  9             AN ACT concerning crimes and punishment; relating to the crime of
10             arson; amending K.S.A. 21-3718 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section 1.   K.S.A. 21-3718 is hereby amended to read as follows: 21-
14       3718. (a) Arson is knowingly, by means of fire or explosive:
15             (1)   Damaging any building, manufactured home, mobile home, tent
16       or other structure or property in which another person has any interest
17       without the consent of such other person; or
18             (2)   damaging any building, manufactured home, mobile home, tent
19       or other structure or property with intent to injure or defraud an insurer
20       or lienholder.
21             (b) (1)   Arson is a severity level 5, nonperson felony if the property
22       is not a dwelling and is damaged to the extent of $50,000 or more.
23             (2)   Arson is a severity level 6, nonperson felony if the property is not
24       a dwelling and is damaged to the extent of at least $25,000 but less than
25       $50,000.
26             (3)   Arson is a severity level 7, nonperson felony if the property is not
27       a dwelling and is damaged to the extent of less than $25,000.
28             (4)   Arson is a severity level 5, person felony if the property is a
29       dwelling and is damaged to the extent of $1,000 or more.
30             (5)   Arson is a severity level 6, person felony if the property is a
31       dwelling and is damaged to the extent of less than $1,000.  
32       Sec. 2.   K.S.A. 21-3718 is hereby repealed.
33         Sec. 3.   This act shall take effect and be in force from and after its
34       publication in the statute book.
