  9             AN  ACT concerning counties; relating to county officers.

11       Be it enacted by the Legislature of the State of Kansas:
12             Section  1. (a) County officers shall devote all necessary time for the
13       faithful performance of the duties of the office to which elected.
14             (b) If any elected county officer is absent from such office more than
15       five days or more than 40 hours in any calendar year, the board of county
16       commissioners of such county shall call and hold a meeting to determine
17       if the duties of the office are being executed as required by law. When
18       determining time of absence, the provisions of this subsection shall not
19       apply to:
20             (1) Any time when the office of such officer is not open to the public
21       for business;
22             (2) any absence which is attributable to the attendance of official
23       business of the county;
24             (3) any absence which is attributable to the attendance of meetings
25       and seminars which the officer determines will be beneficial to the op-
26       eration of the office; or
27             (4) any time used as vacation or sick leave.
28             (c) If the board of county commissioners call and hold a meeting
29       pursuant to this section, the affected county officer shall be allowed to
30       give testimony relating to any absence from the office not excluded pur-
31       suant to subsection (b) and matters relating to the performance of the
32       duties of office. Following such hearing, the board shall determine
33       whether such officer is devoting all necessary time for the faithful per-
34       formance of the duties of office to which such officer was elected. The
35       findings shall be spread on the journal of the meeting of the board.
36        Sec.  2. This act shall take effect and be in force from and after its
37       publication in the statute book.
