  9             AN  ACT concerning school districts; requiring boards of education to
10             adopt policies prohibiting the use of tobacco products in school build-
11             ings and facilities and surrounding premises; amending K.S.A. 72-
12             53,107 and repealing the existing section.
13      
14       Be it enacted by the Legislature of the State of Kansas:
15             Section  1. K.S.A. 72-53,107 is hereby amended to read as follows:
16       72-53,107. (a) The use of tobacco products in any school building is
17       hereby prohibited. No board of education of any each school district shall
18       allow any person to use tobacco products adopt and enforce a policy
19       prohibiting the use by any person of tobacco products in any school build-
20       ing or facilities and the surrounding premises.
21             (b) As used in this section, the term "school building" means any
22       enclosed building used for pupil attendance purposes by the board of
23       education of a unified school district and the term "facilities" means any
24       installation used by the board of education for school sponsored activities
25       or events. The term school building does not include a building, or part
26       thereof, used for residential purposes or leased from the school district
27       for nonschool sponsored activities or events. 
28       Sec.  2. K.S.A. 72-53,107 is hereby repealed.
29        Sec.  3. This act shall take effect and be in force from and after its
30       publication in the statute book.
