9 AN ACT concerning dental hygiene; funding of dental hygiene programs;
10 administration by the state board of education.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. As used in this act, unless the context otherwise requires:
14 (a) "Dental hygiene student" means a student who is regularly en-
15 rolled in a program of dental hygiene education.
16 (b) "Operating budget" means the adopted operating budget, as ap-
17 proved by the state board, for a program of dental hygiene education,
18 except for federal aid and amounts budgeted for acquisition or improve-
19 ment of land and construction, reconstruction or remodeling of buildings.
20 (c) "Federal aid" means federal moneys distributed to a school.
21 (d) "State aid" means state moneys distributed by the state board for
22 programs of dental hygiene education purposes, except aid moneys.
23 (e) "Aid" means state financial aid paid or payable under section 2
24 and amendments thereto.
25 (f) "Local cost" means the operating budget, less state aid.
26 (g) "Total enrollment" means the total number of hours all students
27 of a program of dental hygiene education are enrolled in a school year.
28 (h) "Local cost per enrollment hour" means local cost divided by total
29 enrollment of a program of dental hygiene education. The term means
30 the statewide average of the local cost per enrollment hour as determined
31 by the state board.
32 (i) "Total dental hygiene enrollment" means the total number of
33 hours all dental hygiene students are enrolled in a school year.
34 (j) "Program of dental hygiene education" means a program located
35 in Kansas or authorized to be provided in Kansas which is approved by
36 the Kansas dental board for the teaching of dental hygiene under the
37 dental practices act.
38 (k) "State board" means the state board of education.
39 Sec. 2. In lieu of any other state reimbursement for a program of
40 dental hygiene education, every program of dental hygiene education
41 shall be entitled to receive aid each school year in an amount equal to
42 85% of the product of local cost per enrollment hour and total enrollment
43 for the school year ending June 30, 2000, and each school year thereafter.
44 Sec. 3. The distribution of aid shall be made from appropriations
45 therefor each school year, commencing November 1, 2000, as follows:
46 (a) The amount of aid for each program of dental hygiene education
47 as computed by the state board shall be distributed in payments as follows:
48 On November 1 an amount equal to 50% of the estimated entitlement
49 for the school year, on March 1 an amount equal to 30% of such entitle-
50 ment and on May 1 the balance of such entitlement with adjustments for
51 overpayment or underpayment of the prior payments in accordance with
52 the most recent, available information. The state board shall certify to the
53 director of accounts and reports the amount due as aid to each program
54 of dental hygiene education five days before each payment date. If the
55 amount appropriated shall be insufficient to pay in full the amount each
56 program of dental hygiene education is entitled to receive as aid as com-
57 puted by the state board, then the entire amount remaining shall be
58 prorated among all such programs in proportion to the amount each pro-
59 gram is entitled to receive. The director of accounts and reports shall
60 draw his warrants on the state treasurer payable to the treasurer of each
61 program entitled to payment of aid, upon vouchers approved by the state
62 board. Upon receipt of such warrant, each such treasurer shall deposit
63 the same in the operating fund of the school.
64 In the event any program of dental hygiene education is paid more
65 than it is entitled to receive under any distribution made under this act,
66 the state board shall notify the program of the amount of such overpay-
67 ment, and such program shall remit the same to the state board. The state
68 board shall remit any moneys so received to the state treasurer, and the
69 state treasurer shall deposit the same in the state treasury to the credit
70 of the state general fund. If any such program fails so to remit, the state
71 board shall deduct the excess amounts so paid from future payments
72 becoming due to such program. In the event any program is paid less
73 than the amount to which it is entitled under any distribution made under
74 this act, the state board shall pay the additional amount due at any time
75 within the school year in which the underpayment was made or within
76 60 days after the end of such school year.
77 Sec. 4. This act shall take effect and be in force from and after its
78 publication in the statute book.
