10 AN ACT concerning certain nonprofit public utilities; amending K.S.A.
11 66-104c and repealing the existing section.

13 Be it enacted by the Legislature of the State of Kansas:
14 Section 1. K.S.A. 66-104c is hereby amended to read as follows: 66-
15 104c. (a) Except as otherwise provided in subsection (b), no nonprofit
16 public utility shall be subject to the jurisdiction, regulation, supervision
17 and control of the state corporation commission if the utility meets the
18 following conditions: (1) Every customer, shareholder, household or
19 meter owner is an automatic owner of the utility and has an equal vote
20 on matters concerning the utility; (2) the utility employs no full-time
21 employees; and (3) the utility has no more than 50 100 customers, pro-
22 vided that customer additions resulting from sales or transfers of real
23 property or rights in tenancy shall not be counted for purposes of deter-
24 mining the maximum number of customers.
25 (b) The state corporation commission shall retain jurisdiction and
26 control over the service territory of a utility described in subsection (a)
27 and over all matters concerning natural gas pipeline safety.
28 Sec. 2. K.S.A. 66-104c is hereby repealed.
29 Sec. 3. This act shall take effect and be in force from and after its
30 publication in the statute book [Kansas register].
