10 AN ACT concerning automobiles and other vehicles; relating to traffic;
11 use of head lamps; amending K.S.A. 8-1703 and repealing the existing
12 section.

14 Be it enacted by the Legislature of the State of Kansas:
15 Section 1. K.S.A. 8-1703 is hereby amended to read as follows: 8-
16 1703. (a) Every vehicle, except as provided in subsection (b), upon a
17 highway within this state, at any time all times: (1) From sunset to sunrise
18 and at any other time,; (2) when due to insufficient light or unfavorable
19 atmospheric conditions, persons and vehicles on the highway are not
20 clearly discernible at a distance of 1,000 feet ahead,; or (3) when wind-
21 shield wipers are in use as a result of smoke, fog, rain, sleet or snow shall
22 display lighted head and other lamps and illuminating devices as required
23 for different classes of vehicles, subject to exceptions with respect to
24 parked vehicles. The provisions of this act related to subsection (a)(3) shall
25 not apply when windshield wipers are used intermittently in misting rain,
26 sleet or snow. Stop lights, turn signals and other signaling devices shall
27 be lighted as prescribed for the use of such devices.
28 (b) Motorcycles, motor-driven cycles and motorized bicycles manu-
29 factured after January 1, 1978, shall display lighted head and tail lights at
30 all times that such vehicles are operated on any highway.
31 (c) Law enforcement officers shall not stop drivers for violations of
32 subsection (a)(3) in the absence of another violation of law. A citation for
33 violation of subsection (a)(3) shall not be issued without citing the viola-
34 tion that initially caused the officer to effect the enforcement stop.
35 Sec. 2. K.S.A. 8-1703 is hereby repealed.
36 Sec. 3. This act shall take effect and be in force from and after its
37 publication in the statute book.
