditure limitation established
26       pursuant to section 160(b) of Chapter 203 of the 1998 Session Laws
27       of Kansas on the Kansas savings incentive program account of the
28       state highway fund of the above agency from $5,735,505.99 to $0.
29        (2) On the effective date of this act, the director of accounts and

37       employees retirement fund is hereby decreased from $2,400,000
38       to $2,250,000.
39        (b) In addition to the other purposes for which expenditures may
40       be made by the above agency from the agency operations account
41       of the Kansas public employees retirement fund for the fiscal year
42       ending June 30, 1999, as authorized by section 5(b) of chapter 202
43       or section 99(b) of the 1998 Session Laws of Kansas, expenditures

  2       purpose of paying bonus awards to unclassified employees pur-
  3       suant to procedures established by the board of trustees of the

  6       limitation on the agency operations account of suchthe Kansas

12        (a) On the effective date of this act, the expenditure limitation
13       on the aggregate of all expenditures for banking fees from the
14       pooled money investment portfolio fee fund during the fiscal year
15       ending June 30, 1999, established by section 91(b) of chapter 203
16       of the 1998 Session Laws of Kansas is hereby increased from the
17       limitation prescribed by that section to No limit.
18        Sec. 44.

JUDICIAL BRANCH
20        (a) In addition to the other purposes for which expenditures may
21       be made by the above agency from the moneys appropriated from
22       the state general fund or any special revenue fund for the fiscal
23       year ending June 30, 1999, as authorized by section 98 of chapter
24       203 of the 1998 Session Laws of Kansas or by this or other appro-
25       priation act of the 1999 regular session of the legislature, notwith-
26       standing any other law to the contrary, expenditures shall be made
27       by the above agency from the moneys appropriated from the state
28       general fund or any special revenue fund for fiscal year 1999 to
29       pay for the costs associated with relocating the offices of judges of
30       the district court, including support staff, to another judicial dis-
31       trict, if the judicial administrator determines, upon the death, res-
32       ignation or retirement of any judge of the district court in any
33       judicial district, that reassignment of the office of any such judge
34       of the district court to another judicial district would be beneficial
35       to provide for excessive case loads in that judicial district or to help
36       balance caseload management between judicial districts and any
37       such relocation and reassignment is hereby authorized.

30        (b) On the effective date of this act, the expenditure limitation

32       Laws of Kansas on the Kansas economic development initiatives
33       fund is hereby increased from $15,011,729 to $15,053,352.

36        (a) On the effective date of this act, of the $246,903 appropriated

  9             Sec. 41 52. [51.] Appeals to exceed position limitations. The limitations
10       imposed by this act on the number of full-time and regular part-time
11       positions equated to full-time, excluding seasonal and temporary posi-
12       tions, paid from appropriations for fiscal year 1999 made in this act or in
13       any appropriation act of the 1998 regular session of the legislature or in
14       any other appropriation act of the 1999 regular session of the legislature
15       may be exceeded upon approval of the state finance council.
16             Sec. 42 53. [52.] Appeals to exceed limitations. Upon written applica-
17       tion to the governor and approval of the state finance council, expendi-
18       tures from special revenue funds may exceed the amounts specified in
19       this act.
20             Sec. 43 54. [53.] This act shall take effect from and after its publication
21       in the Kansas register.
