  9             AN  ACT relating to adult care homes; smoke detectors therein; amend-
10             ing K.S.A. 39-932 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. K.S.A. 39-932 is hereby amended to read as follows: 39-
14       932. The licensing agency shall adopt, amend, promulgate and enforce
15       such rules, regulations and standards as may be deemed practicable, rea-
16       sonable and necessary with respect to all adult care homes, to be licensed
17       hereunder and as may be designed to further the accomplishment of the
18       purpose of this law in promoting safe, proper and adequate treatment
19       and care of individuals in adult care homes in the interest of public health,
20       safety and welfare. Such rules and regulations may prescribe minimum
21       standards and requirements relating to the location, building, construc-
22       tion, size, equipment and facilities of adult care homes, the number and
23       kind of residents allowed, the types of care offered, the records to be
24       kept, the kind and frequency of reports and inventories to be made, and
25       may generally establish such requirements as may be deemed necessary
26       to protect the health, safety, hygiene, welfare and comfort of the resi-
27       dents. The licensing agency shall require that a properly installed smoke
28       detector be placed in each resident's room.
29             Adult care homes which are in operation at the time of promulgation
30       of any applicable rules and regulations or minimum standards under this
31       act shall be given a reasonable time, under the particular circumstances
32       not to exceed twelve (12) 12 months from the date of such promulgation,
33       within which to comply with such rules and regulations and minimum
34       standards. The licensing agency may further establish by regulation a
35       system whereby it may, on the basis of the investigations and evaluations
36       herein provided for, uniformly rate adult care homes in terms of the
37       quality and quantity of services and facilities provided. 
38       Sec.  2. K.S.A. 39-932 is hereby repealed.
39        Sec.  3. This act shall take effect and be in force from and after its
40       publication in the statute book.
