  9             AN ACT concerning elections; relating to campaign finance; amending
10             K.S.A. 25-4142 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section 1.   K.S.A. 25-4142 is hereby amended to read as follows: 25-
14       4142. K.S.A. 25-4119e, 25-4119f, 25-4119g, 25-4142 to 25-4179, inclusive,
15       and amendments thereto and 25-4119e, 25-4119f, 25-4119g, 25-4148a,
16       25-4153a, 25-4157a, 25-4169a, 25-4180 to 25-4185, inclusive through 25-
17       4187 and section 1, and amendments thereto shall constitute and may be
18       cited as the "campaign finance act."
19             New Sec. 2.   No officer or employee of the state of Kansas, any
20       county, any unified school district having 35,000 or more pupils regularly
21       enrolled in the preceding school year, city of the first class or the board
22       of public utilities of the unified government of Wyandotte county/Kansas
23       City, Kansas, responsible for the disbursement of funds in payment of
24       wages or salaries shall withhold or divert a portion of an employee's wages
25       or salaries for contributions to political committees for use as political
26       contributions except upon the written request of the employee. Any new
27       request after the effective date of this act shall be made on a form ap-
28       proved by the Kansas commission of governmental standards and con-
29       duct. The form shall contain a clear and unambiguous statement that the
30       employee may choose not to make such request for deduction which shall
31       not affect in any way membership to an organization which is affiliated
32       with the political action committee. The form shall include a statement
33       which states: "Attached to this form is a list of political parties and political
34       committees which the employee may designate as recipient of such con-
35       tribution." Such list shall include, but not be limited to:
36             (1)   The political parties whose candidate for governor polled at least
37       5% of the total vote cast for all candidates for governor in the preceding
38       general election; and
39             (2)   the political committees to which such contributions are to be or
40       may be made.
41             The form shall include a space for the employee to designate which
42       political party or political committee is to receive such employee's con-
43       tribution. The form also shall include a space for the employee to des-

  1       ignate a specific recipient other than those specified on the list and a
  2       space for undesignated contributions. Any form which is not personally
  3       completed and signed by the employee shall be void.
  4             Nothing in this section shall be construed as voiding requests made
  5       prior to July 1, 1999.

35        Sec. 5.   This act shall take effect and be in force from and after its
36       publication in the statute book.
