10 AN ACT concerning the Kansas industrial training program and the Kan-
11 sas industrial retraining program; affecting the definition of job train-
12 ing agency; amending K.S.A. 1998 Supp. 74-5065 and repealing the
13 existing section.

15 Be it enacted by the Legislature of the State of Kansas:
16 Section 1. K.S.A. 1998 Supp. 74-5065 is hereby amended to read as
17 follows: 74-5065. As used in this act:
18 (a) "Kansas industrial training program" or "KIT program" means a
19 program under which the secretary provides for training, customized to
20 meet the specifications of a new or expanding industry, of new employees
21 or prospective employees, or both, of the industry.
22 (b) "Kansas industrial retraining program" or "KIR program" means
23 a program under which the secretary provides for retraining, customized
24 to meet the specifications of a restructuring industry, of employees of the
25 industry.
26 (c) "New or expanding industry" means an industry which is locating
27 or is newly located in Kansas or an existing industry which is located in
28 Kansas and is expanding its work force.
29 (d) "Training" means training of employees or preemployment train-
30 ing of prospective employees for jobs newly created by a new or expand-
31 ing industry.
32 (e) "Restructuring industry" means an existing industry which is lo-
33 cated in Kansas and is restructuring its operations through incorporation
34 of existing technology, development and incorporation of new technology,
35 diversification of production or development and implementation of new
36 production.
37 (f) "Retraining" means retraining of employees of a restructuring in-
38 dustry who are likely to be displaced because of obsolete or inadequate
39 job skills and knowledge.
40 (g) "Job training agency" means any public or private educational or
41 job training institution, any provider of an apprenticeship program that
42 is registered through the Kansas apprenticeship council and recognized
43 by the United States department of labor, bureau of apprenticeship train-
44 ing, and any other public or private entity which is qualified to provide
45 the training or retraining required under the KIT and KIR programs.
46 (h) "Secretary" means the secretary of commerce and housing.
47 (i) "Agricultural land," "corporation," "corporate partnership," "lim-
48 ited liability company," "limited partnership," "swine production facility"
49 and "trust" have the meanings ascribed pursuant to K.S.A. 17-5903, and
50 amendments thereto.
51 Sec. 2. K.S.A. 1998 Supp. 74-5065 is hereby repealed.
52 Sec. 3. This act shall take effect and be in force from and after its
53 publication in the statute book.
