9 AN ACT concerning certain electric public utilities; imposing certain
10 requirements on the sources of electricity sold to retail customers.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. (a) As used in this section, "electric public utility" has the
14 meaning provided by K.S.A. 66-101a and amendments thereto.
15 (b) Any electric public utility which owns or operates generation fa-
16 cilities in this state that have a total capacity of more than 4,000 megawatts
17 shall be required to use electricity generated at the utility's facilities lo-
18 cated in this state to supply at least 80% of the demand of the utility's
19 retail customers. Such electricity shall be generated by the most econom-
20 ically efficient of the utility's facilities located in this state and shall be
21 sold to the utility's retail customers on an equitable and nondiscriminatory
22 basis.
23 (c) Not less than 10% of the electricity sold to retail customers by an
24 electric public utility which owns or operates generation facilities in this
25 state that have a total capacity of more than 4,000 megawatts shall be
26 generated by conversion of wind, solar, biomass, landfill gas or other
27 renewable source of energy.
28 Sec. 2. This act shall take effect and be in force from and after its
29 publication in the statute book.
