  9             AN  ACT concerning certain counties; relating to county surveyors;
10             amending K.S.A. 19-1401 and repealing the existing section.

12       Be it enacted by the Legislature of the State of Kansas:
13             Section  1. K.S.A. 19-1401 is hereby amended to read as follows: 19-
14       1401. (a) Beginning with the general election in 1976, there shall be
15       elected a county surveyor in Shawnee and Wyandotte counties Wyandotte
16       county. Such county surveyor shall hold office for a term of four years
17       and until a successor is elected and qualified. Such county surveyor shall,
18       Before entering upon the duties of the office, the county surveyor shall
19       take and subscribe an oath or affirmation that such county surveyor will
20       faithfully, impartially and to the best of such county surveyor's skill and
21       ability discharge the duties of county surveyor. Such county surveyor shall
22       also shall execute to the state of Kansas a bond in the amount of $2,000,
23       with at least two sureties, as the county clerk may deem deems sufficient,
24       conditioned on the faithful performance of the duties of the office, as
25       provided for by law, and. Such bond shall be filed in the office of the
26       county clerk.
27             No person shall be eligible to hold the office of county surveyor who
28       is not a land surveyor licensed to practice under the provisions of K.S.A.
29       74-7001 et seq., and amendments thereto. Nothing in this act shall be
30       construed to prohibit any such person from being county surveyor of
31       more than one county at the same time.
32             (b) The elective office of Shawnee county surveyor in existence on the
33       effective date of this act shall be abolished on January 7, 2001.  
34       Sec.  2. K.S.A. 19-1401 is hereby repealed.
35        Sec.  3. This act shall take effect and be in force from and after its
36       publication in the statute book.
