9 AN ACT pertaining to laser pointers; prohibiting sale and possession un-
10 der certain conditions.

12 Be it enacted by the Legislature of the State of Kansas:
13 Section 1. It is the purpose of this act to place limitations on the
14 indiscriminate use of laser pointers and the sale of such instruments, and
15 to place certain prohibitions on their possession.
16 Sec. 2. It shall be unlawful for anyone to aim the beam of a laser
17 pointer at police officers and emergency workers engaged in the perform-
18 ance of their official duties. Violation of this subsection is a Class B person
19 misdemeanor.
20 Sec. 3. It shall be unlawful for any person to sell, give or furnish a
21 laser pointer to any person who is under 18 years of age. Violation of this
22 subsection is a class B person misdemeanor punishable by a minimum
23 fine of $200.
24 Sec. 4. Except as is needed for a school assignment, it shall be un-
25 lawful for any person under the age of 18 years to possess a laser pointer
26 in, or on, or within 1,000 feet of any school property upon which is located
27 a structure used by a unified school district or an accredited nonpublic
28 school for student instruction or attendance, or for extracurricular activ-
29 ities of pupils enrolled in kindergarten or any of the grades one through
30 12. Any laser pointer discovered within the above described premises not
31 used as part of a school assignment is subject to confiscation by school
32 officials, security personnel or police officers.
33 Sec. 5. This act shall take effect and be in force from and after its
34 publication in the statute book.
