9 AN ACT concerning locksmiths; imposing certain duties thereon.

11 Be it enacted by the Legislature of the State of Kansas:
12 Section 1. As used in this act:
13 (a) "Apprentice locksmith" means an individual who is registered in
14 a locksmith apprenticeship program that has been approved by the bu-
15 reau of apprenticeship and training of the United States department of
16 labor.
17 (b) "Key duplication machine" means any device that is capable of
18 copying and reproducing keys.
19 (c) "Locksmith" means an individual who provides locksmithing serv-
20 ices for any type of compensation.
21 (d) "Lockpicking tool" means any tool that is designed, or intended
22 by the user to be used, to open a mechanical or electrical locking device
23 by means other than that intended by the manufacturer of such device
24 for normal operation.
25 (e) "Locksmithing services" means:
26 (1) Repairing, rebuilding, servicing, adjusting or installing a mechan-
27 ical or electrical locking device, safe or vault;
28 (2) operating a mechanical or electrical locking device, safe or vault
29 by a means other than that intended by the manufacturer of such locking
30 device, safe or vault;
31 (3) opening, making keys by code for or by bypassing the locking
32 devices on vehicles by means other than that which were intended by the
33 manufacturers of such vehicles; or
34 (4) rendering technical advice concerning any activity described in
35 paragraphs (1, (2) or (3) of this subsection.
36 (f) "Photo identification card" means a valid Kansas driver's license
37 or Kansas nondriver's identification card.
38 (g) "Safe-opening tool" means any tool that is designed, or intended
39 by the user, to be used to open a safe, strongbox, safe deposit box or
40 similar object by means other than that intended by the manufacturer of
41 such safe, strongbox, safe deposit box or similar object for normal
42 opening.
43 (h) "Vehicle-opening tool" means any tool that is designed, or in-
44 tended by the user to be used, to open a motor vehicle of any type by
45 means other than that intended by the manufacturer of such motor ve-
46 hicles for normal opening.
47 Sec. 2. (a) Before providing locksmithing services, a locksmith or ap-
48 prentice locksmith shall require each person requesting such locksmi-
49 thing services to display a photo identification card. The locksmith or
50 apprentice locksmith shall record the name, address and phone number
51 of the person requesting the locksmithing services. The locksmith or ap-
52 prentice locksmith shall keep in such locksmith's or apprentice lock-
53 smith's records a copy of such information for at least one year following
54 the date of providing the locksmithing services.
55 (b) A photo identification card shall not be required to be carried or
56 shown during:
57 (1) The acquisition or use of any key duplication machine or key
58 blanks;
59 (2) the emergency performance of locksmithing services by members
60 of a law enforcement agency, fire department or other government
61 agency in their official line of duty; or
62 (3) bona fide sales demonstrations to locksmiths by sales
63 representatives.
64 (c) Violation of subsection (a) is a class A misdemeanor.
65 Sec. 3. This act shall take effect and be in force from and after its
66 publication in the statute book.
