9 AN ACT concerning county codes and resolutions; assessment of costs;
10 amending K.S.A. 1998 Supp. 19-4707 and repealing the existing
11 section.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 1998 Supp. 19-4707 is hereby amended to read as
15 follows: 19-4707. (a) Except as provided in subsection (b), no person shall
16 be assessed costs for enforcement and prosecution of violations of county
17 codes and resolutions pursuant to this code, except for witness fees and
18 mileage as set forth in K.S.A. 19-4726 and amendments thereto.
19 (b) The court shall assess as a cost in each case filed for violations of
20 county codes and resolutions, a $1 assessment an amount as determined
21 by the board of county commissioners. The judge or clerk of the court
22 shall remit at least monthly to the state treasurer all such assessments
23 received. The state treasurer shall deposit the entire amount of the re-
24 mittance in the state treasury and credit 50% to the protection from abuse
25 fund established pursuant to K.S.A. 74-7325 and amendments thereto
26 and 50% to the crime victims assistance fund established pursuant to
27 K.S.A. 74-7334 and amendments thereto.
28 Sec. 2. K.S.A. 1998 Supp. 19-4707 is hereby repealed.
29 Sec. 3. This act shall take effect and be in force from and after its
30 publication in the statute book.
