9 AN ACT relating to the state gaming revenues fund; providing funding
10 for capital improvements for state parks and local outdoor recreation
11 grants; amending K.S.A. 79-4801, 79-4803 and 79-4804 and repealing
12 the existing sections.

14 Be it enacted by the Legislature of the State of Kansas:
15 Section 1. K.S.A. 79-4801 is hereby amended to read as follows: 79-
16 4801. There is hereby created the state gaming revenues fund in the state
17 treasury. All moneys credited to such fund shall be expended or trans-
18 ferred only for the purposes and in the manner provided by this act and
19 all expenditures from the state gaming revenues fund shall be made in
20 accordance with appropriation acts. All moneys credited to such fund shall
21 be allocated and credited monthly to the funds and in the amounts spec-
22 ified by this act except that the total of the amounts credited to such
23 funds in any one fiscal year pursuant to this act shall not exceed
24 $50,000,000 $55,000,000. All amounts credited to such fund in any one
25 fiscal year which are in excess of $50,000,000 $55,000,000 shall be trans-
26 ferred and credited to the state general fund on July 15, 1996, and June
27 25, 1997, and each year thereafter on June 25.
28 Sec. 2. K.S.A. 79-4803 is hereby amended to read as follows: 79-
29 4803. (a) (1) An amount equal to 10% 9.091% of all moneys credited to
30 the state gaming revenues fund shall be transferred and credited to the
31 correctional institutions building fund created pursuant to K.S.A. 76-6b09
32 and amendments thereto, to be appropriated by the legislature for the
33 use and benefit of state correctional institutions as provided in K.S.A. 76-
34 6b09 and amendments thereto; and
35 (2) an amount equal to 5% 4.545% of all moneys credited to the state
36 gaming revenues fund shall be transferred and credited to the juvenile
37 detention facilities fund.
38 (b) There is hereby created in the state treasury the juvenile deten-
39 tion facilities fund which shall be administered by the commissioner of
40 juvenile justice as approved by the Kansas advisory group on juvenile
41 justice and delinquency prevention. All expenditures from the juvenile
42 detention facilities fund shall be for the retirement of debt of facilities
43 for the detention of juveniles; or for the construction, renovation, remod-

1 eling or operational costs of facilities for the detention of juveniles in
2 accordance with a grant program which shall be established with grant
3 criteria designed to facilitate the expeditious award and payment of grants
4 for the purposes for which the moneys are intended. "Operational costs"
5 shall not be limited to any per capita reimbursement by the commissioner
6 of juvenile justice for juveniles under the supervision and custody of the
7 commissioner but shall include payments to counties as and for their costs
8 of operating the facility. The commissioner of juvenile justice shall make
9 grants of the moneys credited to the juvenile detention facilities fund for
10 such purposes to counties in accordance with such grant program. All
11 expenditures from the juvenile detention facilities fund shall be made in
12 accordance with appropriation acts upon warrants of the director of ac-
13 counts and reports issued pursuant to vouchers approved by the com-
14 missioner of juvenile justice or the commissioner's designee.
15 Sec. 3. K.S.A. 79-4804 is hereby amended to read as follows: 79-
16 4804. (a) An amount equal to 85% 86.364% of all moneys credited to the
17 state gaming revenues fund shall be transferred and credited to the state
18 economic development initiatives fund. Expenditures from the state ec-
19 onomic development initiatives fund shall be made in accordance with
20 appropriations acts for the financing of such programs supporting and
21 enhancing the existing economic foundation of the state and fostering
22 growth through the expansion of current, and the establishment and at-
23 traction of new, commercial and industrial enterprises as provided by this
24 section and as may be authorized by law and not less than 12 of such
25 money shall be distributed equally among the congressional districts of
26 the state. Except as provided by subsection (g) subsections (g), (h) and
27 (i), all moneys credited to the state economic development initiatives fund
28 shall be credited within the fund, as provided by law, to an account or
29 accounts of the fund which are created by this section.
30 (b) There is hereby created the Kansas capital formation account in
31 the state economic development initiatives fund. All moneys credited to
32 the Kansas capital formation account shall be used to provide, encourage
33 and implement capital development and formation in Kansas.
34 (c) There is hereby created the Kansas economic development re-
35 search and development account in the state economic development in-
36 itiatives fund. All moneys credited to the Kansas economic development
37 research and development account shall be used to promote, encourage
38 and implement research and development programs and activities in Kan-
39 sas and technical assistance funded through state educational institutions
40 under the supervision and control of the state board of regents or other
41 Kansas colleges and universities.
42 (d) There is hereby created the Kansas economic development en-
43 dowment account in the state economic development initiatives fund. All

1 moneys credited to the Kansas economic development endowment ac-
2 count shall be accumulated and invested as provided in this section to
3 provide an ongoing source of funds which shall be used for economic
4 development activities in Kansas, including but not limited to continuing
5 appropriations or demand transfers for programs and projects which shall
6 include, but are not limited to, specific community infrastructure projects
7 in Kansas that stimulate economic growth.
8 (e) Except as provided in subsection (f), the director of investments
9 may invest and reinvest moneys credited to the state economic develop-
10 ment initiatives fund in accordance with investment policies established
11 by the pooled money investment board under K.S.A. 75-4232, and
12 amendments thereto, in the pooled money investment portfolio. All mon-
13 eys received as interest earned by the investment of the moneys credited
14 to the state economic development initiatives fund shall be deposited in
15 the state treasury and credited to the Kansas economic development en-
16 dowment account of such fund.
17 (f) Moneys credited to the Kansas economic development endow-
18 ment account of the state economic development initiatives fund may be
19 invested in government guaranteed loans and debentures as provided by
20 law in addition to the investments authorized by subsection (e) or in lieu
21 of such investments. All moneys received as interest earned by the in-
22 vestment under this subsection of the moneys credited to the Kansas
23 economic development endowment account shall be deposited in the
24 state treasury and credited to the Kansas economic development endow-
25 ment account of the state economic development initiatives fund.
26 (g) In each fiscal year, the director of accounts and reports shall make
27 transfers in equal amounts on July 15 and January 15 which in the aggre-
28 gate equal $2,000,000 from the state economic development initiatives
29 fund to the state water plan fund created by K.S.A. 82a-951, and amend-
30 ments thereto. No other moneys credited to the state economic devel-
31 opment initiatives fund shall be used for: (1) Water-related projects or
32 programs, or related technical assistance; or (2) any other projects or
33 programs, or related technical assistance, which meet one or more of the
34 long-range goals, objectives and considerations set forth in the state water
35 resource planning act.
36 (h) In each fiscal year, the director of accounts and reports shall make
37 transfers in equal amounts on July 15 and January 15 which in the ag-
38 gregate equal $2,000,000 from the state economic development initiatives
39 fund to the local government outdoor recreation grants fund.
40 (i) In each fiscal year, the director of accounts and reports shall make
41 transfers in equal amounts on July 15 and January 15 which in the ag-
42 gregate equal $3,000,000 from the state economic development initiatives
43 fund to the state parks comprehensive capital improvements fund, which

1 is hereby created in the state treasury and shall be administerd by the
2 secretary of wildlife and parks. All expenditures from the state parks com-
3 prehensive capital improvements fund shall be made in accordance with
4 appropriations acts upon warrants of the director of accounts and reports
5 issued pursuant to vouchers approved by the secretary of wildlife and
6 parks or the secretary's designee.
7 Sec. 4. K.S.A. 79-4801, 79-4803 and 79-4804 are hereby repealed.
8 Sec. 5. This act shall take effect and be in force from and after its
9 publication in the statute book.
