11             AN  ACT concerning tobacco litigation settlement proceeds; deposit of 
12             settlement proceeds in children's health care programs fund; amend- 
13             ing K.S.A. 1998 Supp. 38-2008 and repealing the existing section.

15       Be it enacted by the Legislature of the State of Kansas:   
16              Section  1. K.S.A. 1998 Supp. 38-2008 is hereby amended to read as 
17       follows: 38-2008. (a) There is hereby established in the state treasury the 
18       children's health care programs fund in the department of the secretary 
19       of social and rehabilitation services. 
20              (b) All of the moneys received by the state  pursuant to the tobacco 
21       litigation settlement agreement entered into or any  judgment rendered, 
22       regarding the litigation against tobacco industry companies and related 
23       entities, 50% of such moneys shall be credited to the children's health 
24       care programs fund. 
25              (c) All moneys credited to the children's health care programs fund 
26       shall be used for the purposes of providing additional funding for chil- 
27       dren's health care, services for children and tobacco use prevention and 
28       cessation programs. 
29              (d) All expenditures from the children's health care programs fund 
30       shall be made in accordance with appropriation acts upon warrants of the 
31       director of accounts and reports issued pursuant to vouchers approved 
32       by the secretary of social and rehabilitation services or the secretary's 
33       designee.  
34       Sec.  2. K.S.A. 1998 Supp. 38-2008 is hereby repealed. 
35        Sec.  3. This act shall take effect and be in force from and after its 
36       publication in the Kansas register.
