  9             AN  ACT relating to city water supply systems; requiring an election on
10             fluoridation.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. (a) On and after January 1, 2000, no city shall provide for
14       fluoridation of the public water supply of the city unless the question of
15       fluoridation is first submitted to and approved by the registered voters of
16       the city.
17             (b) The governing body of a city may adopt an ordinance providing
18       for the fluoridation of the public water supply of such city. Such ordinance
19       shall not take effect until the registered voters of the city approve fluor-
20       idation of the public water supply of such city at an election held for that
21       purpose.
22             (c) Upon adoption of an ordinance providing for fluoridation of the
23       public water supply of a city, the governing body of the city shall submit
24       the following question to the registered voters of the city: "Shall the city
25       of ________ fluoridate the city water supply?" The date of the election
26       shall be fixed in the ordinance and the election shall be called and held
27       in the manner provided for elections under the general bond law. If a
28       majority of the registered voters voting on the question vote in favor of
29       the question, the ordinance providing for fluoridation of the public water
30       supply of the city shall take effect and the public water supply of the city
31       may be fluoridated. If a majority of the registered voters voting on the
32       question vote against the question, the ordinance providing for fluorida-
33       tion of the public water supply of the city shall not take effect and the
34       public water supply of the city shall not be fluoridated.
35        Sec.  2. This act shall take effect and be in force from and after its
36       publication in the statute book.
